RE: Liberty Ridge L.L.C.'s Request That the City Council Authorize and Arrange for an
Annexation Election Pursuant to Either RCW 35A.14.015 or RCW 35A.14.020 to
Annex to the City the"Tydico Site" and Adjacent Existing Street Right-of-Way
Dear Council Members:
I am writing on behalf of my client Liberty Ridge L.L.C. (a Gary Merlino and Don
Merlino family company) to request that the City Council authorize and arrange for an
annexation election pursuant to either RCW 35A.14.015 or RCW 35A.14.020 to annex to the
City the"Tydico Site"and existing street right-of-way that is adjacent to it. (See the attached
map of the"Proposed Tydico Site Annexation Area".) As a part of a real estate exchange
transaction,Liberty Ridge L.L.C.is in the process of acquiring the Tydico Site and will be its
owner by the end of this year. (Title to the property is cunently held by an exchange
facilitator entity named 5050 First Avenue, LLC.) Let me provide you with background
information concerning the annexation election request,background information concerning
the subject property,and an explanation of what the Merlinos have in mind for development
of the property.
Back�round Information Concernin�
the Annexation Election Request
Two people currently reside on the subj ect property,one who is a registered voter(a
Mr. Frank J. Ribera) and one whom I understand is registering to vote today(a Mr. Todd
Flanagan). Pursuant to RCW 35A.14.020, Mr. Ribera has today signed a"Petition to the

Renton City Council Calling For An Annexation Election". As that statutory provision
directs,the original of that Petition has today been filed with the King County Auditor and a
" copies of the Petition has been filed today with the Renton City Council in care of the Renton
City Clerk and with the Council's office. (A copy of the petition is,also herewith attached.)
Note that RCW 35A.14.020 provides that"[t]he auditor. . . shall examine the petition, and
the auditor . . . shall certify the sufficiency of the petition to the legislative authority of the
code city." It then goes on to provide that"[i]f the signatures on the petition are certified as
containing sufficient valid signatures, the city legislative authority shall, by resolution
entered within sixty days thereafter,notify the petitioners. . .of its approval or rejection of
the proposed action." (Emphasis added.)
Rather than wait for the King County Auditor to certify the sufficiency of Mr.
Ribera's Petition,in order to expedite the election Liberly Ridge L.L.C.hereby requests that
the City Council pass a resolution pursuant to RCW 35A.14.015 providing for an annexation
election.
Back�round Information Concernin�
the Subiect Property
The subject property abuts the Renton City limits on three sides (north, west and
south). The property to the north of it is designated and zoned Center Suburban(CS). The
property to the west is designated Residential Options (RO) on the City's Comprehensive
Plan Land Use Map and is zoned R-10. The properties to the east and south are all
designated Residential Single Family(RS)on the City's Comprehensive Plan Land Use Map.
Portions of the site have been used over the years for construction company yards and
offices. A construction company called Tydico is currently a tenant on the subject property.
The King County Hearing Examiner has determined that various nonconforming use rights
exist with respect to the property. Property owners to the south have expressed to both King
County and the City of Renton concerns over Tydico's operations.
What The Merlinos Have In Mind
For Development of the Site
The Merlinos are interested in having the subject property annexed into the City so
that a single-family detached residential subdivision of the site can be developed within the
City during the spring and summer of 2004. In view of the time that it will take to get to and
through an annexation election process and a subsequent preliminary plat process, it is
critical to the Merlinos that the election be scheduled as soon as possible. Subdivision
development of the site will end the construction company use of the site and be a benefit to
all of the abutting properties.

PETITION TO THE RENTON CITY COUNCIL CALLING �
FOR AN ANNEXATION ELECTION
Pursuant to RCW 35A.14.020, the undersigned (the "Petitioner") hereby calls
upon the City Council of the City of Renton, a Washington municipal corporation (the
. "Cit}�'), which is a code city, to authorize and arrange for an election to vote upon the
annexation to the City of that certain portion of unincorporated King County,Washington
_ the boundaries of which circumscribe the property that is legally-described on Exhibit A
atfached hereto and all existing street rights-of-way adjacent thereto (the "Proposed
Tydico Site Annexation Area"). A map of the Proposed Tydico Site Annexation Area
and surrounding properties is attached hereto as Exhibit B. The Proposed Tydico Site
Annexation Area is contiguous to the City.
I am one of not more than two registered voters currently residing within the
Proposed Annexation Area.
