FA No. F-405 ( ) RES-325 Project No. A40504N 10/2014 Page 1 of 5 pages Parcel No. 1-24496 TEMPORARY EASEMENT FURTHER whereas, the Parties entered into an Interlocal Agreement (Agreement) dated June 1, 2018, pursuant to chapter 39.34 RCW, the Interlocal Cooperation Act; and ALSO,the CITY does hereby grant WSDOT a temporary construction easement over the 2,878- square foot portion of Area 2,as described in attached Exhibit A and depicted in attached Exhibit B,to build temporary access to the southwest side of the new May Creek Bridge for construction. ALSO, WSDOT will design, permit, relocate, and connect the existing utilities impacted by WSDOT's work within the 2,878-square foot portion of Area 2, as described in attached Exhibit A and depicted in attached Exhibit B, that serve the parcel immediately to the south that is designated by King County as APN 3224059043,which is owned by Meadow Partners, LLC (or its successor, or assign) to maintain existing or better service, with all work incurred and costs paid for by WSDOT. ALSO, WSDOT will restore the 2,878-square foot portion of Area 2, as described in attached Exhibit A and depicted in attached Exhibit B, to original or better condition prior to completion of the Project. WSDOT acknowledges and agrees that mitigation for temporary impacts will be evaluated through the shoreline and critical areas permit(s) and will likely address plant establishment and mitigation for tree impacts. All mitigation for temporary impacts will be at WSDOT's cost. Said lands being situated in King County,State of Washington,and described as follows: For legal description see Exhibit A attached hereto and made a part hereof. It is understood and agreed that delivery of this Temporary Easement is hereby tendered and that the terms and obligations hereof shall not become binding upon the State of Washington, unless and until accepted and approved hereon in writing for the State of Washington, by and through its Department of Transportation,by its authorized agent.
