CORRESPONDENCE Letter from John L. Hendrickson, attorney for Honey Creek Associates,
Honey Creek requested assistance by the City Council in meeting right-of-way
Associates Rezone condition imposed on Honey Creek Associates Rezone, R-014-84, and
& PPUD Preliminary Planned Unit Development, PPUD-015-84, approved
Conditions 4/14/86. (Rezone ordinance held awaiting approval of concurrent
annexation by King County Boundary Review Board.) The letter noted
difficulties incurred by applicant in acquiring right-of-way from owner
at 2216 Harrington Place NE to enable construction of full 40-foot road
aligned with NE 23rd Street between Harrington Avenue NE and the
applicant's property. The administrative staff, including the City
Attorney, was requested to initiate condemnation proceedings, if
necessary, with the understanding that the City would be reimbursed for
all costs.
City Attorney Warren reported that although the matter had been
discussed in Committee, the requirement for full-width right-of-way had
been approved by the Council without clarification of whether the City
would aid in condemnation procedures, if determined necessary. He
noted that if the Council wishes to concur in the applicant's request, the
City would have to determine whether or not the amount requested is
unreasonable before it would assist in the matter, and an agreement
reached for reimbursement of attorney's fees to ensure that the City is
not expending public funds to aid a developer. MOVED BY MATHEWS,
SECONDED BY KEOLKER, COUNCIL REFER THIS MATTER TO
THE CITY ATTORNEY TO PROVIDE PRELIMINARY ASSISTANCE
AND REPORT BACK TO COUNCIL IF FURTHER COUNCIL
ACTION IS REQUIRED. City Attorney Warren clarified that he would
obtain square footage calculations to determine appropriate value, discuss
attorney's fees with Mr. Hendrickson, and then report back to Council
before any further action is taken. MOTION CARRIED. Councilman
Stredicke requested his "no" vote be recorded, noting that if applicant
cannot meet required conditions, he should resubmit plans.
Finance City Clerk/Finance Department requested the City Council to declare
Department: certain City equipment surplus (obsolete, damaged or no longer used) to
Surplus allow disposal at public auction to be held October 4, 1986, by the City
Equipment of Bellevue for the annual Joint Government Disposal Auction. Upon
Auction inquiry, Administrative Assistant Parness reported that obsolete IBM
personal computer keyboards are being surplused because they are
incompatible with the City's data processing system. MOVED BY
TRIMM, SECONDED BY MATHEWS, COUNCIL DECLARE LISTED
ITEMS SURPLUS. CARRIED.
Rivol' state quit Letter from Robert L. Anderson, attorney for the Estate of William O.
Claim Deed Rivoli, requested City officials to execute Quit Claim Deed to remove
City of Renton's cloud on the title to Lot 19 in Block 5 of the Renton
Real Estate Company's First Addition to Renton, allegedly purchased
from the City by Moreno and Adina Rivoli in 1935 although the deed
cannot be located. MOVED BY REED, SECONDED BY STREDICKE,
COUNCIL REFER THIS MATTER TO THE CITY ATTORNEY AND
ADMINISTRATION TO REPORT BACK TO COUNCIL. CARRIED.
Following further explanation by City Attorney Warren that the property
had come into the City's hands through an LID foreclosure in 1934 and
was purchased in 1935 by the owners who have occupied and paid taxes
on Lot 19 for 51 years, it was MOVED BY STREDICKE, SECONDED
BY REED, COUNCIL AUTHORIZE MAYOR AND CITY CLERK TO
SIGN QUIT CLAIM DEED ON THE PROPERTY. CARRIED.
Padgett Waiver Letter from King County residents Alan and Angela Padgett, 13304 SE
Request for Sewer 99th Street, Renton, requested waiver of requirements of Resolution No.
Connection 2162, adopted in February of 1978, which prohibits sewer connection by
residents outside the City limits unless specific conditions are met. The
letter noted participation by the Padgetts in LID 295, 1975 sewer project
in Union Avenue NE north of the City limits of Renton, to assure future
approval of connection by the City. Mr. Padgett advised that King
County recently denied his short plat request due to unavailability of
letter from the City authorizing future sewer hookups. He noted that
prior to his participation in LID 295, he had an approved septic system,
but he joined the project to assure future connection to City sewers when
he subdivided his property. MOVED BY MATHEWS, SECONDED BY
STREDICKE, COUNCIL REFER THIS MATTER TO THE UTILITIES
COMMITTEE. CARRIED. Council President Mathews requested
notification of all committee meetings regarding this matter.

