CITYOFRENTON,WASHINGTONORDINANCENO.5961ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,ESTABLISHINGTHELATECOMERASSESSMENTFORTHESUNSETLANENEIMPROVEMENTPROJECT,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,theCityofRenton(“City”)isdividedintoseparatecommunityplanningareas,includingtheSunsetsub-areawithintheRentonHighlands(“SunsetArea”);andWHEREAS,theCityestablishedaSunsetAreacommunityrevitalizationprogramandadoptedtheSunsetAreaCommunityInvestmentStrategyinordertoprioritizeadditionalpublicinvestmentintheSunsetAreaandleveragepublicinvestmentandcreateopportunitiesforaffordablehousing,plusretailinvestment;andWHEREAS,asapartoftheSunsetLateNEImprovementProject(“Project”)theCityhasinstalledcertainutilitysystemsandappurtenancestheretoitelectedtoinstallasaresultofOrdinanceNo.5783,adoptedbytheRentonCityCouncilonFebruary1,2016(“OrdinanceNo.5783”),at,near,orwithinthedescribedpropertyintheSunsetI,theundersignedCityClerkoftheCityofRenton,Washington,certifiesthatthisisatrueandcorrectcopyofOrdinanceNo.__________.SubscribedandsealedthisZ.dayof,2020.1CMC,CityClerk ORDINANCENO.5961AreaandhasconnectedsametotheCity’sutilitysystemsothatsuchimprovementsnowareanintegralpartthereof;andWHEREAS,theownersofrecordoftheBenefitedPropertieslistedinExhibitCreceivedaNoticeofPotentialAssessment,whichwasmailedonMarch29,2016,andnoappealwasfiledwithintwenty(20)daysofthedatethenoticewasmailed;andWHEREAS,theRentonCityCounciladoptedResolutionNo.4289onJune13,2016establishingtheSunsetArealatecomerboundaryareaandlatecomerassessmentmethodology;andWHEREAS,asapartoftheProject,theCityhasinstalledcertainstreetimprovementsandappurtenancestheretoitelectedtoinstallasaresultofOrdinanceNo.5783,whichrequiredtheimprovementsasaprerequisitetofurtherdevelopmentandredevelopmentintheSunsetArea,at,near,orwithinthedescribedproperty;andWHEREAS,nootherpropertyownersorusershavesharedinthecostandexpenseofconstructionofsuchimprovements,andpursuanttotheprovisionsandtermsofChapter35.91RCW(theMunicipalWaterandSewerFacilitiesAct),specificallyRCW35.91.020(Contractswithownersofrealestateforwaterorsewerfacilities—Requirements—Financing—Reimbursementofcosts),andChapter35.72RCW(ContractsforStreet,Road,andHighwayProjects)andRentonMunicipalCode(“RMC”)2 ORDINANCENO.5961chapter9-5(UtilityandStreetLatecomer’sAgreements),theCitywishestorecaptureaportionofitsinvestmentsintheinstallationoftheimprovements;andWHEREAS,theCityhaspaidallthecostsandexpensesfortheinstallationofsaidimprovements;andWHEREAS,theRentonCityCouncilheldfirstreadingofthisordinanceonFebruary24,2020anddirectedstafftosendNoticeofFinalAssessmenttotheownersofrecordoftheBenefitedPropertieslistedinExhibitC;andWHEREAS,theownersofrecordoftheBenefitedPropertieslistedinExhibitCreceivedaNoticeofFinalAssessment,whichwasmailedonFebruary27,2020,andnoappealwasfiledwithintwenty(20)daysofthedatethenoticewasmailed;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheRentonCityCouncilherebyestablishestheassessmentsdescribedherein,torecaptureaportionoftheCity’sinvestmentsintheinstallationoftheProjectimprovements(“LatecomerAssessment”).SECTIONII.AtthetimeofpreliminaryapprovalbytheRentonCityCouncil,theCityhasnotassignedanyrightstocollecttheLatecomerAssessmentdescribedhereintoanyotherparty.3 