5967CITYOFRENTON,WASHINGTONORDINANCENO.5967ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,DECLARINGAMORATORIUMONLANDUSEAPPLICATIONSFORLARGERESIDENTIALPROJECTS(150DWELLINGUNITSORMOREINAPROJECT)WITHINTHESUNSETAREA;DECLARINGAMORATORIUMONAPPLICATIONSFORWAIVEDFEESFORLARGERESIDENTIALPROJECTS;SETTINGFORTHFINDINGSOFFACTINSUPPORTOFSAIDMORATORIUMS;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,anylanduseactioninvolvingaprojectof150dwellingunitsormote(hereinafter“LargeResidentialProject”)isalargeprojectfortheCityofRenton,exceedingthescopeandscaleoftheCity’stypicallanduseprojectsandpotentiallyhavingsubstantialimpactinthevicinityofsuchprojectsandontheCitygenerally;andWHEREAS,theCity’sCommunityandEconomicDevelopmentDepartment(CED)regularlyundertakesworkprogramstoproposeamendmentstoTitleIVoftheRentonMunicipalCode(RMC),andseveralofCED’scurrentworkprogramswillapplytoLargeResidentialProjects,aimedatimprovingtheintegrationofLargeResidentialProjectsintotheirvicinityandtheCitygenerally;andWHEREAS,onesuchCEDworkprogramthatwillapplytoLargeResidentialProjectsistheworkprogramtoamendRMCTitleIV’sprocessandscopefor“modifications”tolanduseentitlementsandstandards,includingmajorandminormodificationstomasterplansandsiteplans.ThismodificationsworkprogramwasintroducedtotheCity’sPlanningCommissionpriortothedeclarationofemergencyrelatingtoCOVID-19,buttheworkprogramisnowdelayedduetotheemergency.ItisintheCity’sbestinterestandbeneficialtoitsresidentsthattheworkprogramprocessbedeferreduntilsuchtimethatitcanbeallowedtoreturntothePlanning1 ORDINANCENO.5967CommissionforpublicheatinganddeliberationandsubsequentlyforreferraltotheCityCouncil,anditisfurtherinthebestinterestoftheCityanditsresidentstoimposeamoratoriumonallmodificationapplicationsandallotherlanduseapplicationsrelatingtoLargeResidentialProjectsuntilthisworkprogramisadvancingagain;andWHEREAS,theCityhasinvestedasignificantamountofpublicmoneyininfrastructureimprovementsintheSunsetAreainanefforttostimulateprivateinvestmentinnewmarketratehousing,andLargeResidentialProjectsareofparticularinterestintheSunsetArea;andWHEREAS,intheSunsetArea,theCityhasrecognizedtheneedforhousingthatisaffordabletoincomelevelsbelowtheAreaMedianIncomebutfindsthatitisbothprudentandintheresidents’andCity’sbestinteresttobalancethedistributionofaffordableandmarketratehousing,includingbalancingsuchdistributionwithinLargeResidentialProjects;andWHEREAS,theCityseeksadequatetimetoreviewthebestpracticesthatsupportthedevelopmentofhousingopportunitiesforawidevarietyofincomesand,ifdesired,accordinglyupdateapplicableprovisionsoftheRentonMunicipalCode,includingprovisionsapplicabletoLargeResidentialProjectswithintheSunsetArea;andWHEREAS,theCityhassupportedwaivingfeesforeligibleprojectspursuanttotheprovisionsofRMC4-1-210;however,thesignificantandpotentiallydetrimentaleffectsofwaivingfeesforLargeResidentialProjectshasnotbeenevaluated;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedforamoratoriumonacceptinganylanduseapplication(includingbutnotlimitedtoapplicationsforpreliminaryplats,siteplans,masterplans,conditionalusepermits,majormodifications,andminormodifications)involvingaLargeResidentialProjectwithinallzoningdistrictswithintheSunsetAreawhichare2 ORDINANCENO.5967asfollows:CenterVillage(CV)Zone;Residential-14(R-14)Zone;andResidentialMulti-Family(RMF)Zone;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedforamoratoriumonacceptinganyapplicationsforwaivedfees(RMC4-1-210)forLargeResidentialProjectsuntiltheCityhashadanopportunitytoevaluatetheeffectsofwaivingfeesforLargeResidentialProjects;andWHEREAS,theCityCouncilfindsthatthesubjectofthisordinancecomplieswiththeGovernor’sProclamation20-28relatingtomeetingsduringtheCOVID-19crisisbecausethemattersatissuearenecessary;becausethemattersrelatetotheroutineworkofCEDinmonitoringandrespondingtodevelopmenttrendsintheCity;andbecauseCOVID-19stayhomeproclamationsslowtheCity’sabilitytoamenditsdevelopmentregulationsbecausefullpublicparticipationisnotpossibleuntilthestayhomeproclamationsarelifted;andWHEREAS,theCityCouncilwillholdapublichearingwithinsixty(60)daysofthepassageofthisordinance;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportofthemoratoriumsadoptedhereinpursuanttoRCW35A.63.220andRCW36.JOA.390,andarefoundtobetrueandcorrectinallrespects.SECTIONILTheCityCouncilherebydeclaresamoratoriumuponthesubmissionoracceptanceofanylanduseapplication(includingbutnotlimitedtoapplicationsforpreliminaryplats,siteplans,masterplans,conditionalusepermits,majormodifications,andminor3 ORDINANCENO.5967modifications)involvingaLargeResidentialProject(asdefinedabove)withinthefollowingzones:CenterVillage(CV)zone;Residential-14fR-14)Zone;andResidentialMulti-Family(RMF)ZoneiflocatedwithintheSunsetAreawhichisdefinedforthepurposesofthismoratoriumasitisdefinedinRMC4-1-220.B.11(thegeographicalareadepictedintheEligibleAreasforMultiFamilyHousingIncentivesMap,theoriginalversionofwhichwasadoptedasAttachmentAtoOrdinanceNo.5760);andSECTIONIII.TheCityCouncilalsoherebydeclaresamoratoriumonthesubmission,acceptance,processingorapprovalofanyapplicationsforWaivedFees(RMC4-1-210)forLargeResidentialProjects.SECTIONIV.ThemoratoriumsimposedhereinshallbeineffectuntilOctober6,2020,unlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw.SECTIONV.Apublichearingwillbescheduledandheldwithinsixty(60)daysofthepassageofthisordinance.SECTIONVI.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVII.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.4
