The regular meeting of the Firemen's Pension Board was called to order by Chairman Kathy Keolker-
Wheeler at 10:04 a.m. in the Mayor's conference room, 7th floor of Renton City Hall. In attendance were
Board members Kathy Keolker-Wheeler, Bill Henry, Bill Larson, and Bonnie Walton ; Jill Masunaga,
Finance Department Representative; and Councilman Denis Law, Finance Committee member.
MINUTE APPROVAL
MOVED BY HENRY, SECONDED BY LARSON, THE PENSION BOARD APPROVE THE
MINUTES OF THE DECEMBER 17, 2003, MEETING. CARRIED.
MONTHLY STATEMENT
The financial report as of December 31, 2003, was reviewed. Total cash/investment balance was
$5,133,413.39.
MONTHLY BILLS AND PENSION PAYMENTS
MOVED BY HENRY, SECONDED BY LARSON, THE BOARD APPROVE THE
PENSION/MEDICAL PAYMENTS FOR JANUARY 2004, IN THE TOTAL AMOUNT OF $33,542.19.
CARRIED.
NEW BUSINESS
Discussion took place regarding whether a Council Finance Committee member could serve on the
Firemen's Pension Board in place of the Finance Committee Chairman. It was determined that since a
City Code amendment would be necessary to allow this, Bonnie Walton will contact the City Attorney and
report back at the next meeting.

Subject: Request for Code Amendment concerning Firemen's Pension Board
Members
By memo dated January 22, 2004, you indicate that there has been a request to change the City
Code to allow the Firemen's Pension Board Members to be changed to substitute a member of the
Finance Committee of the Council for the chairman of the Finance Committee. You then point to
RCW 41.16.020 which requires one of the members to be "the Chairman of Finance of the City
Council". You then inquire as to whether or not someone other than the Chair of the Finance
Committee can serve on the Fireman's Pension Board.
The obvious answer is the statute names a specific individual, that is, the Chairman of Finance of
the City Council. One can take an expansive reading, however, and indicate that when the
Chairman of the Finance Committee is unavailable, that the Vice-Chair is serving as the Chairman
of the Finance Committee and thereby meeting the dictates of the statute. If we wrote the
ordinance in such a fashion as to indicate that the Vice-Chair of the Finance Committee could
serve in lieu of the Chair of the Finance Committee, but only when the Chair of the Finance
Committee was unavailable, then I think we have satisfied the statute. Of course, others could
take a more restrictive reading of this statutory section, but I believe that my reading is the better
reading in that it allows the more efficient provision of governmental services. I also wonder who
would complain about this common sense solution to a mino problem.

SUBJECT: Code Amendment Request -Firemen's Pension Board Members
At the Firemen's Pension Board meeting yesterday, it was decided that a City Code amendment for
RMC 2-6-2 should be requested in order to allow the Chairman of the Finance Committee to
designate, if desired, another Finance Committee member to serve on the Firemen's Pension Board.
In following through on this matter,I find that RCW 41.16.020, specifically states that the Chairman
of Finance of the City Council must be one of the five Board members. (Copy of the RCW section
is attached.) According to the RCW, if there were no Finance Committee Chairman, then the City
Treasurer would serve in that position.
Councilman Corman, as you know, is Chairman of the Finance Committee this year, and
Councilman Law is a Finance Committee member. Because of the statute, it would appear that a
City Code amendment request would not be in order, and that Councilman Law cannot serve on the
Board in place of Councilman Corman, even at Councilman Corman's request or with Board
approval. Is that correct? If so,I assume the only alternative for the Board is to change its meeting
schedule to accommodate Councilman Corman's schedule so that he can attend and participate in
the monthly Board meetings.
