, a r - f DRAINAGE HOLD HARMLESS AGREEMENT TO BE RECORDED on the following described property situated in King County, Washington : SEE ATTACHMENT "A" : WHEREAS the undersigned, as a property owner within the City of Renton or developer within the City of Renton is building or has built improvements which require a storm drainage system to be installed, and WHEREAS the undersigned has a storm drainage system installed on the property in question and installation of the City required storm drainage system would require the installation of a duplicate, parallel system, and WHEREAS the undersigned wishes to save the expense of the Up installation of such a parallel system, while realizing that the M O utilization of the on-site storm drainage system might result in Q` co additional risk of damage to the system, and O co WHEREAS the undersigned does not wish to install a separate aD storm drainage system to convey runoff from adjacent properties and/or public rights-of-way across or around the above-described property, and WHEREAS the storm drainage system installed in and across the above-described property has adequate capacity, based upon full development in accordance with current zoning to convey the runoff from adjacent properties and/or public rights-of-way, and WHEREAS the undersigned does hereby agree and consent to allow without benefit of a specific easement the connection to and extension ofthe private storm drainage system, NOW THEREFORE, in consideration of the City of Renton not requiring a separate storm drainage system, the undersigned does agree to hereby establish, grant and impose restrictions and covenants running with the land herein described with respect to the operation and Filed for Record at Request of: City Clerk -1- City of Renton �©— ^ ^, e0 MillAve. S. uy(`�1( Renton, WA 98055 •, maintenance of the on-site storm drainage system by the undersigned, their successors , heirs and assigns and to hold the City of Renton harmless from any claims , causes of action, damages , liability loss or cost, or expense of any type or nature which may accrue to the City by reason of the waiver of these improvements , or by invasion by surface water onto the above-described property or by connection to and extension of the private storm water system, to include the cost of any suit or defense by the City , the undersigned shall likewise, when it has obtained written notice from the City, assume and defend any such suit or action without cost or expense to the City, including payment of any judgment or cost. . i :�n cQnY 174-Ki 1 'RCS.