Dear Council Members :
I am writing this letter to you as the attorney for the Estate of
William O. Rivoli who died on April 14 , 1986 . Mr . Rivoli ' s estate
is being probated under King County Cause No. 86-4-02149-1 .
The executor of the estate is Mr . Robert Rivili and he is in the
process of selling Lots 15 , 16 , 17 , 18 and 19 in Block 5 of the
Renton Real Estate Company ' s First Addition to Renton. All of
these properties were previously gifted to the deceased, William
Rivoli by his mother , Adina Fontana, formerly Adina Rivoli on
January 4 , 1982 .
On July 15 , 1986 , Transamerica Title Company issued their
preliminary commitment for title insurance and in that report they
raised a question with regard to the ownership of Lot 19 . Location
of Lot 19 as shown on Attachment "A" attached hereto. According
to Transamerica all of the five lots were received by the City of
Renton under an LID foreclosure sale conducted by the Renton
Treasurer in 1934 . In the spring of 1935 IJoreno and Adina Rivoli
purchased Lot 19 for cash. Moreno Rivoli died in 1957 , however ,
his wife , Adina, is still alive and she recalls that they purchased
Lot 19 for cash from the City of Renton: She is unable to recall
if they received a deed from the City of Renton and at this time no
one is able to locate a deed to the property. Mrs . Rivoli further
recalls that the cash they paid was $200 . 00 , said sum paid back
taxes and assessments for the years 1919 through 1935 when they
purchased the property. Since 1935 Mr . and Mrs . Rivoli have paid
taxes on Lot 19 and shortly after its purchase they built a residence
on it . According to Mrs . Fontana Lots 15 thru 18 were purchased at
a later time and deeds were received and recorded. In discussing
this matter with Transamerica Title they indicate to me that in
the 1930s the City of Renton apparently sold the LID foreclosure

properties on unrecorded realestate contracts because the title
company records indicate a number of quit claim deeds being recorded
in later years based upon unrecorded contracts with the City . It
would appear that if a deed was delivered by the City of Renton to
Mr . and Mrs . Rivoli that it was somehow lost and not recorded.
Because of this , there is a cloud on the title and only the City
of Renton can remove the cloud from the title to the property
purchased by the Rivolis many years ago. It would be appreciated
if the City would be kind enough to clear title to the Rivolis
property by signing a Quit Claim Deed.
The sale by the Rivoli Estate of the subject property is now on
hold pending a resolution regarding the cloud on Lot 19. The
Renton City attorney has asked the various departments in the City
of Renton to check their records to see if they might possibly
have the deed to the property. I am advised by City Attorney Larry
Warren that a research of the City records does not disclose a
deed from the City to Mr . and Mrs . Rivoli on the subject property.
It is also my understanding that the City Council is in a position
to authorize the city officials to take those steps necesssary in
order to remove the City of Renton ' s cloud on the title to Lot 19 .
I would therefore respectfully ask that the City Council grant
city officials the necessary authorization so that the Rivolis may
complete the sale of their property which they have owned, built
upon , paid taxes on and maintained for the last 51 years .
Your help in expediting this matter as quickly as possible will
be appreciated. In that respect , I would respectively request
that this matter be placed upon your next scheduling agenda for
appropriate action.

Dear Folks:
Please find enclosed a copy of a letter from attorney Robert
Anderson concerning the above captioned real property. Appar-
ently the City of Renton is shown as a record owner on this
property pursuant to a sale following foreclosure of a Local
Improvement District lien. There is no indication that the
City ever deeded property to any third party, although there
is records that the City deeded Lots 15, 16 , 17 and 18 of this
same plat. Since the management of LID' s is through the Finance
Department I have included Dan in this letter. Because all of
the City' s records are maintained by the City Clerk' s office, I
have included Maxine. Because the Public Works Department is
the one handling legal descriptions, I have included Dick. Who
can help me? Does the City have any records to help Mr. Anderson
and his client? Any help would be appreciated.

