NOTICE OF RENTON MUNICIPAL CODE VIOLATION
The City has elected to establish a non judicial hearing and determination system to enforce Renton Municipal Codes (RMC) civil code
violations. Therefore a code violation penalty, consistent with RMC 1 —3-2.P is imposed, not including any costs, fees or assessments.
You may respond in the following manner•
I deny creating, permitting to exist, maintaining or failing to eliminate the violation(s) and I am requesting a hearing to contest this
Finding of Violation. Appeal requests must be received by the Renton City Clerk's office within 15 days of the date of this Finding of
Violation. Please send me a hearing date. I promise to appear on that date. The administrator must prove by a preponderance of the
evidence that I committed the violation. I understand that under RMC 1-3-2.0 that the administrator shall decide whether the
opportunity to be heard will be only in writing or in person, or both. The city is not required to call witnesses to testify at the hearing.
Pursuant to RMC 1-3-2.K, failure to attend the scheduled hearing makes the Finding of Violation final, and I may be subject to
additional costs if I fail to withdraw or resolve my appeal prior to the hearing date. I also understand that the city has not waived any
rights or remedies under the law

March 21, 2019: Code Compliance received an inspection request for commercial
trucks, a shed built without a permit, and a painting business operating at this address.
March 22, 2019:1 observed and photographed violations for number of vehicles,
inoperable vehicles, and construction without a permit. See photos in exhibit 3.
March 25, 2019: 1 opened Code Case 19-000148 and issued a Warning of Violation for
more than four cars parked on a residential parcel, inoperable vehicles, and no building
permit. At this time I did not include the home occupation as I did not witnessed the
work vans at the property and Washington State Department of Revenue did not list
1210 Pierce PL NE as the location of a business. See exhibit 4.
June 4, 2019: Erin Churchill, Graffiti Abetment Coordinator sent e-mail stating a resident
approached her while she was working in the area about the business vehicles and the
shed built without a permit. See Exhibit 5
June 5, 2019: Code Compliance received an inspection request for the driveway
construction, painting business, and vehicles parked. Inspection photos show a painting
van, 3 step ladders, and trim. See exhibit 6.
June 12, 2019: Inspection showed a newly installed driveway, a painting van, step
ladders, and an excavator. Print out of City of Renton Maps to illustrate the driveway
layout in 2017. See Exhibit 7
June 17, 2019: 1 referred code case 19-000148 to a new code case 19-000358 to include
the business and driveway violations. I issued a Warning of Violation dated June 17,
2019 for maximum number of driveways, home occupation, and no building permit.

June 18, 2019: Gerson De Leon called. We discussed the violations. He states that he
was told that a permit was not needed for the retaining wall or the driveway addition. I
stated that a home occupation license was needed and that employees could not report
to work at this location.
September 3, 2019: Code compliance received a letter requesting an inspection with
photos of painting vans and the retaining wall being constructed. See exhibit 12
September 4, 2019: Inspection by Lead Code Compliance Inspector Donna Locher
showed a painting van being towed onto the property. See Exhibit 9.
September 9, 2019: 1 issued a Finding of Violation dated September 9, 2019 for
maximum number of driveways, parking allowed number in residential zone, home
occupation, and no building permit. Gerson De Leon is the owner of 1210 Pierce PI NE
and a governing officer for DeLeon Painting LLC. See exhibit 10 and 14.
September 11, 2019: Gerson De Leon called and stated that he received the Finding of
Violation. He did not agree with the violations. I explained how to appeal the finding.
October 2, 2019: Inspection shows that the shed in the back yard built without a permit
was removed. See exhibit 11
October 11, 2019: Tax & License Division sent a letter requesting business license
registration based on Washington State Department of Revenue address records. See
Exhibit 13
October 15, 2019: 1 observed and photographed five 5 gallon buckets of paint and other
items consistent with a painting business. This property has more than one driveway.
Finding of Violation dated October 15, 2019 issued for maximum number of driveways
and home occupation violations. See Exhibit 15
October 22, 2019: Appeal request received. See exhibit 1
Code Case 16-000825: Code case was opened on December 16, 2016 for a home
occupation violation at 1209 N 35th St, Renton, WA 98056. During the course of this
case two Warnings of Violation were issued dated December 16, 2016 and January 11,
2017, and two Findings of Violation were issued dated January 26, 2017 and February
10, 2017. As part of the resolution of this case an email was sent stating the
qualification standards for a home occupation listed in RMC 4-9-090 F.4. This included
the standard that no additional parking may be added. See exhibit 16
The city's position is that more than ample time has been granted to bring the property
into compliance, which has not happened.