ORDINANCENO.5961SECTIONIII.TheCityhasinstalledthefollowingdescribedimprovements,towit:A.Water:Approximately2,324feetof12-inchwatermain,andnine(9)firehydrantsandrelatedappurtenances,inSunsetLaneNE,NE10thStreet,GlennwoodAvenueNE,andinHarringtonAvenueNE;B.Sewer:Approximately1,713feetof12-inchsewermain,andallappurtenances,inSunsetLaneNEandNE10thStreet;andC.Transportation(StreetImprovements):Approximately2,000linearfeetoftwo-laneroadway,2,200linearfeetofsidewalk,3,400linearfeetofcurb/gutter,togetherwithadrainagesystem,streetlightsandrelocating/undergroundingpower/naturalgas/cableTV/telephoneservicesinSunsetLaneNE,NE10thStreetandHarringtonAvenueNE;andsuchinstallationmadeaccordingtoplansandspecificationsapprovedbytheCityofRentonCommunityandEconomicDevelopmentandPublicWorksDepartments,madeinfullcompliancewiththeCity’sobligationsunderthisordinance,andallapplicablecodesandregulationsoftheCityofRenton.Saidimprovementsarefitfortheuseforwhichtheyareintended.4 ORDINANCENO.5961SECTIONIV.Allexpensesandclaimsinconnectionwiththeconstructionandinstallationoftheimprovements,whetherforlaborormaterialsorboth,havebeenpaidinfull,allattheCity’sexpense.SECTIONV.ThelegaldescriptionsoftheBenefitedPropertieswhichcomprisethelatecomerboundaryarea(“BenefitedProperty”)areattachedheretoasExhibitA.Themapsshowingthelatecomerboundaryforthewater,sewer,andtransportationportions,respectively,areattachedheretoasExhibits81,82,and63.TheCombinedFinalAssessmentRolldetailingtheBenefitedProperties’legaldescriptionsandtheamountoftheassessmentforeachpropertyisattachedheretoasExhibitC.SECTIONVI.CostsofConstruction:A.Thetotalcostofthewaterportionofsaidutilitysystemsconstructionashereinabovespecifiedis$464,551.95;andB.Thetotalcostofthesewerportionofsaidutilitysystemsconstructionashereinabovespecifiedis$429,868.77;andC.Thetotalcostofthetransportation/streetimprovementsconstructionashereinabovespecifiedis$5,293,871.25.SECTIONVII.WaterPortionofUtilitySystemsConstruction:A.CostandProRataReimbursement:Thetotalamountofthecostofthewaterportionofsaidutilitysystemsconstructionshallbeemployedtodeterminetheprorata5 ORDINANCENO.5961reimbursementtotheCitybyanyownerofrealestatewhodidnotcontributetotheoriginalcostofsuchimprovement,andtriggerstheassessmentasspecifiedinsubsectionVll.B,below,allsubjecttothelawsandordinancesoftheCityofRentonandtheprovisionsofthisordinance:Totalcostassociatedwiththewaterportion$464,551.95oftheutilitysystemsconstruction:Themethodofassessmenttobeused:PerlinearfootTheaffectedBenefitedProperties:Parcels#1,2,3,4,5,7,8,9,10,11,12,13,14and15Theproratacostperfront-foot:$132.02112Thetotalassessablefront-footage:3,518.77linearfeetTheportiontheCityhaspreviouslypaid:$166,994.83(forParcel#1)Theportionofthetotalcostthatmaybe$297,557.12reimbursedtotheCity:B.CriteriaforTriggeringofWaterportionofLatecomerAssessment:TheLatecomerAssessmentestablishedbythisordinancerelatedtothewaterportionoftheutilitysystemsconstructionwillbetriggeredwhenaBenefitedPropertywithinthelatecomerboundaryareathatisreceivingwaterservicefromtheexistingwatermainsisdevelopedand/orredeveloped,suchthatthedevelopmentand/orredevelopmentofthepropertyrequiresfireflowdemandwhichexceeds1,500gallonsperminute(which6 