HomeMy WebLinkAboutERC_SEPA_Addendum_LUA09-052_2012DEPARTMENT OF COMMUNITY n city of AND ECONOMIC DEVELOPMENT ADDENDUM TO ENVIRONMENTAL (SEPA) DETERMINATION OF NON -SIGNIFICANCE (DNS-M) = MITIGATED Pursuant to WAC 197-11-600(4)(c) and WAC 197-11-625 Addendum to the Cogger Short and Fleuve de Voiles Plats as Addended by the City of Renton (LUA09-052 and LUA09-016) Determination of Non -Significance - Mitigated (DNS=M) Date of Addendum: July 23, 2012 Date of Original Issuance of SEPA Threshold Determination: November 9, 2006 Proponent: Charles Spaeth Project Numbers: LUA09-052, ECF, PP LUA09-016, SHPL-A Project Names: Fleuve de Voiles Plat and Cogger Short Plat Proposal /Purpose of Addendum: The applicant, Charles Spaeth, received approval fora 39- lot plat (Fleuve de Voiles) from King County Department of Development and Enviromental Services (KC DDES) for Environmental (SEPA) Review and a Preliminary Plat (KC DDES File No. L04P0002). The 6.8 acre parcel is located within the City's Residential - 4 (R-4) dwelling units per acre zoning classification; however, the project is vested to King County's R-6 zoning development regulations. In addition the same applicant received approval for an adjacent eight lot short plat, Cogger or Plat, from KC DDES (LOSS0040)I The Cogger Short Plat is also located within the City's R 4 zoning classification; however, it is also vested to King County's R-6 zoning development regulations. The Cogger Short plat's access is dependent on the Fleuve de Voiles plat improvements and could not be developed without the public and private infrastructure of the larger plat. As a result, KC DDES combined the two applications into one "development" for the purposes of SEPA review. The proposed plat of Fleuve de Voiles has as its sole access a new improvement of the SE 192"d Stand 124th Ave SE intersection. As part of DNS-M, dated November 9, 2006, a mitigation measure was issued, for the "development" requiring the applicant to construct a traffic signal system at this intersection. The mitigation measure currently reads: Addendum to Environmental (SEPA) Review Page 2 of 4 July 23, 2012 1. In order to mitigate the significant adverse impact 114.80.03011 and 14.80.0308) that the proposed development will have at the intersection of SE 192nd St/1241h Ave SE, the applicant will construct a traffic signal system at this intersection. This signalization system will be in general conformance with the conceptual signalization submitted KCDOT on November 8, 2006. This signalization system will be in general conformance with the conceptual signalization exchanged between the Department of Transportation and the Applicant's consultant engineer on/about October 2, 2006, and include all related signalization system appurtenance's necessary for the identified signal operation (including a protected/permitted phasing for the westbound left turn), and an advance warning flasher system located to the west of the intersection. These improvements shall be designed to minimize future reconstruction if/when the deferred/cancelled CIP constructed. Since the time of the two plat approvals, in 2004 and 2005, the intersection annexed into the City of Kent. The Kent Transportation Division has informed the City of Renton that mitigation, in the form of a traffic signal, is not warranted at this intersection based on the significant adverse impacts described in SEPA determination and is ultimately not desired. Appropriate mitigation would include improvements to the north side of 192"d Ave SE to the City of Kent standards, with a stop sign only. It has been determined that the environmental impacts of the proposal were adequately addressed under the analysis of significant impacts contained within the previously adopted DNS-M. However, the mitigation prescribed by KC DDES was not appropriate for addressing the impacts. Based on WAC 197-11-600(4) c, the addendum process may be used if analysis or information is added that does not substantially change the analysis of significant impacts and alternatives in the existing environmental document. The determination by the City of Kent will not change the analysis or impacts in the 1995 State Environmental P011cy Act (SEPA) Review. However, this addendum will modify the single mitigation measure of the DNS-M issued on November 9, 2006 to eliminate the requirement for a traffic signal at the intersection of SE 192"d St and 124th Ave SE and will read: 1. In order to mitigate the significant adverse impact (14.80.030A and 14.80.0308) that the proposed development will have at the intersection of SE 192"d St/124tl' Ave SE, the applicant will construct improvements to the north side of 192"d Ave SE to the City of Kent standards, with the inclusion of a stop sign. The City of Renton is hereby issuing a SEPA Addendum pursuant to WAC 197-11-600. This Addendum is appropriate because it contains only minor information not included in the original Determination and there no environmental impacts related to inclusion of the new information.
