HomeMy WebLinkAboutAdden 1AMENDMENT NO. 1 TO AGREEMENT FOR LOOP PUBLIC ART DESIGN & INSTALLATION IN DOWNTOWN RENTON THIS AMENDMENT, dated March 27, 2020, is by and between the City of Renton (the “City”), a Washington municipal corporation, and Western Neon, Inc. (“Artist” or “Western Neon” or “Seller”), a Washington State corporation. The City and the Artist are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Artist under Agreement CAG-19-244, dated August 19, 2019, to provide necessary services for the design, fabrication, permitting and installation of public art for downtown Renton (referred to herein as the “Agreement”); and Whereas, the Parties wish to amend the Agreement to change the time for performance; and Whereas, the design concept has been modified and the Parties agree that it is in the interest of both parties to confirm the design concept change; and Whereas, accordingly, the Parties wish to amend the Agreement as set forth below including adding Exhibit A-1 (the final design). NOW THEREFORE, It is mutually agreed upon that CAG-19-244 is amended as follows: 1.Time of Performance : Section 3, Time of Performance, is amended such that all work shall be performed by no later than July 31, 2020. 2.Attached Exhibit A-1 (the final design) hereby replaces the design as originally depicted in Exhibit A. All prior references in the Agreement to Exhibit A and the Exhibit A design are hereinafter intended to apply to the design concept reflected in Exhibit A-1. 3.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein.
