AMENDMENT NO., 1 TO AGREEMENT FOR CAG-19-077

THIS AMENDMENT, dated /0/2;2 7n/ 9 , is by and between the City of Renton (the
"City"), a Washington municipal rp ation, and DKS Associates ("Consultant"), 719 Second
Avenue, Suite 1250, Seattle, WA 98104-1706. The City and the Consultant are referred to
collectively in this Amendment as the "Parties." Once fully executed by the Parties, this
Amendment is effective as of the last date signed by both parties.
Whereas, the City engaged the services of the Consultant under Agreement CAG-19-077, dated
April 25, 2019, to provide necessary services for the SW 41n Street and Oakesdale Intersection
Improvements Project (referred to herein as the "Agreement");
Whereas,the Parties wish to amend the Agreement to finish the design, prepare bid documents,
and extend expiration date in order to complete the design of the Duvall Avenue NE Project.
NOW THEREFORE, It is mutually agreed upon that CAG-19-077 is amended as follows:
1. Scope of Work: Section 1, Scope of Work, is amended to provide engineering services
from 30% design to 100% and final design plans, specifications, and estimate, and bid
documents and bid support as specified in Exhibit A-1,which is attached and incorporated
herein.
2. Time of Performance: Section 3, Time,of Performance, is amended pursuant to the
schedule(s) set forth in Exhibit A-1. All Work shall be performed by no later than
December 31, 2021. '
3. Compensation: Section 4, Compensation, is amended so that the maximum amount of
compensation payable to Consultant is increased by $89,235.03 from $90,755.20 to
$179,990.23, which includes any applicable state and local sales taxes. The additional
compensation shall be paid based upon Work actually performed according to the rate(s)
or amounts specified in Exhibit B-1, which is attached and incorporated herein.
4. All terms of the Agreement not explicitly modified herein shall remain in full force and
effect and such terms shall apply to Work performed according to this Amendment as if
fully set forth herein.
IN WITNESS WHEREOF, the Parties have voluntarily entered into this Agreement as of the date
last signed by the Parties below.

SOUTHWEST 41ST STREET AND OAKESDALE AVENUE
SOUTHWEST INTERSECTION IMPROVEMENTS
CONTRACT PRELUDE
Where CONSULTANT is used it is applicable to DKS and sub-consultant firm(s) on this project.
Where CITY is used it is used to represent City of Renton Transportation Systems Division.
PROJECT DESCRIPTION
This scope of work described in the following document will be provided by the CONSULTANT,
DKS, with support from SUBCONSULTANT, WSP, formerly BergerABAM, for the FINAL
DESIGN of the CITY's Southwest 41st Street and Oakesdale Avenue Southwest intersection
improvement project.
Oakesdale Avenue SW provides a vital north-south freight traffic corridor within the City of
Renton. The existing Oakesdale Avenue SW/Southwest 41st Street intersection consists of a
stop controlled leg along Southwest 41st Street to the east and a commercial driveway to the
west creating a fourth leg outside of the public right-of-way (ROW). Springbrook Creek and the
Springbrook Creek pedestrian trail also intersect Oakesdale Avenue SW at this intersection and
travels in a southwest to northeast direction.
The project will include project management, coordination with the City, meetings, final TIR
and taking the 30% design to the final design plans, specifications, and estimate (PS&E)for a
new traffic signal and channelization at the intersection of SW 41st Street and Oakesdale
Avenue SW to provide an increased level of safety for motorists, freight traffic, cyclists, and
pedestrians. Curb return radii and pedestrian curb ramps will be designed to facilitate traffic
movements, including freight with wide turning radii, and meet current regulatory
requirements. Stormwater collection and conveyance systems will be improved as required to
accommodate roadway widening and curb return adjustments and to meet the requirements
of the current City of Renton Surface Water Design Manual (SWDM). Signal pole locations
and intersection improvements will be laid out in a manner that avoids impacts to the
Springbrook Creek culvert systems and the King County Wastewater sanitary sewer
transmission mains located within the public ROW to control project costs and scope.
GENERAL PROJECT ASSUMPTIONS •
The following list is included to confirm the understanding between CONSULTANT and the
CITY and will be used to guide the work.
1. Throughout this scope of work, it is understood that the City of Renton will provide the
CONSULTANT, DKS Associates, with one set of consolidated review comments for the
90, and 100 percent submittal reviews after completion of 30 percent design. DKS
Associates will submit to the CITY the response to comments that will also include all
SUBCONSULTANT responses.
2. It is assumed that the design for the project will be completed within six months of the
notice to proceed. However, the overall completion date of this agreement is twelve

