HomeMy WebLinkAboutD 8101120543 Nor *affp DEDICATION TO THE PUBLIC FOR STREET PURPOSES THE CITY OF SEATTLE, a municipal corporation of the State of Washington, hereby conveys and dedicates to the City of Renton, a municipal corporation of the State of Washington, for the use of the public for all street purposes CO not inconsistent with the use thereof by the City of Seattle CD for underground water pipeline purposes, that portion of The CD City of Seattle' s fee-owned East Side Supply Line right of ai way described as follows: The east thirty (30) feet of the southeast one- quarter (SE 1/4) of the northeast one-quarter (NE 1/4) of Section 16 , Township 23 North, Range 5 East, W.M. , together with the west thirty (30) feet of the southwest one-quarter (SW 1/4) of the northwest one-quarter (NW 1/4) of Section 15, Township 23 North, Range 5 East, W.M. , all in King County, Washington. Reserved, however, to The City of Seattle is an easement through said property for one or more underground water pipelines with the necessary appurtenances which easement shall include the following covenants for the protection of the existing pipeline: 1. The earth cover over the existing 36 inch diameter pipeline shall be maintained at not less than 36 inches or more than 49 inches. 2. The placement of any utilities within 10 feet, measured horizontally, of the centerline of said existing pipeline shall be subject to prior permission in writing from the Superintendent of Water of the City of Seattle. If the area herein dedicated ceases to be used for street purposes, as indicated by vacation, abandonment or in any other manner, the dedication herein shall terminate and fee simple title to the area shall rest in The City of Seattle free of the public easement for street purposes created by this instrument. This dedication deed is given by The City of Seattle in implementation of Stipulation "B" incorporated in the Judgment '(W Page 1 of 3 on Verdicts entered June 5, 1956 in King County Superior Court Cause No. 486190 entitled: In the Matter of the Petition of the City of Seattle to acquire certain property and property rights in unplatted portions of Sections 15, 16 and 21, of Township 23 North, Range 5 East, W.M. , Sections 7 , 8 , 9 , 16, 18 , 21, 28, 33 and 34 of Township 24 North, Range 5 East, W.M. , C. D. Hillman' s Lake Washington Garden of Eden, Division Nos. 6 and 8, and the Plat 01 NT of Mercer, for a pipeline right of way to supply Mercer Island and vicinity, as contemplated by Or- © dinance No. 84393. CQ Said Stipulation "B" reads: O ap STIPULATION "B" Upon adoption by the King County Commissioners of a resolution indicating their intention to accept the dedication herein contemplated and upon payment to the City of Seattle of a sum equal to the total aggregate awards, including severance damage, made herein to the owners and persons otherwise inter- ested in Parcels 7 to 17, inclusive, the City of Seattle will dedicate the right of way acquired from said parcels to King County, Washington, for street or road purposes, reserving to the City an easement for pipeline purposes as contemplated by Ordinance No. 84393 • As successor to King County by annexation the City of Renton by Resolution 2275 has indicated an intention to accept such dedication, and an interested abutter has paid to The City of Seattle a sum equal to the total aggregate awards, including severance damage made to the owners and persons otherwise interested in Parcels 7 to 17, inclusive, King County Cause No. 486190 . Office Engineer Dear Sir: Please find enclosed for your records the original executed and recorded Dedication to the Public for Street Purposes, dedicating to the City of Renton a portion of the City of Seattle's East Side Supply Line right of way for street purposes (Union Avenue N.E. , also known as 132nd Avenue S.E.) . A portion of this dedicated street is adjacent to the plat of Fernwood East, and the total parcel extends from S.E. 132nd Street to S.E. 136th Street (also known as S. 2nd Place) . This instrument, authorized by City of Seattle Ordinance 109442, reserves to the City of Seattle an easement for water pipeline facilities. In accordance with City of Renton Resolution 2275, this street right of way is to be accepted and maintained by the City of Renton in conjunction with the development of the plat of Fernwood East.