06/18/2019 Kevin Louder Contact Violator Gerson De Leon 206-290-3883 called. He
stated that he came into city hall before he
added the retaining wall and gravel area and
asked if he needed a permit. He said he was
told that the work did not require a permit. He
said he was told it was not a driveway
because it was not concrete. He was
frustrated and thought that he was being
targeted by the neighbors because he was
Latino. He says that he addresses the
complaints that he gets from his neighbors
even if it is not his fault. He fixed his
neighbors gate and has also picked up
cigarette butts that were not his.
I explained that I only work valid complaints.
The violations that I saw were too many
driveways, more than 4 vehicles (including
trailers), the shed in the back yard, and no
home occupation business license. I told him
with the home occupation he was not allowed
to have employees report for work in this
location. I explained that I have counted as
many as 3 commercial vehicles at his house
and the rental he has across the street. I told
him that his activities at this address are not
consistent with a residential area.
I told him that if he got planning to sign off on
his driveway then the driveway violation
would be resolved. I told him that the WOV1
has a CBD of 07-02-19. He said he would talk
to planning about the driveways and have the
other violations resolved.

There were only 4 vehicles on the property.
They were all operable. The driveway
remained and the shed, but there was no
work vans present today.

plates and the yellow semi does not appear
operational.
Large shed recently constructed in the back
yard. No building permit.

Pictures attached. Two apparently inoperable
semi trucks, a boat, and five vehicles parked
in the front yard. No permit on file for the
structure in the back yard.
I looked up the tracking information for the
WOV1 and as of 04-11-19 it does not have a
delivery confirmation.
USPS delivery status:
"The delivery status of your item has not been
updated as of March 29, 2019, 10:28 pm. We
apologize that it may arrive later than
expected."
Due to this I am issuing WOV2 and
Diary Log I handed the WOV2 to a person who identified
herself as Gerson De Leon. Inspector Rob
Shuey witnessed. While I was speaking with
her I believe Gerson was listening via the Ring
doorbell. He said he would call me.
The property had more than 4 vehicles
including the semi trucks parked in the back
yard.
Gerson 206-290-3883 left a message while I
was in the field. I left a message stating that
there could only be 4 operable vehicles on the
property and that the structure required a
permit.
Contact Violator Gerson called 206-290-3883. He stated that
he removed the vehicles from the front of his
home. He has hired a consultant to submit for
permit. He is also debating about removing the
structure and building another that would be
under 200 sq ft and not subject to a permit.
He requested two weeks to hear from the
consultant and make the decision. I granted
extension to 05-09-19

Hi Kevin,
I was up on NE 12" St documenting some graffiti and I was approached by a resident about a property he was concerned
with. According to him 1210 Pierce Ave NE has an illegal shed and constantly has business vehicles illegally parked. I
assured this individual multiple times that I was the wrong person to report to but he seemed frustrated with reporting
to Code Compliance so I told him I would pass on the info. In good faith I am passing on the information. The shed does
look pretty rough but I didn't see any business vehicles park there when I went by. Attached is an image of the shed
from road.

NOTICE OF RENTON MUNICIPAL CODE VIOLATION
The City has elected to establish a non judicial hearing and determination system to enforce Renton Municipal Codes (RMC) civil code
violations. Therefore a code violation penalty, consistent with RMC 1-3-2.13 is imposed, not including any costs, fees or assessments.
You may respond in the following manner:
I deny creating, permitting to exist, maintaining or failing to eliminate the violation(s) and I am requesting a hearing to contest this
Finding of Violation. Appeal requests must be received by the Renton City Clerk's office within 15 days of the date of this Finding of
Violation. Please send me a hearing date. I promise to appear on that date. The administrator must prove by a preponderance of the
evidence that I committed the violation. I understand that under RMC 1-3-2.13 that the administrator shall decide whether the
opportunity to be heard will be only in writing or in person, or both. The city is not required to call witnesses to testify at the hearing.
Pursuant to RMC 1-3-2.K, failure to attend the scheduled hearing makes the Finding of Violation final, and I may be subject to
additional costs if I fail to withdraw or resolve my appeal prior to the hearing date. I also understand that the city has not waived any
rights or remedies under the law.