months of the notice to proceed to account for future supplements to the agreement
which may include construction assistance, public outreach, signal timing
implementation, geotechnical and structural support services.
3. Time is a material consideration in the performance of all work by the CONSULTANT
under this agreement. The CONSULTANT shall complete its work and services within its
control to meet the agreed upon schedule. The CONSULTANT shall provide to the
CITY monthly updates to the project schedule that identify tasks and deliverables that
require time extensions due to reasonable and/or unforeseen circumstances. The CITY
shall not unreasonably withhold written acceptance of the time extensions.
4. It is assumed that no new pedestrian facilities will be added to the project scope within
the Springbrook Creek Buffer area, Since this project connects to Springbrook Creek
Trail, revisions to the location of the trail or widening of the trail, if within the project
limits, may be needed as part of the scope.
5. It is assumed that proposed roadway improvements will not be required within the BNSF
Railway crossing located north of the intersection. Coordination with BNSF Railway
operation will be part of the design, if incorporation of interconnect to their bungalow via
existing and available conduit through their right of way, is required.
6. It is assumed that public involvement will not be necessary for this project. This includes
preparing a website, fliers, mailings, or any other public notices regarding the project. If
necessary, these will be prepared by others or will be included in supplemental work.
7. Utility relocation and reconstruction plans, other than water, sewer, and storm drainage,
will be prepared by the respective utility. It is assumed that two meetings will be held for
this work.
8. The CITY, at the 30% design, provided previous traffic reports, geotechnical reports, trail
projects/plans, or other reports that may have occurred within the project boundary or
adjacent to the project that may provide additional insight to be used for this project.
9. The CITY have an environmental consultant for environmental documentations and
permitting. The CONSULTANT will provide up to two exhibits to the CITY's
environmental consultant for the documentation and/or permitting.
10. It is assumed that the ROW plans, exhibits, and legal descriptions for the project will not
be required. Street rights of way will be determined based on found monuments and
research of public survey records. Property lines will be incorporated per King County
GIS right of way linework.
11. All plans will be prepared using AutoCAD version 2018 or later.
12. It is assumed that no new landscape or irrigation services will be included in this scope.
13. Potholing for utilities up to two (2) more locations. Two (2) locations was included in the
original agreement. This bring to total up to (4) four potholes.

14. Lighting will be placed on the separate poles and signal poles with luminaire arm(s) per
CITY standard detail, where applicable, to meet CITY standard lighting levels. LED
fixtures for the lighting will be used on this project.
15. The included fee estimate is an estimate of how we expect to allocate our time. The
CONSULTANT will request and obtain acceptance from the CITY prior to moving
fee/time between tasks.
16. It is assumed 35' mounting height distance from roadway surface to face of luminaire
fixtures will be used for roadway lighting.
17. It is assumed that work as part of this scope will not exceed 5000 sf of additional new or
replaced impervious surface.
18. It is assumed that this project will not require WSDOT review.
19. This scope does not include Arborist services.
20. It is assumed that the 108-and 72-inch King County wastewater gravity sewer mains
located within the Oakesdale Avenue SW ROW will not be impacted as part of the
intersection improvements.
21. It is assumed that preparation of a Public Interest Finding (PIF)will be required to the City
Major for approval. This project scope does not include preparation of a PIF.
22. It is assumed that preparation of Maximum Extent Feasible (MEF) documentation will not
be required unless curb ramps cannot meet current requirements. This project has
standard grades at the intersection; therefore, no MEF documentation is assumed to be
necessary on this project. If required, MEF documentation will be added to this project as
part of a supplement.
23. Major utility design, relocation, and/or upgrades will not be required for this project.
24. City of Renton Traffic control plans for basic construction phasing and project specific will
be included in the Plans.
25. CONSULTANT will be responsible for the overall reproduction of the PS&E packages
that are submitted to the CITY for review and approvals as stated in the deliverables
under each task.
26. Payments for the Lump Sum work are summarized below. In brackets is the estimated
schedule following the notice to proceed on this contract :
45% upon completion of the 90% submittal (2nd month)
70% upon completion of 100% percent submittal (4th month)
95% upon completion of final bid plans (5th month)
100% following final electronic submittals to CITY (6tt' month)

