1 This instrument, a Deed of Release, made by the UNITED STATES OF
2 AMERICA, acting by and through the Administrator of the Federal Aviation
3 Administration, under and pursuant to the powers and authority contained in

4 the provisions of Public Law 81 311 (63 Stat. 700) , as amended, to the

f� 7 WHEREAS, the UNITED STATES OF AMERICA, acting by and through the
8 War Assets Administrator, under and pursuant to Executive Order 9689, dated
9 31 January 1946, and the powers and authority contained in the provisions
10 of the Surplus Property Act of 1944 (Public Law 457, 78th Congress ; 58
11 Stat. 765) as amended, and regulations and orders promulgated thereunder,
12 did, by instrument entitled Quitclaim Deed, dated 25 September 1947, and
13 recorded in Volume 2668, Pages 386 through 395, Deed Records of the
14 County of King, State of Washington, remise, release and forever quitclaim
15 to the City of Renton (grantee) , its successors and assigns, all right,
16 title and interest of the UNITED STATES OF AMERICA in and to certain property
17 known as Renton Municical Airport, subject to certain conditions, reserva-
18 tions, exceptions and restrictions; and
19 WHEREAS, the City of Renton, Washington has requested the United
20 States of America to release the hereinafter described real property, from
21 all the conditions, reservations and restrictions contained in said Quitclaim
22 Deed in order to widen Airport Way which abuts the south end of Renton
23 Municipal Airport so as to improve vehicular access to the airport; and
24 WHEREAS, the Administrator of the Federal Aviation Administration,
25 under and pursuant to the powers and authority contained in Public Law
26 81-311 (63 Stat. 700) , as amended, is authorized to grant a release from
27 any of the terms, conditions, reservations, covenants, and restrictions
28 contained in, and to convey, quitclaim, or release any right or interest
29 reserved to the United States by any instrument of disposal under which
30 surplus airport property was conveyed to a non-Federal public agency pursuant
31 to the Surplus Property Act of 1944, as amended; and
32 WHEREAS, the Administrator of the Federal Aviation Administration has

1 determined that this release will not prevent accomplishment of the purpose
2 for which the airport property was transferred and is necessary to protect
3 or advance the interests of the United States in civil aviation;

O 4 NOW, THEREFORE, for and in consideration of the above-expressed

5 recitals and of the benefits to accrue to the United States and to civil

6 aviation, the United States of America, upon compliance by the City of
7 Renton with the following described conditions, which shall be deemed to
8 be covenants running with the land:
9 (1) To reserve unto itself, its successors and assigns, for the use
10 and benefit of the public a right of flight for the passage of aircraft in
11 the airspace above the surface of the real property hereinafter described,
12 together with the right to cause in said airspace such noise as may be
13 inherent in the operation of aircraft, now known or hereafter used, for
14 navigation of or flight in the said airspace, and for use of said airspace
15 for landing on, taking off from or operating on Renton Municipal Airport,
16 (2) To restrict the height of structures, objects of natural growth
17 and other obstructions on the hereinafter described real property to a
18 height not to exceed the imaginary surfaces as set forth in Federal Aviation
19 Regulations, Part 77,
20 (3) To prevent any use of the hereinafter described real property
21 which would interfere with landing or taking off of aircraft at the Renton
22 Municipal Airport, or otherwise constitute an airport hazard,
23 (4) To prevent any operation on the hereinafter described real
24 property which would produce electromagnetic radiations of a nature which
25 would cause interference with any air navigational or communications aid
26 now or in the future to be installed to serve the Renton Municipal Airport,
27 or which would create any interfering or confusing light or cause any
28 restrictions to visibility at the airport;
29 HEREBY RELEASES the said real property from the conditions, reservations
30 and restrictions as contained in the above-mentioned Instrument of Transfer
31 from the United States of America to the City of Renton, dated 25 September
32 1947, which real property is described as follows :

1 All that portion of the Renton Municipal Airport lying
Southerly of the following described line, containing 0.436
2 acres more or less:
'- 3 BEGINNING at the intersection of the center lines of Rainier
Li") Avenue and Airport Way; thence North 6° 50' 59" West along
0 4 the centerline of Rainier Avenue a distance of 199.66 feet;
thence North 83' 09' 01" East a distance of 65 feet to the

5 true point of beginning of said line; said true point of
0 beginning being the point of a curve to the left, whose radius
C\ 6 point bears North 83° 09 ' 01" east a distance of 169 feet ;
thence Southeasterly along the arc of a curve to the left,
7 radius 169 feet, through a central angle of 80' 39' 23" an
arc distance of 237.90 feet; thence South 87" 30 ' 22" east a
8 distance of 146.79 feet; thence South 82° 16' 56" East a
distance of 175.73 feet; thence South 87' 30' 22" East a
9 distance of 1,364.27 feet to the point of a curve to the left,
whose radius point bears North 2° 29 ' 38" East a distance of
10 144 feet; thence Easterly along the arc of a curve to the
left, radius 144 feet, a distance of 60 feet, more or less,
11 to the West line of Lot 19, Block 4, Renton Real Estate
Company's 1st Addition to Renton, according to the plat re-
12 corded in Volume 21 of plats, page 50, records of King County,
Washington; the termination of said line.

14 By its acceptance of this Deed of Release the City of Renton
15 covenants and agrees for itself, its successors and assigns, to comply
16 with and observe all of the conditions and limitations hereof which are
17 expressly limited to the above-described real property.
18 IN WITNESS WHEREOF the United States of America has caused this Deed
19 of Release to be executed as of the 12. day of 4.i// , 1972.
