ANALYSIS: The City has considered the request for a temporary exemption from RMC 4-6-090(C). The proposal would utilize existing poles and attach to the existing aerial path. Ordinance 5845 grants MCImetro Access Transmission Services Corp., the right to construct, remove, replace, repair, and/or restore any Facility, and may include, but are not limited to, digging and/or excavating to construct, remove, replace, repair, and restore pipeline(s) and/or Facilities with the Franchise area. The proposal would utilize existing poles and attach to the existing communication aerial paths. As minimum vertical height clearance of 15’-6” would need to be provided for, and any existing obsolete cable would need to be removed; staff recommends these as conditions of approval.