ORDINANCENO.5961B.CriteriaforTriggeringofStreetportionofLatecomerAssessment:Theassessmentestablishedbythisordinancerelatedtothestreetimprovementconstructionwillbetriggeredwhenapropertywithinthelatecomerboundaryareaisdevelopedand/orredeveloped,suchthatthedevelopmentand/orredevelopmentofthepropertygeneratesnewweekdaytrips.TheBenefitedPropertiesmaybesoldorchangehandswithoutactivatingtheassessment.C.Paymentisdue:1.Priortotheissuanceofabuildingpermit;or2.PursuanttoarestrictivecovenantoragreementwiththeCityofRenton;however,inallcasespriortotheissuanceofacertificateofoccupancy(eithertemporaryorfinal).SECTIONX.Itisherebyfoundanddeterminedthattheconstructionandinstallationofsaidutilitysystemsandstreetimprovementsareinthepublicinterest.SECTIONXl.TheCityreservestheright,withoutaffectingthevalidityortermsofthisordinance,tomakeorcausetobemadeextensionstooradditionsoftheaboveimprovementsandtoallowserviceconnectionstobemadetosaidextensionsoradditions,withoutliabilityonthepartoftheCity.SECTIONXII.TheLatecomerAssessmentestablishedbythisordinance,asitpertainstothewaterandsewerutilityconstructionlatecomerassessments,andthe10 ORDINANCENO.5961assessmentsdescribedherein,shallbevalidforaperiodoftwenty(20)years,unlesstheCityCouncilagreestoextenditortheassessmentsinaccordancewithRCW35.91.020(4)asitexistsorishereinafteramended.SECTIONXIII.TheLatecomerAssessmentestablishedbythisordinance,asitpertainstothestreetimprovementconstructionlatecomerassessments,andtheassessmentsdescribedherein,willremainvalidforaperiodoffifteen(15)years,unlesstheCityCouncilagreestoextenditortheassessmentsinaccordancewithRCW35.72.020(2)asitexistsorishereinafteramended.SECTIONXIV.ThedecisionoftheAdministratorofthePublicWorksDepartmentorhis/herauthorizedrepresentativeindeterminingorcomputingtheamountduefromanybenefitedownerwhotriggersanylatecomerassessmenthereundershallbefinalandconclusiveinallrespects.SECTIONXV.ThisordinanceshallbeplacedforrecordwiththeKingCountyRecorder’sOfficewithinthirty(30)daysofpassage,approval,andpublicationofthisordinance,attheCity’ssolecost.SECTIONXVI.TheCitymaycollectanadministrationandcollectionfeefromitsutilityenterprisefundsatthetimeanyLatecomerAssessmentrelatedtothewaterorsewerportionsofconstructioniscollected.Theamountofthefeemaybeapercentagebaseduponthefollowing:11 ORDINANCENO.5961A.litheportionoftotalcostthatmaybereimbursedis$20,000orless,theCitywillretainafeeequaltofifteenpercent(15%)ofeachamountcollected.B.litheportionoftotalcostthatmaybereimbursedismorethan$20,000butnotmorethan$100,000,theCitywillretainafeeequaltotenpercent(10%)ofeachamountcollected.C.litheportionoftotalcostthatmaybereimbursedismorethan$100,000,theCitywillretainafeeequaltofivepercent(5%)ofeachamountcollected.SECTIONXVII.Thisordinance,whenrecordedwithKingCounty,willbeamatterofpublicrecordandwillserveasanoticetotheownersoftheBenefitedPropertiesshouldanylatecomerassessmentbetriggered.TheassessmentrolllistingtheBenefitedPropertiesandtheproratapotentiallatecomerassessmentforeachwillbeonfilewiththeCityorRenton.SECTIONXVIII.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONXIX.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaperandrecording12
