Page2of2January31,2007TheHearingExaminerhasremandedthematterbacktotheDevelopmentServicesDivision,andtheOrdertoCorrectisbeingheldinabeyancependingcompletionofindependentsecondaryreviewoftheapplicant’swetlandreport.Acopyofalettertotheapplicant’slegalcounselisattached.NguyenProperty,1824NE20thStreet:InDecember2006,CodeCompliancereceivedareportoftreesbeingcutdowninawetland.Oninspection,itwasfoundthatPoplartreeswerebeingcutdownontheproperty,includingsometreeslocatedinawetlandbuffer.Thetreesweremature,andneartheendoftheirlifecycle.BothaStopWorkOrderandanOrdertoCorrectwereissued.ThetreesonMr.Nguyen’spropertyoutsideofthewetlandandbufferwereallowedtoberemovedasprovidedforinRentonMunicipalCode.Treesinthewetlandbufferthatwereconsideredtobedangerouswereallowedtobecut,providedreplacementoccurredatahigherratio.Mr.Nguyenhasagreedtothisrequirement,andwillplanttwo(2)treesforeachofthetreesremoved.Thereplacementtreesmustbeinstalledbymid-Aprilofthisyear.CodeCompliancewillcontinuetomonitorthissituation.GordleyProperty,2120JonesAvenueNE:Duringthespringseasonlastyear,theGordleyscontactedCitystaffforassistanceindeterminingwhetheragingtreeslocatedontheirpropertycouldberemoved.ThelargePoplartreeswereneartheendoftheirlifespan,andposedathreattobuildingsinthearea.Abuildingonaneighboringpropertyhadbeendamagedwhenoneofthetreesfellduringawindstorm.TheGordleyshadreceivednoticefromthatneighbor’shomeinsurancecarrier,askingthatthetreesberemoved.StafffromCodeComplianceandParksvisitedthesiteandassessedthehealthandconditionofthetrees.fourteenPoplarsweredeterminedtobeinpoorhealth,attheendoftheirlife,dangerous,oracombinationofallthree.Those14treeswereallowedtoberemovedperRentonMunicipalCode,andthetreesinhealthyconditionremained.h:\division.s\develop.ser\dev&plan.ing\jth\issuepapers\clearing&grading20thones.doc PLANNING/BUILDING!PUBLICWORKSDEPARTMENTMEMORANDUMTO:VIA:FROM:STAFFCONTACT:SUBJECT:January31,2007ToniNelson,CouncilPresidentMembersoftheRentonCityCouncilKathyKeolker,Mayof’Kl<GreggZimmerma1G’PWAdministratorNeilWatts,DevelopmentServicesDirectorClearingandGradingActivitiesintheVicinityofNE2O”Street&JonesAvenueNEOverthepastseveralmonths,gradingactivityand/orvegetationremovalhasoccurredonthreepropertieslocatedneartheintersectionofNE20thStreetandJonesAvenueNE.Thepropertiesareownedbydifferentpartiesandwillbereferredtobelowbothbyownerandaddress.DutroProperty,1828NE20thStreet:InAugust2006,fillingactivitiesonthispropertywereobservedbyaneighborandreportedtoCodeCompliance.Sincetheworkwasoccurringwithoutapermit,theowner(Mr.Dutro)wasorderedtostopwork,untilhecouldobtainavalidpermit(annualgradinglicense).Mr.Dutrocharacterizedtheworkaslandscaping,andwasobservedtobeinanareawhereahouseandoutbuildingshadrecentlybeendemolished.Apermitwasissuedallowingtheownertoproceed,providedcertainconditionsweremet.Theseconditionsincludedarequirementforerosioncontrol;providingawetlandstudywithin60days;delineatingandfencinganywetlandarea;complyingwithrecommendationsofthewetlandstudy;andhydroseedingwithin30daysofthepermitissuance.Mr.Dutrocontinuedthework,addingadditionalmaterialbeyondtheoriginalestimateof150cubicyards,butlessthanthenextpermitthresholdof500cubicyards.Heprovidedawetlandstudyandhydroseededtheareaofworkinaccordancewiththeconditions.Inaddition,afillsourcestatementwassubmittedtostaff.Anappealofthegradinglicensewasfiledandadatewassettoconsidertheappeal.Asstaffpreparedfortheappealhearingandreviewedotherwetlandreportspreparedforpropertiesinthevicinityofthissite,staffdeterminedthattheworkmayhavebeenoccurringinornearawetland.Thewetlandstudyprovidedbytheapplicantwasinconclusiveastotheboundariesandbufferofanywetlandareaonsite.CodeCompliancewasinstructedtoissueanOrdertoCorrecttorestorethewetlandarea.Staffstatedatthehearingthattheybelievedthegradinglicensewasissuedinerror.h:\division.s\develop.ser\dev&plan.ing\jth\issuepapers\clearing&grading20thjonesdocVDATE: CITYOFRENVONOfficeoftheCityAttorneyLawrenceJ.WarrenSeniorAssistantCityAttorneysMarkBarberZaneftaL.FontesAssistantCityAttorneysAnnS.NielsenGarmonNewsomHShawnI.ArthurJanuary4,2007Mr.FredKaufmanCityofRentonHearingExaminer1055SouthGradyWayRenton,WA98055Re:TerryDutro/O’ConnorPermitAppeatHearingDearMr.Kaufman:Asyoumayrecall,thiscasewasoriginallyscheduledonNovember14,2006.ItconcernedAppellantWilliamO’Connor’sappealoftheCityofRenton’sissuanceofagradeandfillpermittoTerryDutro.Atthatproceeding,theCity’sPrincipalPlanner,JenniferHenning,indicatedtotheExaminerthattheCity“erredinissuingabuildingpermitforthisaction”andthus,wasnotcontestingMr.O’Connor’sappeal.Nonetheless,Ms.HenningstatedthattheCitydidnotintendtorevokethepermitatthattime.Inresponse,theExaminerstatedthatunlesstherewassomeothermitigatingissue,theappealis“nullandvoid”andthemattershouldbedismissed.However,bothMs.HenningandChristopherBenis,Mr.Dutro’sattorney,requestedthatthematterbecontinued,becausetheCitywantedcertainadditionaldocumentsfromMr.Dutroregardingthepermit.’AlthoughtheHearingExaminerappearedtofindtheappealitselfmoot,inlightoftheCity’sconcessionoferror,theExaminerallowedthemattertobecontinuedtoJanuary9,2007.Inreviewingthiscase,Ihavefoundcaselawthatsupportsthepropositionthatapermitissuedinerrorisvoidabinitio.Furthermore,inlightofMs.Henning’sstatementthattheCityerredinissuingthispermitandwouldnotbedefendingitsposition,theCityintendstorestandwillnotbepresentinganythingfurtheronJanuary9,2007.IhaveconveyedthisintentiontotheAppellant,Mr.O’Connor,aswellastoMr.Dutro’sattorney.Notwithstandingthis,itappearsthatMr.DutroiswillingtocomplywiththeCity’srequestsforsubmissionofadditionaldocuments(inparticular,awetlanddelineationreport)insupportofhispermitapplication.Productionofthiswetlandreport,amongotheritems,wouldbetterassisttheThepartiesareawarethatI’fr.Dutro,thoughheisapartyofrecord,ismoreorlessabystanderinthiscase.ItistheCity’sactionthatisatissueandMr.O’Connor,astheAppellant,andtheCityarethetwoprimaiypartiesinapositiontopresentandarguethecasebeforetheExaminer.However,itisMr.Dutro’spropertyandhisactionsregardingthepropertywhichgiverisetotheappeal.And,theCityrequesteddocumentsfromMr.DutrowhichMr.Dutroindicatedhewouldbewrfflingtoprovide,butwouldneedtimetoproducethosematerials.KathyKeolker,PostOfficeBox626-Renton,Washington98057-(425)255-8678/FAX(425)255-5474 DELMORAL&ASSOCLTESCERTIHEDECOLOGICALCONSUlTANTS200242NDAVENUEEASTSEATTLE,WASFHNGTON98112206323-71061X:206-685-1728September22,2006RE:EvaluationofPropertyNorthof182$ME20thSt.,Renton,WA98056Mr.TerryDutroOwner:MasterbuilderConstruction10711SE30thSt.Bellevue,WA98004DearMr.Dutro:OnSeptember21,2006,Ivisitedthesubjectproperty(hereincalledthe“Coreproperty”forconvenience.)Asyouknow,itiswithin200feetofastreamlocatedtothewest.TheCityofRentonhasrequestedthatyoudeterminethedistancestoexistingwetlandsintheeventthatanyaresufficientlyclosetoaffectyourproperty,eitherdirectlyorbecauseofbufferrequirements.Thesiteis100ftby355ft(1.15acres).Mostofthispropertyhasbeencleared,withexceptionsofsomefruittreesonthenorth,severalDouglasfirsonthesouth,andanarrowbandofveryyoungaldersonthewest.AnaccessroadleadingnorthfromNE20thSt.formstheeasternedge.Thissurroundingareaisundergoingconsiderabledevelopment.Therearenewhomesnortheastandeastofthisproperty.Thepropertytothesouth,alongNE20thSt.willsoonhaveanewhome.Propertiestothewest,currentlyfields,appeartobeunderenvironmentalinvestigationthatwouldoccurbeforedevelopment(seebelow).IreviewedthereportbyEllisportEngineeringthatdescribedwetlandconditionsonthispropertyanditsassociatedareas(knownastheGordlyandCorePropertiesinthatreport).ThisreportwasconductedinOctober,2004byMs.AnneSecthoft.Recently,IreviewedthepropertytothesouthforMr.DanielNguyen(reporttoMr.NguyendatedAugust30,2006;IbelievethatithasbeenfiledwiththeCity).IdeterminedthatasmallwetlandexistsnorthoftheNguyenproperty,butdidnotexaminetheextentofthatwetlandbecauseitwasnotonthesubjectproperty.However,Ididdetenroinethatbyexistingrules,thewetlandwasaCategory3wetland,describedasawetlandthatisseverelydisturbed,ThisreportdescribesmyfindingsconcerningvegetationonandadjacenttotheCoreproperty.Inparticular,Imeasuredthedistancefromthepropertytoexistingwetlandsandexaminedthewetlandtothesouthofthepropertyinmoredetail.METHODSWetlanddelineationofthenorthernedgeofthewetlandfragmenttothesouthofthepropertywasmadeusingtheWashingtonStateDept.ofEcologymanual(WetlandsIdentificationand DelineationManual,1997),asrequiredbytheCityofRenton.Tobeawetland,thesitemustsimultaneouslydemonstratepositiveindicationsofhydricsoil,hydrophyticvegetationandwetlandhydrology(saturationforasignificantportionofthegrowingseason).Thelackofdirectpositiveindicationsofwetlandhydrologydoesnot,byitself,indicatedthatasiteisanuplandatthistimeofyear.Soilconditions,topography,typeofvegetationandothercriteriamayindicatethatsoilsaresaturatedforasignificantportionofthegrowingseason.AnadjacentwetlandwasdelineatedbyEllisportEngineering(lettertoMr.Nguyen,May31,2006byAnneSeethoff),butthatletterdidnotprovideanexactdelineation.Itwasbasedonthe2004report(“Gordly-CoreProperties”).InmyreporttoMr.Nguyen,Idelineatedthesouthernedgeofthewillow/hardbackthicketlocatedascloseas5feetfromhisproperty,andusedthesouthernedgeofaditchleadingtothenorthwestastheedgeofthewetland.Ididnotinvestigatethetwoditcheswithinthewetland.ThiswetlandwasdeterminedtobeaCategory3wetlandbyEllisportEngineeringandIconfimiedthisfinding.Theirfindingsnotedsubstantialhuman-induceddisturbances,alteredhydrology,changesinsoils,andchangesinvegetation.Theunderstoryofthescrnb-shrubareaisdisturbedbytheactivitiesofchildrenwhoplayinthissite.MyinvestigationconfirmedthefindingthatthatthewetlandisaCategory3wetlandsandisbyalteredsoil(somefill,dikesandditches),alteredhydrology(ditches)andalteredvegetation(manyexoticspecies).InRenton,suchawetlandrequiresa25ftbuffer.Alongtheeasternedgeoftheproperty,thereisabermformedbyexcavationsassociatedwiththeinstallationofasewerline.Thisbermisdominatedbyyoungredalderandweedyvegetation.Westofthisai-ea,anotherfirmhasdelineatedtheeasternextendofwetlandsontheadjacentproperty.FlagsweredatedSeptember14,2006.Theseflagsappeartobeaccuratelyplacedandincludedaneasternextensioninaditch.ThesurroundinguplandvegetationwasdominatedbyHimalayanblackberry.Usingmydelineationofthenorthernedgeofthesouthernwetland,andtheflaggeddelineationofthewetlandtothewest,Imeasuredthedistancedirectlyfromtherelevantpropertylines.RESULTSGeneralConditionsRecentrainshadwetthesoilthoroughly,thoughnotnecessarilytocreatesaturatedconditionsifthesecandevelop.Thebulkofthepropertyhasbeenclearedandfilled.TheEllisportreport,conductedinOctober2004,determinedthatdespitehydrophyticvegetationandhydricsoil(asindicatedbyaMunsellcolordetermination),thevegetationalongthewesternedgeoftheCorepropertywasnotwetlandsbecausethesoilwasnotsaturated.Myexaminationofthisboundaryagreeswiththatdetermination.Thissitemayhaveoncebeenawetland,butrecentandsubstantialhydrologicalhaveremovedthewetlandhydrology.Itappearsthatthewatertableinthisareahasdropped,andthatthehydrophyticvegetationnotedbyEllisportisarelict,asisthesoilchroma.Inmystudy,Ifoundthatsoilchromahadalsoincreasedinvalue(lessblack)andthatinmostcasesnolongerindicatedhydricconditions(seebelow).Vegetation,whilestillhydrophytic,waslessso.Small-fruitedbulrush,commonin2004,wasreducedtoasingle,verysicklyplant.Thisobligatespeciesvouldbeexpectedtobethefirsttodieoutifthewatertabledropped.7 