It has come to my attention that an additional item is needed in order to accept your application and begin formal review. That is, the owner of the property where the facilities are proposed must sign the Land Use Permit Master Application Form. Since the City of Renton is the owner of the right-of-way, a franchise is the normal and customary means by which the City grants permission for utilities or facilities to be located in the right-of-way. Previous correspondence (enclosed) from the City to Ben R. Johnson dated March 25, 2016 states that a franchise agreement must be negotiated with the City of Renton before any work can proceed; and, Mobilitie could pursue the Conditional Use Permit while negotiating a franchise with the City. In addition, in email correspondence (enclosed) dated August 4, 2016 between from you to W. Scott Snyder, Jill Ding, and Alex Tuttle, you acknowledged that "...al1 parties understand that no permits will be issued prior to finalization of a franchise agreement." The Master Use/Franchise Utility Permit Application was received by City of Renton on February 8, 2016. The application requests that Mobilitie be permitted to install four new wood poles as follows: • 9WAB000008 (SE90XS012) — near 40143`d Street • 9WAB000553 (SE90XS190) -- near 4100 East Valley Road • 9WAB000560 (SE90XS197) —near 7211 S 135th Street (2101 SW Sunset Blvd) a 9WAB000564 (SE90XS201) — near 3933 NE 4th Street. Subsequently, you communicated with our staff member (Holly Powers) that you wished to withdraw two of the permits 9WAB000553 (SE90XS190) — near 4100 East Valley Road, and 9WA6000560 (SE90XS197) — near 7211 S 135th Street (2101 SW Sunset Blvd). Therefore, we understand that your current request is to install a new wood utifity pole that is 46 feet in height for 9WAB000008 (SE90XS012) — near 40143`d Street (generally Talbot Road South and Carr Road), and another new wood utility pole that is 60 feet in height for 9WAB000564 (SE90XS201) — near 3922 NE 4th Street. Your letter states that Mobilitie should be exempt from zoning, conditional use permit, and special permits due to its Washington Utility Pole Authority certificated status, and the Mobilitie should be treated equally as other utility companies, such as electric, cable and landline telephone companies. We certainly respect and understand your need to confer and counsel your client. As a point of information, the meeting that I have scheduled with Ms. Ding is an application submittal meeting. Our understanding of the purpose of this meeting is to confirm that our conditional use land -use permit applications are complete and include all of the submittal materials, explicitly published and outlined, as well as those specifically discussed at our pre -application meeting, in order for the city to accept our applications. Staff has indicated that permit review can proceed concurrently with the agreement process, and all parties understand that no permits will be issued prior to finalization of a franchise agreement. Certainly, if these two processes run concurrently, all parties are benefited by the efficient use of time and resources. Please advise us on the City's determination regarding the permitting process after conferring with your clients at your very earliest convenience. Until then, we will cancel our currently scheduled permit application meeting set for today at 1PM.
