4411CITY’OFRENTON,WASHINGTONRESOLUTIONNO.4411APUBLICHEALTHEMERGENCYRESOLUTIONOFTHECITYOFRENTON,WASHINGTON,ESTABLISHINGAFUNDINGPROGRAMANDIMPLEMENTATIONPLANFORTHECITYOFRENTON’SCARESACTRELIEFFUNDS.WHEREAS,duetotheCOVID-19publichealthemergency,theU.S.CongresspassedtheCoronavirusAid,Relief,andEconomicSecurity(CARES)Act,PublicLaw116-136(“CARESAct”),whichprovidesfundingtoassistindividuals,businesses,andgovernmentsinrespondingtoCOVID-19;thesefundsareadministeredbytheU.S.TreasuryDepartment;andWHEREAS,theU.S.TreasuryDepartmenthasprovidedsix(6)categoriesofprimaryallowableexpensecategoriesforCARESActfunds:medical;publichealth;payroll;COVID-19publichealthcompliancemeasures;smallbusinesseconomicsupport;andotherexpensesnecessarytothefunctionofgovernment;andWHEREAS,forWashingtoncitiesunder500,000inpopulationsuchasRenton,CARESActfundsaredistributedviatheStateofWashingtonwhichhasawardedtheCityofRenton$3,141,000infundingbasedonitspopulation;andWHEREAS,theCityCouncildesirestoestablishafundingprogramandimplementationplanthatutilizestheCity’sCARESActfundsforCity-directexpenses;asmallbusinesssupportprogram;andarentalassistanceandhumanservicessupportprogram;andWHEREAS,inordertoreceivetheCARESActfundsallocatedtotheCity,theMayorandCityClerkmustenterintoaninteragencyagreementwiththeStateofWashingtonDepartmentofCommerce;and1 RESOLUTIONNO.4411WHEREAS,theCityandtheStateofWashingtonDepartmentofCommerceareauthorized,pursuanttoRCWChapter39.34,theInterlocalCooperationAct,toenterintosuchinteragencyagreement;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DORESOLVEASFOLLOWS:SECTIONI.EstablishmentofaFundingProgramKnownastheCityofRentonCARESActReliefFundProgram.TheMayorordesigneeisdirectedtoestablishafundingprogramentitledthe“CARESActReliefFundProgram”inanamountequaltothe$3,141,000tobedistributedtotheCityofRentonbyWashingtonStateinCARESActrelieffundinganddenoteassuchintheaccountingrecordsoftheCity.Thesefundsshallbeallocatedandutilizedtosupportthefollowingprogramsherebyauthorized:1.City-DirectCOVID-19ResponseProgram;2.SmallBusinessSupportProgram;and3.RentalAssistanceandHumanServicesSupportProgram.SECTIONII.ImplementationPlan.A.TheCity’sCARESActrelieffundsshallbeutilizedforexpendituresthroughOctober31,2020(unlessanotherdateisestablished)thatareallowedpursuanttotheCARESActandguidanceissuedbytheU.S.TreasuryDepartment.B.TheCityCouncilauthorizestheMayorordesigneetoexecuteanyandallagreementsandrelateddocumentationnecessarytoreceivefullandcompletereimbursementoftheCity’sallowableCARESActfundexpendituresdistributedunderitsCARESActReliefFundProgram,includingbutnotlimitedtoaninteragencyagreementwiththeStateofWashington2 RESOLUTIONNO.4411DepartmentofCommerceregardingtheCoronavirusReliefFundforLocalGovernmentsattachedheretoasExhibit“A”andincorporatedbythisreference(the“InteragencyAgreement”).C.TheCityCouncilauthorizestheMayorordesigneetonegotiateandexecuteanyandallcontractsand/orpurchaseorderswiththird-partyvendors,organizations,andotherpersonsandentitiestodistributetheCity’sCARESActrelieffundsasprovidedforinthisResolution.D.IncompliancewithCARESActrequirementsandtheInteragencyAgreement,theMayorordesigneeisdirectedtodevelop,implement,andoperatetheCity-DirectCOVID-19ResponseProgramforreimbursementofeligibleCityexpenditures.E.IncompliancewithCARESActrequirementsandtheInteragencyAgreement,theMayorordesigneeisdirectedtodevelopanapplicationprocessfortheSmallBusinessSupportProgram,includingestablishingeligibilitycriteria,andtoimplementandoperatetheSmallBusinessSupportProgram.Allsuchactionsmaybeperformeddirectlyorthroughoneormorethird-partycontractors.E.IncompliancewithCARESActrequirementsandtheInteragencyAgreement,theMayorordesigneeisdirectedtodevelopafundingdistributionmethodologyfortheRentalAssistanceandHumanServicesSupportProgram,includingestablishingeligibilitycriteria,andtoimplementandoperatetheRentalAssistanceandHumanServicesSupportProgram.Allsuchactionsmaybeperformeddirectlyorthroughoneormorethird-partycontractors.SECTIONIII.Communication.TheMayorordesigneeshallimplementacommunicationsplantobroadlydisseminatetheavailabilityofCARESActrelieffundstoCityofRentonbusinesses,humanservicesproviders,andanyotherpotentialfunding-eligibleentities.3 GENERALTERMSANDCONDITIONSINTERAGENCYAGREEMENTFEDERALFUNDS1.DEFINITIONSAsusedthroughoutthisContract,thefollowingtermsshallhavethemeaningsetforthbelow:A.“AuthorizedRepresentative”shallmeantheDirectorand/orthedesigneeauthorizedinwritingtoactontheDirector’sbehalf.B.‘COMMERCE”shallmeantheDepartmentofCommerce.C.“Contract”or“Agreement”meanstheentirewrittenagreementbetweenCOMMERCEandtheContractor,includinganyattachments,documents,ormaterialsincorporatedbyreference.E-mailorfacsimiletransmissionofasignedcopyofthiscontractshallbethesameasdeliveryofanoriginal.D.“Contractor”shallmeantheentityidentifiedonthefacesheetperformingservice(s)underthisContract,andshallincludeallemployeesandagentsoftheContractor.E.“PersonalInformation”shallmeaninformationidentifiabletoanyperson,including,butnotlimitedto,informationthatrelatestoaperson’sname,health,finances,education,business,useorreceiptofgovernmentalservicesorotheractivities,addresses,telephonenumbers,socialsecuritynumbers,driverlicensenumbers,otheridentifyingnumbers,andanyfinancialidentifiers.F.“State”shallmeanthestateofWashington.G.“Subcontractor”shallmeanonenotintheemploymentoftheContractor,whoisperformingallorpartofthoseservicesunderthisContractunderaseparatecontractwiththeContractor.Theterms“subcontractor”and“subcontractors”meansubcontractor(s)inanytier.2.ALLWRITINGSCONTAINEDHEREINThisContractcontainsallthetermsandconditionsagreeduponbytheparties.Nootherunderstandings,oralorotherwise,regardingthesubjectmatterofthisContractshallbedeemedtoexistortobindanyofthepartieshereto.3.AMENDMENTSThisContractmaybeamendedbymutualagreementoftheparties.Suchamendmentsshallnotbebindingunlesstheyareinwritingandsignedbypersonnelauthorizedtobindeachoftheparties.4.ASSIGNMENTNeitherthisContract,workthereunder,noranyclaimarisingunderthisContract,shallbetransferredorassignedbytheContractorwithoutpriorwrittenconsentofCOMMERCE.5.CONFIDENTIALITYANDSAFEGUARDINGOFINFORMATIONA.“ConfidentialInformation”asusedinthissectionincludes:i.AllmaterialprovidedtotheContractorbyCOMMERCEthatisdesignatedas“confidential”byCOMMERCE;ii.AllmaterialproducedbytheContractorthatisdesignatedas“confidential”byCOMMERCE;andiii.AllpersonalinformationinthepossessionoftheContractorthatmaynotbedisclosedunderstateorfederallaw.B.TheContractorshallcomplywithallstateandfederallawsrelatedtotheuse,sharing,transfer,sale,ordisclosureofConfidentialInformation.TheContractorshalluseConfidentialInformationsolelyforthepurposesofthisContractandshallnotuse,share,transfer,sellordiscloseanyConfidentialInformationtoanythirdpartyexceptwiththepriorwrittenconsentofCOMMERCEorasmayberequiredbylaw.TheContractorshalltakeallnecessarystepstoassurethatConfidentialInformationissafeguardedtopreventunauthorizeduse,sharing,transfer,saleordisclosureofConfidentialInformationorviolationofanystateorfederallawsrelatedthereto.Uponrequest,theContractorshallprovideCOMMERCEwithitspoliciesandproceduresonconfidentiality.StateofWashingtonInteragencyAgreementVersion072019DepartmentofCommercePage5 