incontrast,speciessuchasthePacificwillowaredeep-rootedandcanpersistfordecadesifthewaterleveldoesnotdroptoofar.Thus,theareatothesouthofthesttbjectpropertyretainstheappearanceofawetland,butithasshrunksubstantially.tVetlandEdgeitearSotttltemBoundaryAlongthesouthernedgeoftheproperty,Ilookedatsoilandvegetationtodetermineifthisedgecontainedwetlands.Thefirstsample(I),nearthesoutheastcorner,hadsoilcolorat18inchesthatwasdistinctlyuplandinnature(IOYR4/3),eventhoughthevegetationwashydrophytic.Thesoilwasmoistandwelldrained,evenafterrecentheavyrains.ThevegetationwasdominatedbyHimalayanblackberry(50%;SeeTableIforScientificnamesandwetlandindicatorvaluesofspeciesencountered),Pacificwillow(20%),creepingbuttercup(30%),reedcanarygrass(20%)andhardhack(10%).Thiscombinationofspeciesindicatesmoist,heavilydisturbedconditionsthatmaybeintransitiontoupland.Atasecondsite(II),nearthemiddleofthisboundary,thesoilwasdarker(IOYR2/2),butitlackedmottles,andthusisnothydric.Thesoilwasmoist,notnearlysaturated.Thevegetationwashydrophytic,heredominatedbyPacificwillow(60%),withHimalayanblackberry(30%),creepingbuttercup(20%)andsomereedcanarygrass.Thethirdsite(III)alongthisboundarywasmowedgrassandwasnotwetatall.Thesoilwasnothydric(1OYR2/2,nomottles),whilethevegetationwasmixedpasturegrassandweeds.IsearchedforthenorthernedgeofthewetlandsouthoftheCoreproperty(thesouthernedgeofwhichIhadflaggedinAugustforMr.Nguyen).Iwassurprisedtofindthatwhatappearedtobewetlandfromthevegetationdidnothavehydricsoilforquiteadistance(seelater).Here,thehydrologyhasbeenalteredduetosurroundingdevelopmentandtheditcheswithinthewetlandwerenotverywet.Iflaggedthreepoints(A-iontheeast)andA-3tothewest.Theminimumdistancefromthesouthernedgeofthesubjectpropertywasmeasuredtoby40ft.Asurveyofthesethreepointsmaybeprovidedbytheclient.Appendix1providesdetailedinformationaboutthewetlandanditsimmediateupland.A-iisabout50ftsouthofSiteII.ItisstronglydominatedbyPacificwillowwithvirtuallynounder-story.Thereissomewoodferninprotectedsites.Kidsnowusethisareaandhavetrampleditsignificantly.Evenwithinthewetland,conditionswererelativelydry.Thesoilwaswetandsufficientlydarktobeindicatewetlandconditions(1OYR2/1).Within5ftofthissite,Ideterminedthesoiltobemuchlighterincolor(YOYR3/2,nomottles),andconsiderablydrier.Thevegetationwasdisturbed.Whilewillowstilldominated,itwasjoinedbyapreponderanceofexotics(Himalayanblackberry,Englishholly,rowan)andsomeswordfern.Theseallsuggestedrecentdesiccationofthesite.NotethattheditchbetweenthewetlandedgeandtheCorepropertyalsoappearstohavedriedout.Thesoilonitsbankwasnotwetandlightincolor(1OYR4/2);thevegetationonitsbankswasHimalayanblackberryandDouglasfir.WetlandEdgenearWesternBoundaiyNowetlandsoccurredalongthewesternboundary(soilwelldrained,colorsfromIOYR3/2toYOYR2/2,withnomottles.Thesevaluesareconsistentwiththevaluesfoundattheappropriate3 