Is there a specific form required to submit for an appeal to a LLC? If so would you please provide. As the City of Renton is currently closed I will submit this as the formal appeal and should additional information or forms be required I will do so immediately upon receipt or notice from the City of Renton and ask that the 14 day appeal deadline be flexible as to the fact your offices and staff are not physically present. The principals of acceptability that the findings were based on in this decision have several facts that are not accurate or most certainly are debatable based on the definitions. 1) CORRECTING Based on past communication with the City of Renton they will not allow the upper portion of land for parcels 1 & 2 to to be developed into new single family residences. As such they have effectively eliminated the practical use of said potion of land. By not being able to build on the upper portion of land as there is no access there is a substantial risk associated with not being able to monitor the activity on said land with a 60'+ high cliff wall. This poses risk to the public if and when people access this land. The City asserts that the proposed lot design is not an improvement as lot 3 would go from 5 to 11 corners is negates the fact that by doing so it eliminates two lots that have no access to limited use of their land due to topography and the restrictions being placed on the land by the city of renton. I would assert that a vertical cliff divide is more irregular than the proposed solution. The proposed solution would also allow for more direct access and visibility to said land to ensure public safety. Additionally please note that the property located two lots away has 8 property corners (312 Seneca). 2) IMPROVING See notes above pertaining to public safety. Additionally the current configuration of land does not allow for visibility as to whom is using or encroaching on said property resulting in loss of use. 3) APPROVAL CRITERIA 2 Subsections a, b, and d are clearly met however c again is a matter of safety and interpretation as a cliff wall in between a parcel is most certainly more irregular than multiple corners on lots as can be evidenced by searching for any other lots in The City of Renton with similar conditions. Certainly there are far more lots with excessive corners. 117 NW 6th St, 601 Rainier Ave, 801 Rainier Ave are just a few examples within a short radius. 4) NON EVASIVE This LLU action would not create any scenario that would circumvent any agency receivables or code section. There is no way to show that this LLU is not in compliance with this section therefore it should be compliant. I request that the proposed LLU be reconsidered to accurately account for the topographical conditions and reconsider what is more irregular, a lot with more than 5 corners which there are likely hundreds of examples of or a lot delineated by a cliff that presents hazards and the inability to monitor said lot frequently due to other restriction set forth by current City code. Lastly a portion of the LLA did not appear to receive any comment. The East/ West property line between lots one and two is proposed to be moved north so as to create a buildable pad for lot 2. Alternatively a proposed house would have to be built into the hillside containing steep slopes and which is composed of solid rock. Should for some unforeseen reason the LLU not be approved in its entity I request the portion of the LLU moving the shared property line between lots 1 and 2 to the North be approved. Example attached, please ignore the "lot 3 annotation". Should this be the final direction I will have the surveyor update the map to reflect only the revision of the one lot line.
