The 5.07-acre site is zoned Urban Center (UC) and is within the Urban Design District C overlay district. The single-sided signs include a white background with the SECO company logo and text that reads “SECO Development, Inc.” The signs would be printed on reflective material and mounted to 1/8” di-bond on 4x4 wooden posts. The dimensions of each sign face would be 48” wide by 24” tall (8 square feet) and the overall height of the proposed temporary signs would be six feet (6’) tall. One sign would face Park Ave N and the second sign would face N 8th St. The parcel contains high seismic hazards and the southern portion of the property is located within the Downtown Wellhead Protection Area Zone 2. FINDINGS OF FACT (FOF): 1. The Planning Division of the City of Renton accepted the above master application for review on March 10, 2020 and determined the application complete on March 11, 2020. The project complies with the 120- day review period. 2. The project site is located at the Southeast corner of Park Ave N and N 8th St (APN 0886610070). 3. The project site is currently developed as a temporary parking lot (File No. LUA14-000155, TP). 4. Access to the site is provided via Park Ave N and Garden Ave N. 5. The property is located within the Commercial & Mixed Use (CMU) Comprehensive Plan land use designation. 6. The site is located within the Urban Center (UC) zoning classification and within Urban Design District ‘C’. 7. The site is mapped with high seismic hazards and the southern portion of the property is located within the Downtown Wellhead Protection Area Zone 2. 8. No trees would be removed during sign installation. 9. Staff received no public comments. F. ANALYSIS: The applicant is requesting a Tier 2 Temporary Use Permit pursuant to Renton Municipal Code Section 4 -9-240 to install two (2) temporary signs on the 5.07-acre parcel located at the southeast corner of Park Ave N and N 8th St (APN 0886610070). The applicant is proposing two (2) single-sided signs with the SECO company logo and text that reads “SECO Development, Inc” over a white background. One sign would face Park Ave N and the second sign would face N 8th St (Exhibit 2). The signs would be printed on reflective material and mounted to 1/8” di-bond on 4x4 wooden posts. The dimensions of each sign face would be 48” wide by 24” tall (8 square feet) and the overall height of the proposed temporary signs would be six feet (6’) in height (Exhibit 3). The maximum height of a freestanding sign in the urban design area is five feet (5’) above finished grade, including the support structure (RMC 4-4-100.G.6). To maintain consistency with allowed permanent freestanding ground-related monument signs in the urban design areas, and as a condition of approval, the temporary freestanding ground-related monument signs shall be limited to five feet (5') above finished grade, including the support structure. In addition, to better integrate the posts into the design of the sign and more fully comply with the general requirements of sign code, the applicant shall paint the support structure (4x4 wooden posts) white to match the background color of the temporary sign. G. DECISION: The LI-C8 Signs, File No. LUA20-000067, TP, as depicted in Exhibit 3, is approved and is subject to the following conditions: 1. The height of the temporary freestanding ground-related monument signs shall be limited to five feet (5') above finished grade, including the support structure. 2. The applicant shall paint the support structure (4x4 wooden posts) white to match the background color of the temporary sign. LAND USE ACTION APPEALS, REQUEST FOR RECONSIDERATION, & EXPIRATION: The administrative land use decision will become final if the decision is not appealed within 14 days of the decision date. APPEAL: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on April 14, 2020. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680), together with the required fee to the Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. RMC 4-8-110.B governs appeals to the Hearing Examiner and additional information regarding the appeal process may be obtained from the City Clerk’s Office, (425) 430-6510. EXPIRATION: The Temporary Use Permit is valid for up to one year from the effective date of the permit, unless the Community & Economic Development Administrator or designee establishes a shorter time frame or an applicant can request that a permit be valid beyond the one year expiation, for up to five years at the time of application or prior to permit expiration. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator. RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. THE APPEARANCE OF FAIRNESS DOCTRINE: provides that no ex parte (private one-on-one) communications may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing through the Hearing Examiner. All communications are public record and this permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence in writing. Any violation of this doctrine could result in the invalidation of the appeal by the Court.
