statute desires to extend the term of said latecomers agreement an additional five year
period of time.

NOW, THEREFORE, the parties hereto do agree as follows:

1. The latecomers agreement entitled "Agreement and.Conveyance ke: Utilities
Systems," recorded under Auditor's File No. 8106010666, is hereby extended an additional
five year period of time and will now expire August 20, 1995.
2. The developer is the owner of the following described property, to wit:
That portion of the South f of the South 1 of the SW 1 of the NE a of Section 3, Township
23 North, Range 5 East, W.M. King County, Washington, lying east of the following •
described line: Beginning at the southwest corner of the SE I of the NW # of said Section
3, thence S 87° 26' 08" E along the south line of the SE # of the NW + of said section and
the south line of the SW+ of the NE+ of said section a distance of 1780.25 feet to the true _
point of beginning; thence N 2° 33' 52" E at right angles to said south line a distance of
310.36 feet to the north line of the Si of the Si of SW+ of the NE+ of said Section 3.
Together with an easement for ingress, egress and utilities, over, under, upon or
across the south 30 feet of that portion of the SE; of the NW; lying east of 138th Avenue
SE and the south 30 feet of the SW+ of the NE+, less the east 871.01 feet thereof, all in
Section 3, Township 23 North, Range 5 East, W.M. in King County, Washington.

The improvement installed that is the basis for this latecomers agreement is
