PROJECT LOCATION:Located within Riverview Park, south of Maple Valley Hwy and SE 5th ST
PROJECT DESCRIPTION:The applicant is requesting a Shoreline Exemption to top one (1) black cottonwood tree
located (28 caliper inches) within Riverview Park (parcel number 1623059033). The
property (See Exhibit 2) is 502,246 square feet, zoned Resource Conservation (RC),
and is located in Cedar River Reach C, designation Urban Conservancy. The proposed
tree for removal is located within the shoreline buffer. The tree is located along the
northern edge of Riverview Park and extends over the river towards Maple Valley Hwy.
The City's Urban Forester, Ian Gray, has assessed the tree's health and states that the
tree exhibits severe lean (25 degree angle) towards Maple Valley Hwy and poses a
safety hazard. Ian Gray states that if the tree were to fail it would reach the roadway
and potentially hit road users. A crane is proposed to be used to reach over to the tree
so the top can be pruned and reduced by one third. The applicant states that this will
reduce the likelihood of the tree failing and will eliminate the risk of the tree striking the
roadway if it does. It is anticipated that the tree may remain viable and will continue to
protect the river bank from similar flooding events following pruning. No access or
equipment is proposed from the opposite river bank at the base of the tree, so no soil
disturbance will occur during this operation.

EXEMPTION JUSTIFICATION: An exemption from a Shoreline Management Substantial Development Permit is hereby
Approved on the proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and for the
following reasons:
The project meets the requirements of an emergency as the tree in its current condition is classified as an Extreme Hazard
threatening public heath and safety.
The proposed development is:
Consistent with the policies of the Shoreline Management Act.
Consistent with the guidelines of the Department of Ecology where no Master Program has been finally approved or
adopted by the Department.
Consistent with the City of Renton Shoreline Master Program.

RECONSIDERATION: Within 14 days of the decision date, any party of record may request that the decision be reopened
by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the
original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if
the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal
period. Any person wishing to take further action must file a formal appeal within the 14 day appeal time frame.
APPEALS: The administrative land use decision will become final if not appealed in writing together with the required fee
to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057 on or before 5:00 pm, on April 23, 2020
(RCW 43.21.C075(3); WAC 197-11-680). RMC 4-8-110 governs appeals to the Hearing Examiner and additional
information regarding the appeal process may be obtained from the Renton City Clerk's office, Renton City Hall, 7th Floor,
(425) 430-6510.
EXPIRATION: Two (2) years from the date of decision (date signed)

Project Description
The shoreline exemption requested pertains to urgent mitigation work required for public safety on a
leaning tree in the Cedar River. A 28” inch DBH Black Cottonwood was undercut and had its root plate
scoured during the flooding in February 2020. It has leaned over at an approximately 25 degree angle
towards the Maple Valley Highway on the other side of the river. If it were to fail it would reach the
roadway and potentially hit road users. On April 10, 2020 a crane will be used to reach over to the tree
so the top can be pruned and reduced by one third. This will reduce the likelihood of the tree failing and
will eliminate the risk of the tree striking the roadway if it does. There is every chance that the tree will
remain viable and will continue to protect the river bank from similar flooding events. No access or
equipment is need from the opposite river bank at the base of the tree so no soil disturbance will occur
during this operation. Photos and a site map are included below.
