We understand that you own property that abuts the 12-foot right-of-way (alley), and we also understand that you have expressed concerns about the construction of this alley. I am going to do my best to respond to your concerns. The City of Renton was dedicated the 12-foot right-of-way (ROW) in between the lots within your residential block as part of the original plat recorded in July 18, 1904. For your reference, enclosed is a copy of the original recorded plat map, an aerial image of the area taken from the City’s GIS mapping, as well as a copy of the survey produced by the Applicant showing ROW/property lines and City tree locations. Over the years, homeowners have used land in the area that is ROW, they have erected fences, built sheds, and installed new landscaping (trees, shrubs, retaining walls, etc.) without consent or permission from the City of Renton. While the City did not enforce and require removal of these features, the presence of fences, landscaping and the like do not create ownership of the ROW. As a courtesy to property owners, we are requesting that the Applicant move the fences to the surveyed property lines. This will be done at no cost to the existing property owners. However, trees located in the alley ROW will need to be removed to allow in order for construction of the alley to proceed. We understand that this may come as a surprise to you, especially given that you have enjoyed use of the ROW for many years. The Applicant is within their rights to continue with construction of the alley as designed.
