Each local agency must follow the rules and regulations set forth by The Americans with Disabilities Act of 1990, and if the agency receives Federal funding must also meet requirements set by Section 504 of the Rehabilitation Act of 1973.While neither law requires Maximum Extent Feasible(MEF) documentation,the Federal Highway Administration (FHWA)and the United- States Access Board recommend that these instances be documented (per WSDOT LAG Manual Chapter 29). If a project is receiving Federal Funding,Washington State Department of Transportation (WSDOT) requires that MEF Documentation be completed(per WSDOT LAG Manual Chapter 29). According to the Department of Justice 2010 ADA Standards for Accessible Design, "The phrase 'to the maximum extent feasible/...applies to the occasional case where the nature of an existing facility makes it virtually impossible to comply with applicable accessibility standard through a planned alteration."The purpose of the MEF documentation is to document the accessibility of the existing features and to document when design features cannot be made fully compliant. This alteration project extends along Duvall Ave NE from NE 41h Street to NE 10th Street(shown in the Exhibit A Vicinity Map of Section 6 of this document). The project includes a full-width 2"grind and overlay,full width pavement repair, utility adjustments, roadway channelization and curb ramp upgrades. Pedestrian facilities at NE 61h Street, NE 7th Place, and NE 8th Street and NE 9th Street were determined to need redesign to meet ADA standards. In this document, pedestrian design requirements designed to the MEF and non-compliant features that occur frequently throughout the project are listed in Section 4 and discussed to avoid repetition. Each curb ramp that contains a non-compliant feature are then listed. For specific geometric properties of the curb ramps can be found in Appendix A. 2 Existing Pedestrian Facilities The purpose of this project is to improve the pedestrian mobility and infrastructure at each of the project locations. Pedestrian facilities were evaluated at each intersection of this project.At the locations evaluated,the existing pedestrian facilities are either non-compliant or do not have existing facilities in place. This project falls under the classification of an "alteration project," per the 2010 Department of Justice ADA Standards for Accessible Design,and hence must meet the following requirements for curb ramps per section 28 CFR 335.151 New Construction and Alterations: • Newly constructed or altered streets, roads,and highways must contain curb ramps or other sloped areas at any intersection having curbs or other barriers to entry from a street level pedestrian walkway. • Newly constructed or altered street level pedestrian walkways must contain curb ramps or other sloped areas at intersections to streets, roads,or highways. ADA MEF Documentation 1 Duvall Ave NE Pavement Preservation Project September 2016 i ,zw, Ai CM DESIGN GROUP s s :: 3 Pedestrian Design Requirements The following standards and guidelines have been incorporated and adhered to in design: • United States Department of Justice 2010 ADA Standards for Accessible Design • 2005 Public Right of Way Accessibility Guidelines(2005 PROWAG) • Washington State Department of Transportation(WSDOT) Design Manual (DM) • WSDOT LAG Manual,Chapter 29,Section 504 and the Americans with Disabilities Act In accordance with the WSDOT DM,the following requirements were used in design: • Curb Ramps—Cross Slope, DM Section 1510.09(2)(c),July 2013. The maximum cross slope in a ramp is 2%which means the maximum slope in the gutter for a perpendicular ramp is also limited to 2%. • Curb Ramps—Flares, DM Section 1510.09(2)(3),July 2013. The maximum slope of a flare is 10%. • Curb Ramps—Landing, DM Section 1510.09(2)(d),July 2013. The maximum cross slope and running slope in a landing is 2%. For parallel ramps,this means the maximum gutter slope is 2% also. The maximum warping rate used for ramp area between the gutter and the top of ramp for this project is 0.5%per foot. ADA requirements currently do not address warping curb ramps to obtain level landings when the gutter slope is over 2%. The rate of 0.5%per foot is based on engineering judgement and constructability limits observed in the field. 4 Roadway Parameters Roadway Classification: Principal arterial (Principal Arterial) Cross-street Classification: Principal Arterial (NE 4th St) Local street(NE 6th St) Local street(NE 7th PI) Local street(NE 8th St) Local street(NE 9th St) Local street(NE 101h St) Posted Speed: 35 mph ADT: 12,700 5 Justification There are several existing conditions or proposed design elements that occur frequently throughout this project that do not meet current ADA requirements. 5.1 Existing Gutter Slopes Existing grades in the gutter were maintained even if they exceeded the requirement of 2%maximum since re-profiling the road would be required to make them compliant. This type of major reconstruction,to re-profile the roadway,is beyond the scope of this project. Simply warping the gutter without re-profiling the road does not eliminate the steep grade, but rather pushes it further into the ADA MEF Documentation 2 Duvall Ave NE Pavement Preservation Project September 2016 CM DESIGN GROUP traveled lane and creates an undesirable grade change at the point where the new construction ties into the existing roadway. The existing gutter slope of the following ramps exceeded the maximum slope requirement of 2%: • Duvall Ave NE&NE 71h Place—Ramp 1 (3.1%) 5.2 Parallel Ramp Landing Running Slope If a parallel ramp is placed on a curb radius with a non-compliant gutter slope,the cross slope of the parallel ramp landing will also be non-compliant.A compliant landing cross slope is not feasible without reconstructing the gutter slope.As stated in Section 4.1,constructing a compliant gutter slope would require re-profiling the roadway and is beyond the scope of this project. The parallel ramp landing running slope of the following ramps exceed the design standard of 2.0%: • Duvall Ave NE&NE 6th Street—Ramp 5 (2.4%) • Duvall Ave NE&NE 7th Place—Ramp 1 (4.0%) 5.3 Existing Counter Slopes Counter slopes exceeding the 5%maximum requirement were maintained since the major reconstruction of the road required to make them compliant is beyond the scope of this project. Warping the pavement only in the 4'x 4' clear space at the bottom of the ramps to make the counter slope compliant would create an undesirable grade change in the roadway when the surrounding pavement is tied into. The counter slope of the following ramps exceeded the maximum slope requirement of 2%: • Duvall Ave NE&NE 6th Street—Ramp 2(7.0%) 5.4 Grade Break greater than 13.3% Due to the existing terrain,the grade break in front of a curb ramp could have an algebraic difference greater than 13.3%.This difference could be caused by a counter slope greater than 5%or a ramp running grade greater than the standard 8.3%.
