WebLinkAboutCovenant_LUA13-001481ReturnAddress:CityClerk’sOfficeCityofRenton1055SGradyWayRenton,WA98057DECLARATIONOfCOVENANTFORINSPECTIONANDMAINTENANCEOFSTORMWATERFACILITIESANDBMPSGrantor:RentonSchoolDistrictGrantee:CityofRentonLegalDescription:Lot1ofCityofRentonShortPlatNo070-80RecordingNo.8107299002inRingCounty,WashingtonAssessor’sTaxParcelID#:2923059061INCONSIDERATIONoftheapprovedCityofRentonGrading,Drainage,SewerandWaterpermitforapplicationfileNo.LUA/SWPLUAI3-001481,SA-Arelatingtotherealproperty(“Property”)describedabove,theGrantor(s),theowner(s)infeeofthatProperty,herebycovenants(covenant)withtheCityofRenton,apoliticalsubdivisionofthestateofWashington,thathe/she(they)willobserve,consentto,andabidebytheconditionsandobligationssetforthanddescribedinParagraphs1through10belowwithregardtotheProperty,andherebygrants(grant)aneasementasdescribedinParagraphs2and3.Grantor(s)herebygrants(grant),covenants(covenant),andagrees(agree)asfollows:1.TheGrantor(s)orhis/her(their)successorsininterestandassigns(“Ownersofthedescribedproperty”)shallattheirowncost,operate,maintain,andkeepingoodrepair,theProperty’sstormwaterfacilitiesand/orbestmanagementconstructedasrequiredintheapprovedconstructionplansandspecificationsAcademyonfilewiththeCityofRentonandsubmittedtotheCityofRentonforthereviewandapprovalofpermit(s)LUA13-001481,SA-A.Theproperty’sstormwaterfacilitiesand/orbestmanagementpractices(“BMPs”)areshownand/orlistedonExhibitA.Theproperty’sstormwaterfacilitiesand/orBMPsshallbemaintainedincompliancewiththeoperationandmaintenancescheduleincludedandattachedhereinasExhibitB.Stormwaterfacilitiesincludepipes,swales,tanks,vaults,ponds,andotherengineeredstructuresdesignedtomanageand/ortreatstormwaterontheProperty.StormwaterBMPsincludedispersionandinfiltrationdevices,nativevegetatedareas,permeablepavements,vegetatedroofs,rainwaterharvestingsystems,reducedimpervioussurfacecoverage,andothermeasuresdesignedtoreducetheamountofstormwaterrunoffontheProperty.2.CityofRentonshallhavetherighttoingressandegressoverthoseportionsofthePropertynecessarytoperforminspectionsofthestormwaterfacilitiesandBMPsandconductmaintenanceactivitiesspecifiedinthisDeclarationofCovenantandinaccordancewithRMC4-6-030.3.ifCityofRentondeterminesthatmaintenanceorrepairworkisrequiredtobedonetoanyofthestormwaterfacilitiesorBMPs,CityofRentonshallgivenoticeofthespecificmaintenanceand/orrepairworkrequiredpursuanttoRMC4-6-030.TheCityshallalsosetareasonabletimeinwhichsuchPage1of3FormApprovedbyCityAttorney10/2013 workistobecompletedbytheOwners.IftheaboverequiredmaintenanceorrepairisnotcompletedwithinthetimesetbytheCity,theCitymayperformtherequiredmaintenanceorrepair,andherebyisgivenaccesstotheProperty,subjecttotheexclusioninParagraph2above,forsuchpurposes.WrittennoticewillbesenttotheOwnersstatingtheCity’sintentiontoperformsuchwork.Thisworkwillnotcommenceuntilatleastseven(7)daysaftersuchnoticeismailed.If,withinthesolediscretionoftheCity,thereexistsanimminentorpresentdanger,theseven(7)daynoticeperiodwillbewaivedandmaintenanceandlorrepairworkwillbeginimmediately.4.IfatanytimetheCityofRentonreasonablydeterminesthatastormwaterfacilityorBMPonthePropertycreatesanyofthehazardousconditionslistedinRMC4-4-060Gorrelevantmunicipalsuccessor’scodesasapplicableandhereinincorporatedbyreference,theCitymaytakemeasuresspecifiedtherein.5.TheOwnersshallassumeallresponsibilityforthecostofanymaintenanceorrepairworkcompletedbytheCityasdescribedinParagraph3oranymeasurestakenbytheCitytoaddresshazardousconditionsasdescribedinParagraph4.SuchresponsibilityshallincludereimbursementtotheCitywithinthirty(30)daysofthereceiptoftheinvoiceforanysuchworkperformed.Overduepaymentswillrequirepaymentofinterestatthecurrentlegalrateasliquidateddamages.Iflegalactionensues,theprevailingpartyisentitledtorecoverreasonablelitigationcostsandattorney’sfees.6.TheOwnersareherebyrequiredtoobtainwrittenapprovalfromCityofRentonpriortofilling,piping,cutting,orremovingvegetation(exceptinroutinelandscapemaintenance)inopenvegetatedstormwaterfacilities(suchasswales,channels,ditches,ponds,etc.),orperforminganyalterationsormodificationstothestormwaterfacilitiesandBMPsreferencedinthisDeclarationofCovenant.7.AnynoticeorconsentrequiredtobegivenorotherwiseprovidedforbytheprovisionsofthisAgreementshallbeeffectiveuponpersonaldelivery,orthree(3)daysaftermailingbyCertifiedMail,returnreceiptrequested.8.Withregardtothemattersaddressedherein,thisagreementconstitutestheentireagreementbetweentheparties,andsupersedesallpriordiscussions,negotiations,andallagreementswhatsoeverwhetheroralorwritten.9.ThisDeclarationofCovenantisintendedtoprotectthevalueanddesirabilityoftherealpropertydescribedabove,andshallinuretothebenefitofallthecitizensoftheCityofRentonanditssuccessorsandassigns.ThisDeclarationofCovenantshallrimwiththelandandbebindinguponGrantor(s),andGrantor’s(s’)successorsininterest,andassigns.10.ThisDeclarationofCovenantmaybeterminatedbyexecutionofawrittenagreementbytheOwnersandtheCitythatisrecordedbyKingCountyinitsrealpropertyrecords.INWITNESSWHEREOF,thisDeclarationofCovenantfortheInspectionandMaintenanceofStormwaterFacilitiesandBMPsisexecutedthisI(dayof,209GRANTORwnerofthePropertyGRANTOR,ownerofthePropertyPage2of3FormApprovedbyCityAttorney10/2013