City of Renton uses the City of Renton Drafting Standards for Road, Bridge, and Municipal
Construction, Current Edition with the following pertinent elements:
• "feet" not meters
• Either*.CTB or*. STL styles for plotting
• datum in feet (per standard)
• APWA.WSDOT symbols and lines
• Layer naming per standard
• Scale of 1"=20'
TASK 1 PROJECT MANAGEMENT
The estimated project duration is 6 months from NTP. No design work will proceed without
written authorization from the City.
Provide project management administrative services including:
• Project set-up and execute agreement
• Execution of Subconsultant agreements
• Preparation of monthly progress reports in spreadsheet format, provided by the
CITY, and invoices
• Record keeping and project closeout
Provide overall project management including:
• Project staff management and coordination
• Subconsultant management and coordination
• Prepare and update project design schedule in Microsoft Project format.
• Schedule and budget monitoring
Coordinate with City staff, including preparation and attendance of up to 3 one hour coordination
meetings throughout the duration of the project. Level of effort for this task is based on an
average of 1 Consultant staff at each of the following meetings:
• One formal kickoff meeting at project start
• One formal check-in meeting between kickoff and 90%
• One formal review meeting after 90% review submittal
• Bi-weekly progress e-mails
The Consultant shall provide internal QA/QC reviews of the following major work elements prior
to submittal to the City.
Field review completed base maps for completeness and accuracy and incorporate findings.
Provide QA/QC review of 90% and Final Plans, specifications and estimates prior to submittal to
the City.
Task 1 Deliverables:
• Monthly invoices and progress reports (6 months)via e-mail.
• Project schedule in Microsoft Project and PDF format and updates via email.

• Meeting agenda minutes in Microsoft Word format via email. Agenda will be submitted
two days prior to meeting and Minutes will be submitted no later than two days after
meeting.
• Internal Review Mark-ups as part of each submittal to the City
• Misc. correspondence to document project management issues, time extension
requests via email, if necessary.
TASK 3 FINAL TIR
Task 3 shall be performed by Subconsultant WSP.
Stormwater treatment will be consistent with the 2017 City of Renton Surface Water Design
Manual (SWDM). A technical information report (TIR)will be required for this scopeto document
that the drainage improvements comply with the Core Requirements of the SWDM.
Assumption(s)
• The open channel and existing culverts conveying Springbrook Creek will not be altered
as a part of this project
• New pollution-generating impervious surface created by the project will be less than
5,000 square feet
• Meet with the City to discuss comments on draft TIR. Prepare final TIR.
Task 3 Deliverable(s):
• Final TIR in electronic PDF format.
TASK 8 PS&E PACKAGE (30%, 90%, 100% AND BID READY)
CONSULTANT will provide CITY'S comments list and written responses to CITY's comments
on the 30% submittal and resubmit 30% Plans with 30% comments incorporated to the CITY to
complete the 30% design. If changes are required to the proposed design, CONSULTANT will
coordinate with CITY reviewer to incorporate changes.
CONSULTANT will provide a 90%, 100% and BID READY Plans, Specification, and Estimate
(PS&E) package for the proposed intersection design. The plans will include all items provided
with the 30%, 90% and 100% submittal package, with CITY comments adjudicated. The plans
will,be complete, without any outstanding issues previously identified and brought to the CITY's
attention.
CONSULTANT will provide final, stamped, and signed PS&E package for the proposed
intersection signalization design. The final bid ready plans will include all items provided with the
90% submittal package, with CITY comments adjudicated.
CONSULTANT will update the previous estimate with each submittal for any changes
incorporated.
CONSULTANT will provide special provisions with each submittal updated for any changes
incorporated.
Task 8.1: 30%, 90%, 100% and Bid Ready Traffic Signal Design
Task 8.1 shall be performed by Consultant DKS.

