The fence was partially constructed without a required special fence permit and is being reviewed under code case violation number CODE19-000256. The property is located within the R-8 zone. The applicant proposes to retain the 6 foot tall fence directly on the west (front yard) and south (side yard) property line within the front yard setback (See Exhibit 1). The applicant states that a 6 foot tall cedar fence is necessary within the front yard setback to preserve privacy. Pursuant to Renton Municipal Code (RMC) 4-4-040G.1.a., a special fence permit is required for fences that exceed forty eight inches (48") within a front yard setback. Per RMC 4-4-040G.2, the Administrator may approve the issuance of special fence permits provided that the following objectives can be met: the proposed fence improves the privacy and security of the adjoining yard space (criterion a); the proposed fence does not detract from the quality of the residential environment by being out of scale or creating vast blank walls along public roadways (criterion b); the proposed fence compliments the environment it serves in an aesthetically pleasing manner (criterion c); and the proposed fence does not present a hazard to vehicular or pedestrian traffic (criterion d). City staff agrees with the applicant's justification for front yard privacy and agrees that the cedar fence material compliments the environment it serves in an aesthetically pleasing manner. Therefore, staff agree that the proposed fence meets criterion a and c of RMC 4-4-040G.1.a. Without the incorporation of a landscaped buffer between the proposed fence and the public street, the proposed 6-foot tall fence acts as a blank wall along the public street. In addition, the driveway for the neighboring property to the south is only 5-feet from the southern (side) property line. Back-out visibility from the existing neighboring driveway is impaired with the installation of the 6-foot tall fence, which endangers both other vehicles and pedestrians. Therefore, staff recommends as a condition of approval that the proposal be revised to include a minimum 10-foot landscape strip between the front property line and the fence. The landscape strip shall include a mixture of trees, shrubs, and groundcover plants. The landscape strip shall be planted with 22 ground cover plants (minimum 4 inch pots) per 5 linear feet and 10 low shrubs (minimum mature height of 3 feet) per 5 linear feet, and shall comply with the planting standards of RMC4-4-040D.3.e.iv-vi. The applicant shall submit a landscape plan for review and approval prior to landscaping installation. The applicant shall contact the current planning project manager following installation of the landscaping for an inspection. Provided conditions of approval are met, the proposal will meet all criteria for approval of a special fence permit. The inspection of the approved landscape plan resolves code case number CODE19-000256. Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. I feel more safe with my fence. My neighbor and his dad harass me. That side of my fence hasn’t been put up yet. And the people on the corner lot sell drugs and have people wait outside my house staring into my house all day, who also harass me. All privacy I had has been taken away by this developer who harasses me, and I can see passed my fence when I am at the stop sign on sixth and also exiting my property. I’d also like to know if this was a complaint made by my neighbor Andrew Wenzl who stole my property. His dad, who is in contract with the city, I have had to call the police on for harassment. I have the police report. Here are also pictures of clear lines of vision. The only thing that isn’t clear anymore is sight into my home. My car hardly goes beyond the white line at the stop sign on 6th and my car is not even close to being in the roadway to be able to see. And I can see with plenty of time to make a rash decision to enter the roadway or not. Here is a video of his crew using my property without my permission. I have lived in this home for seven years and I am being made to feel unwelcome in my own neighborhood and uncomfortable. I had to again report the developer to a police officer who came to my home last August when this developer threatened me. He has walked onto my property without my permission. He has used my property without my permission. I am concerned he removed a property steak. He has tried to steal my property without my permission. And I intend to stay on my property and keep my home for the rest of my life. This fence helps create a noise barrier for increased traffic in my area, it gives me privacy. People driving by can actually still see over the top of my fence. It is a good quality cedar fence. It was really expensive and it took a lot of hard work to put up.
