The GRANTOR, ALPINE ONE, LLC, a Washington limited liability company, in
consideration of the MUTUAL BENEFITS derived, conveys and grants unto the CITY OF
RENTON, a Washington municipal corporation, CITY, and its assigns, GRANTEE,under the
imminent threat of the Grantee's exercise of its rights of Eminent Domain, a permanent
nonexclusive easement over, under, upon, through and across the hereinafter described lands
for the purpose of installing, constructing, repairing and maintaining a sidewalk associated
with the Williams Avenue and Wells Avenue S Conversion Project("Project");
Said lands being situated in King County, State of Washington, and described as
follows:
PER EXHIBIT A AND AS DEPICTED IN EXHIBIT B
ATTACHED HERETO AND INCORPORATED BY REFERENCE
1. General Provisions. This easement is granted and accepted subject to the following
conditions:
1.1 That, in constructing the aforesaid improvements, the City shall do no
unnecessary injury to any trees, shrubs, lawns, buildings, fences, or
appurtenances within the property; and shall restore the surface of the ground to

the same condition in which it was before the start of the improvements as near
as such restoration can be made;
1.2 That, upon completion of any repair or maintenance work, the City shall leave
the premises substantially the same as it was on the day work commenced;
1.3 That the City shall indemnify,defend and hold harmless Grantor from any claim
or damage which might arise as a result of the work performed;
1.4 That the Grantor shall not obstruct the easement premises in any manner that
will prevent or interfere with the use of the easement for the purposes identified
herein, or allow any third party to obstruct the premises in a manner that will
prevent or interfere with use of the easement for the purposes identified here.
1.5 The Grantor acknowledges that the property rights herein conveyed for this
Sidewalk Easement are a donation to the City of Renton. Grantor's donation
is made voluntarily and with full knowledge of Grantor's entitlement to
receive just compensation therefore. Grantor hereby waives the City's
requirement of obtaining an appraisal for the acquired property rights.
It is understood and agreed that delivery of this easement is hereby tendered and that
the terms and obligations hereof shall not become binding upon the City unless and until
accepted and approved hereon in writing for the City ,by its authorized agent.
