Thank you for the explanation. We do not wish to appeal the project and we appreciate you spelling out the City's
intent behind the condition. With regard to the latter portion of the condition—'They shall not be made private with
restricted access by any means'—SECO's intent is to support the public use of the floats,while retaining private control
over the existing docks.
Though we will not be appealing,we will ask that this email chain become part of the permanent project file at the City,
so as to retain our agreement on the meaning of this condition.

Thank you for your request for reconsideration. You may not be aware, but the Department of Ecology does not
authorize reconsiderations through their permit process. Please refer to page 29 of the Shoreline Permit for appeal
opportunities available to the Shoreline Hearing Board. In light of this fact,we are happy to provide you with
clarification of condition#3 as it relates to the City's intent. As you mentioned in your reconsideration request,the
project site includes several existing overwater structures, including the existing wharf along the southwestern boundary
of the project area. It was not the intent of condition#3 to apply to any existing docks or piers only those new floats and
shoreline access points(cove)that were included in this specific shoreline permit application. Furthermore, it is the
City's intent to interpret the second sentence of condition#3 "They shall not be made private with restricted access by
any means"to be read in its entirety,which would require both a conversion of the docks to"private" and the
restriction of access"to the public. It is reasonable to assume that typically maintenance,closures from sunset to
sunrise and inclement weather which could result in unsafe conditions to the public,would be expected, provided the
temporary restrictions were not combined with a conversion of the dock use to private from public.
Please let me know if you have any other questions about the intent of Condition#3 that I could clarify for
you. Otherwise,your appeal opportunity is still available at this time and you are welcome to exercise this right.