The City has elected to establish a non -judicial hearing and determination system to enforce Renton Municipal Codes (RMC) civil code
violations. Therefore a code violation penalty, consistent with RMC 1-3-2.13 is imposed, not including any costs, fees or assessments.

Code Text: Renton Municipal Code requires each business enterprise at each location to have a valid City of
Renton business license. A review of the city records by the business license accountant indicates
your business is operating in a residential zone and does not have a valid home occupation business
license for this location.
Corrective Action: Apply for a home occupation business license to continue operating this business as office space
only. There may be no outside indication other than a 2' x 2' sign attached to the house that there is
a business operating at this location. The home occupation shall not employ more than one
nonresident of the dwelling unit. The outdoor storage or display of materials, goods, products or
equipment is prohibited.

I was provided your email address by Ruth Perez. Since December 16, 2016 1 have mailed 2 Warnings of Violation and 2
Findings of Violation to De Leon Painting for not having obtained a Home Occupation Business License. You have also
been assessed a total of $300 in Code Enforcement Fees. To date, no one has contacted me or applied for the business
license. I am at the point where I must assess another $300 in fees if you don't obtain the business license, which is
something I would prefer to avoid.
If you can meet the conditions of the home occupation license, it will be approved (this means that they will have to
move all the ladders out of site). The conditions are as follows.
Qualification Standards:
a. Primary Residence: The property on which the business is located must be the primary residence of the business
owner.
b. Retail Sales and Storage: No retail sales shall be allowed, except for sales of products made on the premises.
Incidental supplies necessary for business operations may be kept if not for sale. Products may be sold wholesale and
stored for wholesale distribution.
c. Parking: There shall be no expansion of parking, including the addition of on -site or off -site parking spaces, to support
the home occupation.
d. Employees: The home occupation shall not employ more than one nonresident of the dwelling unit. An employee for
these purposes means one individual, not a full-time equivalent. In addition, home occupations may use professional
services such as accountants.
e. Mechanical/Electrical Equipment: There shall be no use of mechanical or electrical equipment that would change the
structure or create visible or audible interference in radio or television receivers or cause fluctuations in line voltage
outside the dwelling unit.
f. Environmental Impacts: There shall be no noise, vibration, smoke, gas, dust, odor, heat or glare produced by the
business which would exceed that normally associated with a dwelling.
g. Space: The business shall not occupy more than twenty five percent (25%) of the floor space of the gross floor area of
the residence, and in no event, more than five hundred (500) square feet.
h. Outdoor Storage: The outdoor storage or display of materials, goods, products or equipment is prohibited. Domestic
animals or household pets kept as an accessory use and utilized as a component of a home occupation are excluded
from this provision. (Ord. 5356, 2-25-2008)
i. Flammable Liquids: A permit must be obtained for storage, handling or use of Class I flammable or combustible liquids
on the premises.
j. Fire Extinguisher: A minimum rated 2-A 10 BC fire extinguisher is required on the premises.
k. City Codes: The home occupation must meet all City codes and ordinances for type of business being conducted.
I. Building Alterations: Any alterations to the building shall be conducted pursuant to the issuance of a permit from the
Planning/Building/Public Works Department.
m. Accessory Structures: Existing garages with adequate access may be used for home occupations; provided, that the
property still complies with the parking requirements of the zone. Other accessory structures, such as carports and tool
sheds, shall not be used for any activities associated with the business other than storage. Such storage shall be
completely enclosed and not be visible from outside the accessory structure. Accessory structures providing shelter for
domestic animals or household pets that are a component of the home occupation are allowed. (Ord. 5356, 2-25-2008)
n. Signage: There shall be no exterior or window signage, display, or advertising except for one nonelectric and
nonilluminated sign attached flush to the wall or window of the building with the face of the sign in a plane parallel to
the plane of the wall or window. The allowed building sign may not be larger than two (2) square feet in area. The sign
material and appearance must be harmonious with the architecture of the home. Pursuant to RMC 4-4-100B6q, a permit
is not required for the allowed building sign.
If you feel you can meet these standards, please submit an application for the business license. If you are not able to
meet the standards and continue to use the residence for a business, they will be assessed additional fees and
eventually issued a criminal citation.