For each submittal, the CONSULTANT will incorporate 30%, 90% and 100% submittal review
and will resolve all outstanding issues previously identified.
CONSULTANT will provide CITY'S comments list and written responses on the 30% submittal
and resubmit 30% Plans with 30% comments incorporated to the CITY to complete the 30%
design.
CONSULTANT will perform street lighting analysis for the 90% and 100% design using AGI32
software to enure the intersection meet the lighting standards. LED luminares on signal poles
shall be used for street lighting.
The 90%, 100%, and bid ready plans are expected to include: Cover(1 sheet), Legend and
Abbreviations (1 sheet), Channelization, Signage Plan (1 sheet) and Illumination Plan with
illumination details and foundation details(2 sheets), Signal Plan (1 sheet), Traffic Signal Pole
Detail (1 sheet), Signal Wiring Diagram (1 sheet), Signal Details with foundation details (1
sheet), Cabinet Termination Diagram (1 sheet), Interconnect Plan (1 sheet), Comm Details (1
sheet), and project specific traffic control plans (2 sheets). •
Task 8.2: 90%, 100% and Bid Ready Civil Design
Task 8.2 shall be performed by Subconsultant WSP.
For each submittal, the CONSULTANT will incorporate 30%, 90% and 100% submittal review
and will resolve all outstanding issues previously identified. The complete 30% design plans will
include the 30% CITY comments incorporated in the plans, 30% CITY comments list, responses
to comments.
The plans are expected to include: Notes and Detail (1 sheet), Site Preparation and Demolition
Plan (1 sheet), Roadway Plan (1 sheet), Roadway Details (1 sheet), Utility Details (1 sheet),
ADA Ramp Details (1 sheet), Right-of-way and alignment Plan (by KPG, 1 sheet).
Task 8.4: Bidding Support
The CONSULTANT will assist the City in addressing questions that may be brought up by
bidders during the bid process.
Task 8 Assumptions:
Assumes up to two (2) Bid Amendments, up to four(4) RFIs. Assumes a three week bidding
process.
Task 8 Deliverables:
• 30% CITY's Comments list, responses to comments, and 30% Plans re-submittal with
30% comments incorporated
• 90%, 100% and Bid Ready Project Plans submitted electronically (11x17 .pdf format)via
email or email link; two (2) hard copy stamped and signed Bid Ready Plan Sets.
• 90%, 100% and Bid Ready Construction Cost Estimate, submitted electronically (.pdf
format) via email or email link; two (2)final estimate stamped and signed.
• 90%, 100% and Bid Ready Final Signed Special Provisions, submitted electronically
(Microsoft Word format)via email or email link, with two (2) hard copies.
• Input for up to two (2) Bid Amendments
• Response to up to four(4) requests for information (RFIs) during the bidding process

PROJECT DESCRIPTION
The services to be furnished by WSP upon receipt of written direction to proceed from DKS
Associates(hereinafter referred to as the CONSULTANT), are supplemented as described
below. Unless otherwise noted, the following scope of work supplements the original scope of
work.
This scope of work is for work to be provided by WSP to support DKS with the final design of
the Southwest 41st Street and Oakesdale Avenue Southwest Intersection Improvements project.
Oakesdale Avenue SW provides a vital north-south freight traffic corridor within the City of
Renton. The existing Oakesdale Avenue SW/Southwest 41st Street intersection consists of a
stop-controlled leg along Southwest 41st Street to the east and a commercial driveway to the
west, creating a fourth leg outside of the public right-of-way(ROW).Springbrook Creek and the
Springbrook Creek pedestrian trail also intersect Oakesdale Avenue SW at this intersection and

