Home My WebLink AboutD 4920152 `� _� vik l ,-Abf627 ,./J-734/),-/1?;- DEED J%3q)d ;-DEED OF DEDICATION THIS INDENTURE, made this 11th day of June , 1958, between the United States of America, acting through the Housing and Home Finance Agency, Public Housing Administration, under and pursuant to the powers and authority contained in the provisions of the Lanham Act (54 Stat. 1125; 42 U.S.C. 1521) as amended, and Reorganization Plan No. 3 of 1947 (12 F.R. 4981), Grantor, and the City of Renton, a municipal corporation of the State of Washington, Grantee, WITNESSETH: That the said Grantor, by these presents, does hereby dedi- cate to the Grantee for public use for municipal purposes, that parcel of land lying and being in the City of Renton, County of King, State of Washington, more particularly described as follows: Tract "5 B" of Block 5. Corrected Plat of Renton Highlands No. 2, an addition to the City of Renton, as recorded on August 8, 1956 in Volume 57 of Plats, Pages 92 to 98 inclusive, Records of the County of King, State of Washington. SUBJECT TO that certain lease dated the 3rd day of August, 1956 between the Housing Authority of the City of Renton, Washington, Lessor, (which lease was assigned to the Grantor as of the close of business on September 30, 1957) and the Boeing Airplane Company, Lessee, it being agreed between the Grantor and Grantee that the Grantor will receive the monthly rental from the Lessee until said lease expires or is terminated. TO HAVE AND TO HOLD the foregoing described property, to- gether with the appurtenances, unto the Grantee, its successors and assigns, PROVIDED, HOWEVER, that this deed is made and accepted upon the following condition subsequent, which shall be binding upon and enforceable against the Grantee, its successors and assigns, and each of them as follows: That for a period of ten (10) years from July 31, 1961, or the date the above re- ferred to lease is terminated, whichever date is the sooner, the above described property herein conveyed, shall be utilized continuously for public use for municipal purposes, and for no other purposes. In the event of a breach of the condition set forth above whether caused by the legal or other inability of said Grantee, its successors or assigns, to perform the obligation herein set forth, all right, title and interest in and to the above described property shall, at its option, revert to and become the property of the United States of America, which, in addition to all other remedies for such breach, shall have an immediate right of entry thereon and the said Grantee, its successors or assigns, shall forfeit all right, title and interest in and to the above described property and in any and all tenements, hereditaments and appurtenances there- unto belonging.