GENERALTERMSANDCONDITIONSINTERAGENCYAGREEMENTFEDERALFUNDSCOMMERCEmayrequirechangestosuchpoliciesandproceduresastheyapplytothisContractwheneverCOMMERCEreasonablydeterminesthatchangesarenecessarytopreventunauthorizeddisclosures.TheContractorshallmakethechangeswithinthetimeperiodspecifiedbyCOMMERCE.Uponrequest,theContractorshallimmediatelyreturntoCOMMERCEanyConfidentialInformationthatCOMMERCEreasonablydetermineshasnotbeenadequatelyprotectedbytheContractoragainstunauthorizeddisclosure.C.UnauthorizedUseorDisclosure.TheContractorshallnotifyCOMMERCEwithinfive(5)workingdaysofanyunauthorizeduseordisclosureofanyconfidentialinformation,andshalltakenecessarystepstomitigatetheharmfuleffectsofsuchuseordisclosure.6.COPYRIGHTUnlessotherwiseprovided,allMaterialsproducedunderthisContractshallbeconsideredworksforhire”asdefinedbytheU.S.CopyrightActandshallbeownedbyCOMMERCE.COMMERCEshallbeconsideredtheauthorofsuchMaterials.IntheeventtheMaterialsarenotconsidered“worksforhire”undertheU.S.Copyrightlaws,theContractorherebyirrevocablyassignsallright,title,andinterestinallMaterials,includingallintellectualpropertyrights,moralrights,andrightsofpublicitytoCOMMERCEeffectivefromthemomentofcreationofsuchMaterials.“Materials”meansallitemsinanyformatandincludes,butisnotlimitedto,data,reports,documents,pamphlets,advertisements,books,magazines,surveys,studies,computerprograms,films,tapes,and/orsoundreproductions.“Ownership”includestherighttocopyright,patent,registerandtheabilitytotransfertheserights.ForMaterialsthataredeliveredundertheContract,butthatincorporatepre-existingmaterialsnotproducedundertheContract,theContractorherebygrantstoCOMMERCEanonexclusive,royalty-free,irrevocablelicense(withrightstosublicensetoothers)insuchMaterialstotranslate,reproduce,distribute,preparederivativeworks,publiclyperform,andpubliclydisplay.TheContractorwarrantsandrepresentsthattheContractorhasallrightsandpermissions,includingintellectualpropertyrights,moralrightsandrightsofpublicity,necessarytograntsuchalicensetoCOMMERCE.TheContractorshallexertallreasonableefforttoadviseCOMMERCE,atthetimeofdeliveryofMaterialsfurnishedunderthisContract,ofallknownorpotentialinvasionsofprivacycontainedthereinandofanyportionofsuchdocumentwhichwasnotproducedintheperformanceofthisContract.TheContractorshallprovideCOMMERCEwithpromptwrittennoticeofeachnoticeorclaimofinfringementreceivedbytheContractorwithrespecttoanyMaterialsdeliveredunderthisContract.COMMERCEshallhavetherighttomodifyorremoveanyrestrictivemarkingsplacedupontheMaterialsbytheContractor.7.DISPUTESIntheeventthatadisputearisesunderthisAgreement,itshallbedeterminedbyaDisputeBoardinthefollowingmanner:EachpartytothisAgreementshallappointonemembertotheDisputeBoard.ThememberssoappointedshalljointlyappointanadditionalmembertotheDisputeBoard.TheDisputeBoardshallreviewthefacts,Agreementtermsandapplicablestatutesandrulesandmakeadeterminationofthedispute.TheDisputeBoardshallthereafterdecidethedisputewiththemajorityprevailing.ThedeterminationoftheDisputeBoardshallbefinalandbindingonthepartieshereto.Asanalternativetothisprocess,eitherofthepartiesmayrequestinterventionbytheGovernor,asprovidedbyRCW43.17.330,inwhicheventtheGovernor’sprocesswillcontrol.8.GOVERNINGLAWANDVENUEThisContractshallbeconstruedandinterpretedinaccordancewiththelawsofthestateofWashington,andanyapplicablefederallaws,andthevenueofanyactionbroughthereundershallbeintheSuperiorCourtforThurstonCounty.StateofWashingtonInteragencyAgreementVersion072019DepartmentofCommercePage6 