3. The final design for the project will be completed within four months of the notice to
proceed. Extension of the design completion date,caused or required by the CITY,
beyond the number of months,may result in an extension of time and a supplemental
agreement for additional funds to cover the costs associated with the extension of time,if
additional hours are needed to complete the design.
4. The roadway widening for this project will not exceed 5,000 square feet of new
pollution-generating impervious surface and that the existing culverts,which convey
Springbrook Creek north and west through the intersection,will not be affected by the
proposed project improvements.
5. Stormwater treatment will be consistent with the 2017 City of Renton Surface Water
Design Manual(SWDM). It is understood that a full technical information report(FIR)
will be required for this project.
6. No new pedestrian facilities will be added to the project within the Springbrook Creek
Buffer area,including revisions to the location of the trail or widening of the trail.
7. Proposed roadway improvements will not be required within the BNSF Railway
crossing located north of the intersection and that coordination with BNSF Railway will
not be required.
8. Public involvement will not be necessary for this project. This includes preparing a
website,fliers,mailings, or any other public notices regarding the project. If necessary,
these will be prepared by others,will be included in a future supplement,or will be
included under a separate contract.
9. Major utility design,relocation, and/or upgrades will not be required for this project. It
is assumed that the CITY will invite the water and sewer department and any other
known utility purveyors within the project limits,to review the project and assess
potential impacts to their systems. This will be conducted in one meeting for the final
design work.
10. If required,potholing for utilities will be performed by others.
11. The CITY will provide any previous traffic reports, geotechnical reports,trail
projects/plans, or other reports that may have occurred within the project boundary or
adjacent to the project that may provide additional insight to be used for this project.
12. The City of Renton have a separate environmental consultant for environmental and
permitting services.WSP,in coordination with DKS,will provide up to two exhibits to
the CITY's environmental consultant. If the allowance of 8 hours is not sufficient„WSP
will review the level of effort to determine if the level of effort required is beyond the

level of effort assumed. A contract amendment may be necessary to supplement the
assumed level of effort.
13. The ROW plans,exhibits, and legal descriptions for the project will be provided by
others and no coordination will be required by WSP other than providing the limits of
proposed civil work.

15. Landscape or irrigation design will not be required as part of this project.

CONSULTANT will request and obtain acceptance from the CITY prior to moving

17. The 108-and 72-inch King County wastewater gravity sewer mains located within the
Oakesdale Avenue SW ROW will not be impacted as part of the intersection
improvements.
18. Preparation of a Public Interest Finding(PIF)will be required by others to submit to the
City Mayor for approval.This project scope for WSP does not include preparation of a
PIF.
19. It is assumed that preparation of Maximum Extent Feasible (MEF) documentation will
not be required unless curb ramps cannot meet current requirements. This project has
standard grades at the intersection;therefore,no.MEF documentation is assumed to be
necessary on this project.If required,MEF documentation will be added to this project
under a supplemental agreement.
20. DKS will prepare the channelization plans for approval.
21. DKS will compile the overall plan set,including the cover sheet,channelization and
signing plans,signal plans,and traffic control and detour plans as applicable.
22. DKS will be responsible for the overall reproduction of the PS&E packages that are
submitted to the CITY for review and approval.
23. A constructability review will be required for the final design effort by the
CONSULTANT.

TASK 1.0 PROJECT ADMINISTRATION
This task will include project administration,meetings, coordination, and QA/QC.
Subtask 1.1 Monthly Invoices and Reporting

• Prepare and submit monthly invoices,including a tabulation of hours expended,broken

Subtask 1.2 Team Meetings
DKS will facilitate four internal project team coordination meetings. Meetings shall be
approximately 1 hour in duration and will be attended by one WSP staff member via
telecommunication correspondence.
Subtask 1.3 Project Coordination
It is estimated that an average of 4 hours per month over four months for a total of 16 hours will
be spent coordinating with the CITY,DKS, other team members firms, and utility companies
via the phone and through email correspondence.
Subtask 1.4 City Meetings
The CITY will facilitate one project meeting per month over the course of the project. The
meeting will include 3 hours per meeting for preparation, travel, and meeting time. These will
be attended by one WSP staff member. DKS will prepare an agenda and shall provide summary
notes within two business days from the meeting date.
Subtask 1.5 Utility Coordination Meetings
The CITY will facilitate utility coordination meetings with project utility companies and other
entities,public or private,whose facilities may be affected by the project. WSP will participate in
one meeting with the CITY and the utility representatives. The meeting will include 3 hours for
preparation, travel, and meeting time. This will be attended by one WSP staff member. The
agenda and summary notes will be prepared by DKS within two business days from the meeting
date.