Dear Larry :
This will confirm my previous telephone conversation with you
regarding the problems that the title company has raised
regarding the above referenced lot .
I am the attorney for the estate of William O. Rivoli who died
on April 14 , 1986 , and whose estate is being probated under
King County Cause Number 86-4-02149-1 . The estate is in the
process of selling Lots 15 , 16 , 17 , 18 and 19 in Block 5 of
Renton Real Estate Company ' s First Addition to Renton. All of
these properties were gifted to William Rivoli by his mother
on January 4 , 1982 . A copy of the Quit Claim Deed is enclosed
for your information. I am also enclosing a copy of the
Transamerica Title Report issued on July 15 , 1986 , that raises
a question with regard to Lot 19. According to Transamerica all
of the five lots were received by the City of Renton under a
LID deed foreclosure by the Renton Treasurer in 1934. In the
spring of 1935 Marino and Adina Rivoli purchased Lot 19 for
cash. Marino Rivoli died in 1957 , however , Adina Fontana ,
formerly Adina Rivoli is still alive and she remembers purchasing
the property for cash, but does not recall what kind of or if
they did receive a deed from the City of Renton and we are unable
to locate a deed to the property. Mr . and Mrs . Rivoli have

paid taxes on Lot 19 since 1935 and built a residence on Lot
19 shortly after the purchase. According to Mrs . Rivoli Lots
15 thru 18 were purchased at a later time and apparently deeds
were received and recorded. In discussing this matter with the
title company they indicate to me that the City of Renton
apparently at that time sold a number of these properties on
unrecorded real estate contracts because their records indicate
a number of quit claim deeds being recorded in later years based
upon unrecorded real estate contracts.
This pending sale is now on hold pending a resolution regarding
the ownership of Lot 19. It would be appreciated if someone at
the City could research their records with regard to Lot 19 and
see if there isn' t some record of a conveyance out by the City
of Renton.
Your assistance in expediting this matter as quickly as possible
will be appreciated. If you have any questions , please don ' t
hesitate to give me a call .

COMMITMENT FOR TITLE INSURANCE

Transamerica Title Insurance Company, a California corporation, herein called the Company,
for a valuable consideration, hereby commits to issue its policy or policies of title insurance, as
identified in Schedule A, in favor of the proposed insured named in Schedule A, as owner or
mortgagee of the estate or interest covered hereby in the land described or referred to in
Schedule A, upon payment of the premiums and charges therefor; all subject to the exceptions
and conditions and stipulations shown herein, the Exclusions from Coverage, the Schedule B
exceptions, and the conditions and stipulations of the policy or policies requested. (See reverse
side of this cover and inside of back cover for printed Exclusions from Coverage and Schedule B
exceptions contained in various policy forms.)
This Commitment shall be effective only when the identity of the proposed Insured and the amount
of the policy or policies committed for have been inserted in Schedule A hereof by the Company,
either at the time of the issuance of this Commitment or by subsequent endorsements and is
subject to the Conditions and Stipulations on the back of this cover.
This Commitment is preliminary to the issuance of such policy or policies of title insurance and all
liability and obligations hereunder shall cease and terminate six months after the effective date
hereof or when the policy or policies committed for shall issue, whichever first occurs, provided
that the failure to issue such policy or policies is not the fault of the Company.
IN WITNESS WHEREOF Transamerica Title Insurance Company has caused its corporate name
and seal to be hereunto affixed by its duly authorized officers on the date shown in Schedule A.
NOTE:THE POLICY COMMITTED FOR MAY BE EXAMINED BY INQUIRY AT THE OFFICE

at Date of Policy or at the date such claimant acquired an estate or interest insured by this policy or acquired the insured
mortgage and not disclosed in writing by the insured claimant to the Company prior to the date such insured claimant became
an insured hereunder; (c) resulting in no loss or damage to the insured claimant;(d)attaching or created subsequent to Date
of Policy;or(e)resulting in loss or damage which would not have been sustained if the insured claimant had been a purchaser
or encumbrancer for value without knowledge.
