Mehrens, Jr. and Gloria M. Mehrens, as co-owners, hereinafter called the Grantors, are the owners in fee of that certain parcel of land situated in the City of Renton, County of King, State of Washington, more particularly described as follows: That portion of Henry H. Tobin donation Claim No. 37 in the northeast quarter of Section 18, Township 23 North, Range 5 East, W.M., in King County, Washington, described as follows: � Beginning 335 feet north and 37.13 feet east of the southwest corner of the 2 acre tract of land sold to D.C. Mitchell by Charles Burhn, Apri126, 1900, the deed for which is recorded in Volume 254 of Deeds, Page 140, Records f King � � County Washington, (said corner being 1077.12 feet west and 1136.52 feet north � of the southwest corner of block 25 of the town of Renton); thence north 240 feet; p� thence east 77.57 feet; thence south 240 feet;thence west 77.57 feet to the Point � of Beginning. Q hereinafter called"Grantors' property", and outlined on the attached map (Exhibit A); � O � NOW, THEREFORE,the Grantors, for themselves, their heirs, administrators, � executors, successors and assigns, do hereby grant, bazgain, sell and convey unto the Renton Municipal Airport, City of Renton, hereinafter called the Grantee, its successors and assigns, for the use and benefit of the public, an easement and right-of-way, appurtenant to the Renton Municipal Airport, for the unobstructed passage of a11 aircraft, ("aircraft"being defined for the purpose of this instrument as any contrivance now known or hereafter invented, used or designed for navigation of or flight in the air)by p whomsoever owned or operated. � � In the airspace above Grantors' property above an imaginary plane rising and -- extending in a generally easterly direction over Grantor's property, said imaginary plane , running from approximately eighty-three(83)feet above mean sea level above Point A on � Exhibit B, generally the location of the southwest corner of the Grantors' property, at the � rate of one (1)foot vertically for each seven(7) feet horizontally, to appro�mately ninety- � eight (98) feet above mean sea level above Point B, generally the location of the northeast � corner of the Grantors' property, in E�ibit B, to an infinite height above said imaginary � plane, together with the right to cause in all airspace above the surface of Crrantors' � property such noise, vibrations, fumes, dust, fuel particles, and a11 other effects that may " be caused by the operation of aircraft landing at, or taking off from, or operating at or on � said Renton Municipal Airport; and Grantors do hereby fully waive, remise, and release � any right or cause of action which they may now have or which they may have in the � future against Grantee, its successors and assigns, due to such noise, vibrations, fumes, „ �, dust, fuel particles, and a11 other effects that may be caused or may have been caused by •.A opD i � r �`" �� �� EX TAX NO i REQUIRED �, � ��e�'�� Kir�g Rec s Division B �,,..�., eputy � � V • I • � the operation of aircraft landing at, or taking off from, or operating at or on said Renton Municipal Airport. The easement and right-of-way hereby ganted includes the continuing right in the Grantee to prevent the erection or growth upon Grantors' property of any building, structure, tree or other object e�ending into the airspace above the said mean sea level of eighty-three(83)feet, and to remove from said airspace, or at the sole option of the Grantee, as an alternative, to mark and light as obstructions to air navigation, any such building, structure, tree or other objects now upon, or which in the future may be upon Grantor's property, together with the right of ingess to, egess from, and passage over Grantor's property for the above purposes. TO HAVE AND TO HOLD said easement and right-of-way, and all rights appertaining thereto unto the Grantee, its successors, and assigns, until said Renton Municipal Airport shall be abandoned and sha11 cease to be used for public airport purposes. AND the Grantors, for themselves, their heirs, administrators, executors, successors, and assigns, do hereby agree that for and during the life of said easement and right-of-way, they will not hereafter erect, permit the erection or growth of, or pernut or ;� suffer to remain upon Crrantors' property any building, structure, tree or other object � extending into the aforesaid prohibited airspace, end that they sha11 not hereafter use or �. permit or suffer the use of Grantors' properry in such a manner as to create electrical � interference with radio communication between any installation upon said airport and � aircraft, or as to make it difficult for flyers to distinguish between airport lights and others, � or as to impair visibility in the vicinity of the airport or as otherwise to endanger landing, � taking off or maneuvering of aircraft, it being understood and agreed that the aforesaid � covenants and agreements shall run with the land.