• Up to two exhibits to assist utility companies with their utility relocation designs.
Subtask 1.6 Coordination with CITY's Environmental Consultant
WSP will coordinate with the CITY's environmental consultant to provide them with •
calculations and an overview of the design that they may need for environmental permits and
documentation. Any exhibits required will be provided under Subtask 1.7.
Subtask 1.7 Prepare Environmental Exhibits
WSP will prepare exhibits for the CITY's environmental consultant to be included with
applicable environmental permits and documentation. It is assumed that two 8-1/2 x 11 exhibits
will be prepared for this effort.

Subtask 1.8 Quality Assurance
WSP will provide quality assurance/quality control(QA/QC) for all their design work elements
in accordance with their QA/QC standards.
TASK 2.0 CIVIL DESIGN
The civil design work prepared by WSP will include those services necessary to prepare plans
up to a final design level for the CITY's review;to determine utility impacts; to determine
environmental impacts; and to determine ROW impacts and needs. WSP will prepare
90 percent plans,specifications, and an anticipated construction cost estimate(PS&E)
documentation to DKS to submit to the CITY for the CITY's review.
WSP will prepare the 100 percent and Ad-Ready final PS&E bid documents of their related
design elements and will submit them to DKS Associates for inclusion into the final plan set.
WSP will provide bid support services to answer questions from contractors during the bidding
period. WSP will provide a conformed set of bid plans once the contract has been awarded to a
contractor.
Subtask 2.1 Prepare Final Drainage Report
WSP will prepare a full drainage report with the 90 percent design that incorporates all CITY
review comments on the draft drainage memorandum completed during the 30 percent design.
Assumption(s)
The scope of work defined within this document includes the assumptions noted below.
• A full drainage Technical Information Report(TIR)will be required for this project.
• The open channel and existing culverts conveying Springbrook Creek will not be altered as a
part of this project
• New pollution-generating impervious surface created by the project will be less than 5,000
square feet.

Subtask 2.2 Final Utility Design
It is assumed that no utilities will need to be relocated as part of this project,including the water
lines,hydrants, and the Renton gravity sanitary sewer main located near the intersection.
Subtask 2.3 Complete 30 Percent and Prepare 90 Percent Plans and Details
WSP will prepare final design plans and details as necessary for the project. The plans will be
submitted to the CITY for review and acceptance prior to preparing the final bid documents.

prices, contingencies, and the anticipated cost of construction. This will be sent to DKS for
review and submitted to the CITY for review.This work includes coordination with DKS and
the CITY to resolve any questions that they may have and to get the bid items in different
payment schedules if necessary. Comments received will be incorporated into the final
engineer's cost estimate.

Subtask 2.6 Constructability Review
WSP will review the PS&E package with their construction management team for their design
elements. This review will be tailored to the construction of the project to determine if there are
any aspects of the package or concerns that the design team needs to address before the project
is advertised. This review will check to verify that the design is compatible with construction
practices.
Subtask 2.7 Special Provisions •
WSP will prepare the special provisions necessary for their design elements of the project and
submit them to DKS Associates. This effort will include coordinating with DKS and the CITY to
ensure that the necessary items are included in special provisions.

one set of consolidated review comments for each submittal review.WSP will respond to their
applicable comments and incorporate the agreed-upon resolution into the final construction
document(s).

• Up to two review meetings will be held with the CITY,which will include 4 hours per
meeting for preparation,travel, and meeting time. These will be attended by one WSP staff
member.

TASK 3-AD, BID,AND AWARD SERVICES
3.1 Bid Advertisement Assistance
DKS Associates shall assist the CITY in preparing the contract bid documents for advertising
and getting them uploaded to an internet site of their choice for contractors to download and
review during the bid review process. It is assumed this assistance will be for a two-week
timeframe.
3.2 Response to Bidder Inquiries
WSP shall provide formal responses to comments received by the CITY during the bid
advertisement period. The responses to the comments will be submitted to the CITY for further
distribution and dissemination to the contract plan holders. It is assumed that WSP will provide
up to two formal responses.It is assumed there will be a three-week bid period.
