McCullough 701 Fifth Ave. Suite 6600 Seattle, WA 98104 SUBJECT: Response to Topgolf Project, LUA19-000094 (the “Project”), Request for Confirmation Dear John McCullough: I am in receipt of your letter, dated September 30, 2019 (Enclosed), wherein you requested the City’s more specific response to Development Agreement compliance, as referenced in your letter. Specifically how the Project complies with the 2003 Development Agreement allocation of 1,500 trips listed in Section 4.2.3 to that Development Agreement. Anticipated transportation impacts associated with the Project were addressed in the Hearing Examiner’s decision issued August 19, 2019, as amended on reconsideration dated September 16, 2019 (collectively, the “Hearing Examiner Decision”). First, the staff report to the Hearing Examiner addressed both a 2002 Development Agreement and the 2003 Development Agreement, explaining that neither Development Agreement controlled the scope of the Project. Second, through its SEPA review process, the City evaluated transportation impacts associated with the Project, and the City applied Project-specific transportation mitigation measures in the SEPA Threshold Determination issued for the Project. The Hearing Examiner Decision adopted those SEPA mitigation measures as conditions of Project approval. For all of these reasons, the C ity views the issue of the Project’s transportation impacts (including trip generation) as having been addressed in the Hearing Examiner Decision. The City intends to honor the Hearing Examiner Decision and will require the Project to comply with the conditions imposed therein. I trust that the above response is sufficient to address the concerns raised in your letter.
