It is my intention to rough grade the 5.9 acres included in the sale to
you of my property described below.
In addition, I will quit claim my interest in the 15 feet east of the
property described below to you with the understanding that I will pay
for one-half. the cost of clearing the title of the 15 feet up to a maxi-
mum cost to me of $500.

Dear Harold:
Enclosed is the deed for the easterly 15 feet of the Van Daal property.
We will not be able to include it in our legal description inasmuch as
the title company will not be able to insure the parcel for another
year and a half.
f Scarsella Bros. acquired the property through a tax foreclosure sale
on November 5, 1976. Although Burlington Northern was the taxpayer
of record, they were not the record title holder of the property.
Pioneer Title handled the certificates involved with the sale and for
some reason missed the deed or interest of the party owing the property.
Because of this, three years must elapse from the date of sale before
the property is insurable for title purposes.
