HomeMy WebLinkAboutM_Malik Street Modification_200702_FINALDEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT ADMINISTRATIVE STREET MODIFICATION APPROVAL DENIAL EVALUATION FORM & DECISION PROJECT NAME: Malik SFR PROJECT NUMBER: LUA20-000143, B19006088 PROJECT MANAGER: Nathan Janders, Civil Engineer II APPLICANT: Paras Malik ZONING CLASSIFICATION: R8-Residential (8 DU/AC) PROJECT LOCATION: 713 N 33rd St SUMMARY OF REQUEST: Pursuant to RMC 4-9-250D, the applicant is requesting an Administrative Modification from RMC 4-6-060 - Street Standards to modify the Alley abutting both the western and southern property lines of parcel 3342100165 to maintain the existing street section except for approximately the north 120 Lineal Feet of the west alley that is proposed for access to a side load garage. BACKGROUND: The western and southern Alley have an existing right-of-way width of 12 feet per the King County Assessor’s Map. The existing Alley has improved portions but is unimproved along the property frontage. The unimproved portion of the southern alley contains three (3) significant trees while east of the project the southern alley is partially improved with a gravel roadway providing access to the abutting properties. The unimproved portion of the western alley contains steep slopes and abuts the existing structure on the adjacent parcel while south of the project the western alley is improved with a paved roadway providing access to the abutting properties. . Per RMC 4-6-060, Complete Street Standards, an Alley requires a minimum right-of-way width of 16 feet with a paved roadway width of 12 feet. Per RMC 4-4-080 for lots in the R-6 and R-8 zones abutting an alley, all parking areas and/or detached garages shall not occur in the front of the building and/or in the area between the front lot line and the front building line; parking areas and garages must occur at the rear or side of the building and vehicular access shall be taken from the alley. To meet the City’s Complete Street Standards, right-of-way dedication of approximately 2 feet with a minimum of 12 feet of paving is required along the western and southern property frontage. EXHIBITS: Exhibit 1: Site Plan ANALYSIS OF REQUEST: The Section 4-6-060Q.1 allows the Administrator to grant modifications provided the modifications meet the following criteria (pursuant to RMC 4-9-250D.2): Compliance Street Modification Criteria and Analysis  a. Substantially implements the policy direction of the policies and objectives of the Comprehensive Plan Land Use Element and the Community Design Element and the proposed modification is the minimum adjustment necessary to implement these policies and objectives. Staff Comment: By improving a portion of the western Alley the project is providing alley access from the side of the building as required by RMC 4-4-080.F.7.b; and the proposed modification does not limit other parcels abutting the alley from being able to have alley access. Therefore, the modification substantially meets the policy directives and objectives of the current City’s Comprehensive Plan. It is the minimum adjustment necessary to meet projected future use requirements.  b. Will meet the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements, based upon sound engineering judgment. Staff Comment: City staff has reviewed the Alley and surrounding area. The existing Residential Access streets surrounding the property (N 33rd st and N 32nd St) will provide the code required fire access. Three (3) significant trees are located in the alley and along the southern property line which will be retained with the modification whereas otherwise would need to be removed. Improvement of the alley, and future development along the alley, would require storm drainage improvements. Given the area topography and existing storm system, a storm main is likely to be required along the south alley which would impact the aforementioned significant trees. Given the above findings, staff has determined that the existing street section meets the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements.  c. Will not be injurious to other property(ies) in the vicinity. Staff Comment: Parcel 3342100170 abuts the west alley along the parcels east property line. Given the cross slope of the alley and the need to level and install a protective barrier, there is a high likelihood of damage to the existing structure if the alley is extended. In addition, all surrounding parcels have access from other public right of way. Therefore, by keeping the existing conditions in the alley reduces the risk of causing damage to adjacent properties and does not impact their access.  d. Conforms to the intent and purpose of the Code. Staff Comment: See comments under criterion ‘a and b’.  e. Can be shown to be justified and required for the use and situation intended; and Staff Comment: See comments under criterion ‘a, b and c’.  f. Will not create adverse impacts to other property(ies) in the vicinity. Staff Comment: See comments under criterion ‘a and c’. DECISION The proposal satisfies 6 of the 6 criteria listed in RMC 4-9-250D.2 for the requested modification.
