As the Applicant, you are requesting an adjustment from the 2017 RSWDM Chapter 5, Section 5.1.3.1, Design Criteria/Setback (5-foot setback between vault and tract/easement). More specifically, you are requesting an adjustment to:  Shift the proposed stormwater vault five (5) feet to the east so that the east wall of the vault is located on the lot line between Lot 1 and the storm drainage tract, and  Create a 5-foot private storm drainage easement on Lot 1 specifically for vault access and maintenance. FINDING OF FACTS (FOF): 1. The proposed stormwater vault will be privately maintained by the home owners within the Cedar Ridge Short Plat. 2. Access for maintenance of the stormwater vault will be provided utilizing the proposed private storm drainage easement located on Lot 1. 3. In accordance with RSWDM Chapter 4, Section 4.1.2, a five (5) foot building setback will be required between the private storm drainage easement and the building on Lot 1, which maintains the same setback as what is provided currently without the proposed vault shift. 4. Conformance with RSWDM, Chapter 1, Section 1.4.2, Criteria for Granting Adjustments. Compliance Conformance with Criteria for Granting Adjustments  (see FOFs 1-3) The Storm Drainage Adjustment shall: 1. Produce a compensating or comparable result that is in the public interest, AND 2. Meet the objectives of safety, function, appearance, environmental protection, and maintainability based on sound engineering judgement. Satwant Singh October 9 2020 Page 2 of 2 DECISION: The storm drainage adjustment request conforms to the storm drainage adjustment criteria, therefore your request is approved with the following condition: 1. A five (5) foot wide private drainage easement on the western 5-feet of Lot 1 shall be recorded on the final short plat for the benefit of all lots within the Cedar Ridge Short Plat. This private easement shall be graded flat to increase maintainability of the stormwater vault.
