'� The Grantee shall,upon completion of any work within the property covered by the agreement,restore the surface of tne agreement,and any private improvements disturbed or destroyed during execution of the work,as nearly as practicable to the condition they were in immediately before commencement of the work or entry by the Grantee except where modified by the project plans and specifications. 1. The City may trim the lower branches of the 24"fir tree at the southwest corner of the property as needed for construction access. The 24"fir may need to be removed if the roots are damaged during construction,or if it appear to be unstable. The City will be responsible for all costs for trimming and removing the tree. If the 24"fir is removed the City will replace it with new nursery stock size(6—8 foot)tree of the same species, or of different species as the owner may choose. r .. 2. The set of 12"juniper trees straddling the fence line wiil probably need to be removed for construction. The City will replace it with up to two new nursery stock size(6—8 foot)trees of the same species,or of different species as the owner may choose. The new trees will be planted at least 4 feet from the fence line. This permit shall become effective upon execution by the Grantor from date hereof,and shall continue for two(2)years.