GENERALTERMSANDCONDITIONSINTERAGENCYAGREEMENTFEDERALFUNDS9.INDEMNIFICATIONEachpartyshallbesolelyresponsiblefortheactsofitsemployees,officers,andagents.10.LICENSING,ACCREDITATIONANDREGISTRATIONTheContractorshallcomplywithallapplicablelocal,state,andfederallicensing,accreditationandregistrationrequirementsorstandardsnecessaryfortheperformanceofthisContract.11.RECAPTUREIntheeventthattheContractorfailstoperformthisContractinaccordancewithstatelaws,federallaws,and/ortheprovisionsofthisContract,COMMERCEreservestherighttorecapturefundsinanamounttocompensateCOMMERCEforthenoncomplianceinadditiontoanyotherremediesavailableatlaworinequity.RepaymentbytheContractoroffundsunderthisrecaptureprovisionshalloccurwithinthetimeperiodspecifiedbyCOMMERCE.Inthealternative,COMMERCEmayrecapturesuchfundsfrompaymentsdueunderthisContract.12.RECORDSMAINTENANCETheContractorshallmaintainbooks,records,documents,dataandotherevidencerelatingtothiscontractandperformanceoftheservicesdescribedherein,includingbutnotlimitedtoaccountingproceduresandpracticesthatsufficientlyandproperlyreflectalldirectandindirectcostsofanynatureexpendedintheperformanceofthiscontract.TheContractorshallmaintainrecordsthatidentify,initsaccounts,allfederalawardsreceivedandexpendedandthefederalprogramsunderwhichtheywerereceived,byCatalogofFederalDomesticAssistance(CFDA)titleandnumber,awardnumberandyear,nameofthefederalagency,andnameofthepass-throughentity.TheContractorshallretainsuchrecordsforaperiodofsix(6)yearsfollowingthedateoffinalpayment.Atnoadditionalcost,theserecords,includingmaterialsgeneratedunderthecontract,shallbesubjectatallreasonabletimestoinspection,revieworauditbyCOMMERCE,personneldulyauthorizedbyCOMMERCE,theOfficeoftheStateAuditor,andfederalandstateofficialssoauthorizedbylaw,regulationoragreement.Ifanylitigation,claimorauditisstartedbeforetheexpirationofthesix(6)yearperiod,therecordsshallberetaineduntilalllitigation,claims,orauditfindingsinvolvingtherecordshavebeenresolved.13.SAVINGSIntheeventfundingfromstate,federal,orothersourcesiswithdrawn,reduced,orlimitedinanywayaftertheeffectivedateofthisContractandpriortonormalcompletion,COMMERCEmaysuspendorterminatetheContractunderthe“TerminationforConvenience”clause,withoutthetencalendardaynoticerequirement.Inlieuoftermination,theContractmaybeamendedtoreflectthenewfundinglimitationsandconditions.14.SEVERABILITYTheprovisionsofthiscontractareintendedtobeseverable.Ifanytermorprovisionisillegalorinvalidforanyreasonwhatsoever,suchillegalityorinvalidityshallnotaffectthevalidityoftheremainderofthecontract.15.SUBCONTRACTINGTheContractormayonlysubcontractworkcontemplatedunderthisContractifitobtainsthepriorwrittenapprovalofCOMMERCE.IfCOMMERCEapprovessubcontracting,theContractorshallmaintainwrittenproceduresrelatedtosubcontracting,aswellascopiesofallsubcontractsandrecordsrelatedtosubcontracts.Forcause,COMMERCEinwritingmay:(a)requiretheContractortoamenditssubcontractingproceduresastheyStateofWashingtonInteragencyAgreementVersion072019DepartmentofCommercePage7 GENERALTERMSANDCONDITIONSINTERAGENCYAGREEMENTFEDERALFUNDSrelatetothisContract;(b)prohibittheContractorfromsubcontractingwithaparticularpersonorentity;or(c)requiretheContractortorescindoramendasubcontract.EverysubcontractshallbindtheSubcontractortofollowallapplicabletermsofthisContract.Contractorshallincorporate2CFRPart200,SubpartFauditrequirementsintoallsubcontracts.TheContractorisresponsibletoCOMMERCEiftheSubcontractorfailstocomplywithanyapplicabletermorconditionofthisContract.TheContractorshallappropriatelymonitortheactivitiesoftheSubcontractortoassurefiscalconditionsofthisContract.InnoeventshalltheexistenceofasubcontractoperatetoreleaseorreducetheliabilityoftheContractortoCOMMERCEforanybreachintheperformanceoftheContractor’sduties.EverysubcontractshallincludeatermthatCOMMERCEandtheStateofWashingtonarenotliableforclaimsordamagesarisingfromaSubcontractor’sperformanceofthesubcontract.16.SURVIVALTheterms,conditions,andwarrantiescontainedinthisContractthatbytheirsenseandcontextareintendedtosurvivethecompletionoftheperformance,cancellationorterminationofthisContractshallsosurvive.17.TERMINATIONFORCAUSEIntheeventCOMMERCEdeterminestheContractorhasfailedtocomplywiththeconditionsofthiscontractinatimelymanner,COMMERCEhastherighttosuspendorterminatethiscontract.Beforesuspendingorterminatingthecontract,COMMERCEshallnotifytheContractorinwritingoftheneedtotakecorrectiveaction.Ifcorrectiveactionisnottakenwithin30calendardays,thecontractmaybeterminatedorsuspended.Intheeventofterminationorsuspension,theContractorshallbeliablefordamagesasauthorizedbylawincluding,butnotlimitedto,anycostdifferencebetweentheoriginalcontractandthereplacementorcovercontractandalladministrativecostsdirectlyrelatedtothereplacementcontract,e.g.,costofthecompetitivebidding,mailing,advertisingandstafftime.COMMERCEreservestherighttosuspendallorpartofthecontract,withholdfurtherpayments,orprohibittheContractorfromincurringadditionalobligationsoffundsduringinvestigationoftheallegedcompliancebreachandpendingcorrectiveactionbytheContractororadecisionbyCOMMERCEtoterminatethecontract.AterminationshallbedeemedaTerminationforConvenience”ifitisdeterminedthattheContractor:(1)wasnotindefault;or(2)failuretoperformwasoutsideofhisorhercontrol,faultornegligence.ThetightsandremediesofCOMMERCEprovidedinthiscontractarenotexclusiveandareinadditiontoanyotherrightsandremediesprovidedbylaw.18.TERMINATIONFORCONVENIENCEExceptasotherwiseprovidedinthisContract,COMMERCEmay,byten(10)businessdayswrittennotice,beginningontheseconddayafterthemailing,terminatethisContract,inwholeorinpart.IfthisContractissoterminated,COMMERCEshallbeliableonlyforpaymentrequiredunderthetermsofthisContractforservicesrenderedorgoodsdeliveredpriortotheeffectivedateoftermination.19.TERMINATIONPROCEDURESUponterminationofthiscontract,COMMERCE,inadditiontoanyothertightsprovidedinthiscontract,mayrequiretheContractortodelivertoCOMMERCEanypropertyspecificallyproducedoracquiredfortheperformanceofsuchpartofthiscontractashasbeenterminated.Theprovisionsofthe“TreatmentofAssets”clauseshallapplyinsuchpropertytransfer.COMMERCEshallpaytotheContractortheagreeduponprice,ifseparatelystated,forcompletedworkandservicesacceptedbyCOMMERCE,andtheamountagreeduponbytheContractorandCOMMERCEfor(i)completedworkandservicesforwhichnoseparatepriceisstated,(ii)partiallycompletedworkandservices,(iii)otherpropertyorservicesthatareacceptedbyCOMMERCE,and(iv)theprotectionandpreservationofproperty,unlesstheterminationisfordefault,inwhichcasetheAuthorizedRepresentativeshalldeterminetheextentoftheliabilityofCOMMERCE.FailuretoagreeStateofWashingtonInteragencyAgreementVersion072019DepartmentofCommercePage8 GENERALTERMSANDCONDITIONSINTERAGENCYAGREEMENTFEDERALFUNDSwithsuchdeterminationshallbeadisputewithinthemeaningoftheDisputesclauseofthiscontract.COMMERCEmaywithholdfromanyamountsduetheContractorsuchsumastheAuthorizedRepresentativedeterminestobenecessarytoprotectCOMMERCEagainstpotentiallossorliability.TherightsandremediesofCOMMERCEprovidedinthissectionshallnotbeexclusiveandareinadditiontoanyotherrightsandremediesprovidedbylaworunderthiscontract.Afterreceiptofanoticeoftermination,andexceptasotherwisedirectedbytheAuthorizedRepresentative,theContractorshall:A.Stopworkunderthecontractonthedate,andtotheextentspecified,inthenotice;B.Placenofurtherordersorsubcontractsformaterials,services,orfacilitiesexceptasmaybenecessaryforcompletionofsuchportionoftheworkunderthecontractthatisnotterminated;C.AssigntoCOMMERCE,inthemanner,atthetimes,andtotheextentdirectedbytheAuthorizedRepresentative,alloftherights,title,andinterestoftheContractorundertheordersandsubcontractssoterminated,inwhichcaseCOMMERCEhastheright,atitsdiscretion,tosettleorpayanyorallclaimsarisingoutoftheterminationofsuchordersandsubcontracts;D.Settlealloutstandingliabilitiesandallclaimsarisingoutofsuchterminationofordersandsubcontracts,withtheapprovalorratificationoftheAuthorizedRepresentativetotheextenttheAuthorizedRepresentativemayrequire,whichapprovalorratificationshallbefinalforallthepurposesofthisclause;E.TransfertitletoCOMMERCEanddeliverinthemanner,atthetimes,andtotheextentdirectedbytheAuthorizedRepresentativeanypropertywhich,ifthecontracthadbeencompleted,wouldhavebeenrequiredtobefurnishedtoCOMMERCE;F.CompleteperformanceofsuchpartoftheworkasshallnothavebeenterminatedbytheAuthorizedRepresentative;andG.Takesuchactionasmaybenecessary,orastheAuthorizedRepresentativemaydirect,fortheprotectionandpreservationofthepropertyrelatedtothiscontract,whichisinthepossessionoftheContractorandinwhichtheAuthorizedRepresentativehasormayacquireaninterest.20.WAIVERWaiverofanydefaultorbreachshallnotbedeemedtobeawaiverofanysubsequentdefaultorbreach.AnywaivershallnotbeconstruedtobeamodificationofthetermsofthisContractunlessstatedtobesuchinwritingandsignedbyAuthorizedRepresentativeofCOMMERCE.StateofWashingtonInteragencyAgreementVersion072019DepartmentofCommercePage9 AttachmentAScopeofWorkThisfundingismadeavailableundersection601(a)oftheSocialSecurityAct,asaddedbysection5001oftheCoronavirusAid,Relief,andEconomicSecurityAct(“CARESAct”)andSectionVandVIoftheCARESAct,forcostsincurredduetothepublichealthemergencywithrespecttotheCoronavirusDisease2019(COVID-19).UndertheCARESAct,theCoronavirusReliefFundmaybeusedtocovercoststhat:1.ArenecessaryexpendituresincurredduetothepublichealthemergencywithrespecttotheCoronavirusDisease2019fCOVID—19);AND2.ArenotaccountedforinthebudgetmostrecentlyapprovedasofMarch27,2020(thedateofenactmentoftheCARESAct)fortheStateorgovernment.ThesefundsmaybeusedtoreimburseforexpendituresincurredduringtheperiodofMarch1,2020thruOct.31,2020.Pleasenote:InordertoensureallfundshavebeenfullyutilizedpriortotheUSTreasury’sDecember30,2020enddate,theStateofWashingtonmustcloseoutcontractsbyOctober31,2020.AllfinalrequestsforreimbursementmustbereceivednolaterthanNovember15,2020.Expendituresmustbeusedfornecessaryactionstakentorespondtothepublichealthemergency.Thesemayincludeexpendituresincurredtoallowthelocalgovernmenttoresponddirectlytotheemergency,suchasbyaddressingmedicalorpublichealthneeds,aswellasexpendituresincurredtorespondtosecond-ordereffectsoftheemergency,suchasbyprovidingeconomicsupporttothosesufferingfromemploymentorbusinessinterruptionsduetoCOVID-19-relatedbusinessclosures.Fundsmaynotbeusedtofillshortfallsingovernmentrevenuetocoverexpendituresthatwouldnototherwisequalifyunderthestatute.Althoughabroadrangeofusesisallowed,revenuereplacementisnotapermissibleuseofFundpayments.PaymentsmaybeusedonlytocovercostsjaccountedforinthebudgetmostrecentlyapprovedasofMarch27,2020.Acostmeetsthisrequirementifeither:1.Thecostcannotlawfullybefundedusingalineitem,allotment,orallocationwithinthatbudget;OR2.Thecostisforasubstantiallydifferentusefromanyexpecteduseoffundsinsuchalineitem,allotment,orallocation.The“mostrecentlyapproved”budgetistheenactedbudgetfortherelevantfiscalperiodfortheparticulargovernment.Acostisnotconsideredtohavebeenaccountedforinabudgetmerelybecauseitcouldbemetusingabudgetarystabilizationfund,rainydayfund,orsimilarreserveaccount.Allowableexpendituresinclude,butarenotlimitedto:1.Medicalexpensessuchas:a.COVID-19-relatedexpensesofpublichospitals,clinics,andsimilarfacilities.b.ExpensesofestablishingtemporarypublicmedicalfacilitiesandothermeasurestoincreaseCOVID-19treatmentcapacity,includingrelatedconstructioncosts.c.CostsofprovidingCOVID-19testing,includingserologicaltesting.d.Emergencymedicalresponseexpenses,includingemergencymedicaltransportation,relatedtoCOVID-19.e.ExpensesforestablishingandoperatingpublictelemedicinecapabilitiesforCOVID-19-relatedtreatment.2.Publichealthexpensessuchas:StateofWashingtonInteragencyAgreementVersion072019DepartmentofCommercePage10 AttachmentAa.ExpensesforcommunicationandenforcementbyState,territorial,local,andTribalgovernmentsofpublichealthordersrelatedtoCOVID-19.b.Expensesforacquisitionanddistributionofmedicalandprotectivesupplies,includingsanitizingproductsandpersonalprotectiveequipment,formedicalpersonnel,policeofficers,socialworkers,childprotectionservices,andchildwelfareofficers,directserviceprovidersforolderadultsandindividualswithdisabilitiesincommunitysettings,andotherpublichealthorsafetyworkersinconnectionwiththeCOVID-19publichealthemergency.c.Expensesfordisinfectionofpublicareasandotherfacilities,e.g.,nursinghomes,inresponsetotheCOVID-19publichealthemergency.U.ExpensesfortechnicalassistancetolocalauthoritiesorotherentitiesonmitigationofCOVID19-relatedthreatstopublichealthandsafety.e.ExpensesforpublicsafetymeasuresundertakeninresponsetoCOVID-19.f.Expensesforquarantiningindividuals.3.Payrollexpensesforpublicsafety,publichealth,healthcare,humanservices,andsimilaremployeeswhoseservicesaresubstantiallydedicatedtomitigatingorrespondingtotheCOVID19publichealthemergency.4.ExpensesofactionstofacilitatecompliancewithCOVID-19-relatedpublichealthmeasures,suchas:a.Expensesforfooddeliverytoresidents,including,forexample,seniorcitizensandothervulnerablepopulations,toenablecompliancewithCOVID-19publichealthprecautions.b.Expensestofacilitatedistancelearning,includingtechnologicalimprovements,inconnectionwithschoolclosingstoenablecompliancewithCOVID-19precautions.c.ExpensestoimproveteleworkcapabilitiesforpublicemployeestoenablecompliancewithCOVID-19publichealthprecautions.d.ExpensesofprovidingpaidsickandpaidfamilyandmedicalleavetopublicemployeestoenablecompliancewithCOVID-19publichealthprecautions.e.COVID-19-relatedexpensesofmaintainingstateprisonsandcountyjails,includingasrelatestosanitationandimprovementofsocialdistancingmeasures,toenablecompliancewithCOVID-19publichealthprecautions.f.ExpensesforcareforhomelesspopulationsprovidedtomitigateCOVID-19effectsandenablecompliancewithCOVID-19publichealthprecautions.5.ExpensesassociatedwiththeprovisionofeconomicsupportinconnectionwiththeCOVID-19publichealthemergency,suchas:a.Expendituresrelatedtotheprovisionofgrantstosmallbusinessestoreimbursethecostsofbusinessinterruptioncausedbyrequiredclosures.b.ExpendituresrelatedtoaState,territorial,local,orTribalgovernmentpayrollsupportprogram.c.UnemploymentinsurancecostsrelatedtotheCOVID-19publichealthemergencyifsuchcostswillnotbereimbursedbythefederalgovernmentpursuanttotheCARESActorotherwise.6.AnyotherCOVID-19-relatedexpensesreasonablynecessarytothefunctionofgovernmentthatsatisfytheFund’seligibilitycriteria.StateofWashingtonInteragencyAgreementVersion072019DepartmentofCommercePage11
