The City of Renton had a due process right to have a reasonable amount of time to respond to a summary judgment motion. The hearing on 6/23/20 will be held as scheduled. Therefore, Mr. Sucius was denied his Constitutional Procedural due process to file a motion for summary judgment under CR 56, which requires summary judgment motions to be filed 28 days in advance of the appeal hearing. Mr. Suciu has less than 25 days. Therefore, Mr. Suicu respectfully requests that the Hearing Examiner sustain the appeal. Also, Mr. Suicu respectfully requests that the Hearing Examiner overturn the violations and dismiss the fines in the interest of justice.