level(15-18inches)byEllisportEngineering.Thevegetationalongthisboundaryisdominatedbyt-edalderandgrasses.Itishydrophytic,butsuchvegetationrarelyoccursinwetlands.Thereis,apparently,awetlandtothewest.BecausethisareaisnotontheCoreproperty,Ididnotsamplesoilorvegetationindetail.Rather,Iacceptedtherecentwetlandflagging.Thisboundaryappearsvalid,thoughitseasternextensionintheditchthatleadsfromtheCorepropertymayextendtoofartotheeast.ImeasuredfromthewesternedgeoftheCorepropertyatseveralpointstothenearestwetlandboundary.Fromsouthtonorth,thedistancesare:over50ft;48if;60if;42ft;and39ft.Thelikelybufferforthedisturbedwetlandtothewestis25ft(Category3),sothereisunlikelytobeanybufferextendingontotheCoreproperty.SUMMARYTheCorepropertycontainsnowetland.Thenearestwetlandsareover40fttothesouthandnocloserthan39fttothewest.Thestream,about130fttothewestisunlikelytobeaffectedbydevelopmentofthisproject.Inthecourseofdevelopingthissite,Irecommendthatexoticspecies(e.g.holly,ivy,reedgrass)beeliminatedandthatthelandscapeplanincludeapreponderanceofnativetreesandshrubs.Thiswillenhancethebioticresourcesofthesurroundings.Thisconcludesmyreporttoyou.Shouldyouhaveanyquestionsorcomments,pleasefeelfreetocontactme.Sincerely,RogerdelMoral4 INancyWeil-review(etter.doc___________________________________________________________Page.-.....-..____N.Weil19July2005Page2of34asisdepictedintheCityofRentonWaterClassesMap(dated5/05).ToqualifyasaType5stream,awatercoursemusthavebeenartificiallycreatedandnotcarryflowsofahistoricstream.Undisputedly,ditchinghasoccurredonthissite,resultinginthepresent,straightandsteep-sidedchannelform.Downstreamofthesite,beyondJonesAvenueNE,anaturalstreamchannelinanarrowvalleywasnoted.Thevalleyinthevicinityofthesubjectpropertyclearlyhasbeenanareathatconveyedsurface-waterpriortohistoricagriculturalandresidentialdevelopment.Exactlyhowthatsurfacewaterwashistoricallyconveyed,whetherassheetandsub-surfaceflow,orinadefinedchannelorbed,istherelevantquestion.Thisvalleywasonceamoreextensiveheadwaterwetlandsystemthatcouldhavehadapermanentorseasonalstreamchannelrunningthroughit.Thishistoricchannelwouldlikelyhavehadsevereand/orbraidedmeanderswithinthewetland.Theburdenofproofastowhetherornotachannelorbedwaspresentpriortoditchingfallsontheapplicant.Thematerialssubmittedthusfardonotaddressthisquestion.Therefore,therecommendationisthattheType4classificationstandsuntilcompellingevidenceisdiscoveredthatprovestheareawaswetlandonlyanddidnothaveachannelorbed.ItshouldalsobenotedthatTheWashingtonDepartmentofFishandWildlife(WDFW)alsohasregulatoryauthorityoverstreams.ConsultationwiththelocalWDFWareahabitatbiologistshouldalsobesoughtfortheirinterpretationofwhetherornotthisareameetstheWashingtonStatedefinitionofastream.WetlandsEllisportEngineeringcontendsthatthewetlandsonparcels3343903563and3343903201havedriedoutduetothesewerlineandnewdevelopment.However,Ifoundthatwetlandboundariesextendacrossmostoftheseparcels.Ingeneral,thefindingsoftheEntrancodelineationareaccurate;howeverboundariesaredifficulttodiscernandcomparetositeconditionsonthesuppliedEntrancomap.Hydrophyticvegetationanddark,hydricsoilsarepresentinallareasdelineatedordepictedbyEnfranco.Ialsonotedthatsoilsweresaturatedtothesurfaceoratleastwithintherootzoneacrosspreviouslydelineatedareas.Itshouldbenotedthatthedelineationfrthesetwoparcelstookplaceattheendofthe2004summer,inOctober.Duetothetiming,itisnotsurprisingthatthesewetlandswereobservedtobedryduringthedelineation.Whilehydrologyisthemostimportantindicatorofthethreerequiredforadeterminationofwetland,itisalsothemostdifficulttointerpretduetoitsephemeralnature.Wetlandhydrologyinthissystemishighlyaltered,butisstilldrivenbygroundwaterandsurfacewatermovementthoughtheditch/streamsystem.Ifoundnoevidencethatthesitehasdriedouttotheextentthatformerwetlandareasnolongermeetthehydrologyparameter.Sincethiswetlandisintheheadwatersofastreamsystem,itwouldqua1if’asClass2
