The Finding of Violation was issued on October 2, 2019. The appeal was received on October 29, 2019.
Per RMC 1-3-2:
2. Appeal Requirements:
a. Timeliness: Any appeal of the Administrator’s decision must be filed and served within fifteen (15) calendar days of the issuance of the decision. An appellate petition or motion
is barred, and the court may not grant review, unless the petition is timely filed with the court and timely served on the City.
This appeal was filed 27 days after the Notice of Violation date, therefor it is not a timely appeal.
Please have the Hearing Examiner dismiss this appeal.
