HomeMy WebLinkAboutCity - Request for Reconsideration to the Hearing Examiner Decision_Apex LLA Appeal October 23, 2020 SUBJECT: Hearing Examiner Decision – Apex Lot Line Adjustment Appeal Apex Lot Line Adjustment, LUA20-000064, LLA City’s Request for Limited Reconsideration Mr. Hearing Examiner: The City of Renton submits this request for limited reconsideration of the Hearing Examiner Decision, dated October 9, 2020, regarding the Apex Lot Line Adjustment Appeal. The City has two concerns regarding the Hearing Examiner Decision. First, the decision states that the application for a lot line adjustment is granted without conditions. This implies that the lot line adjustment is approved as-is, without any revisions to ensure compliance with the City code requirements for a Lot Line Adjustment Map per RMC 4-8- 120.D.12, as well as King County recording standards. City staff issued its decision regarding the Lot Line Adjustment application on a denial basis, which means that the City did not provide comment to the applicant for any revisions that would be necessary to obtain approval. Therefore, staff requests that the Hearing Examiner reconsider and issue an amended decision to require as a condition of approval that the applicant submit a revised Lot Line Adjustment submittal to the City for review against RMC 4-8-120.D.12 and King County recording standards. After compliance is achieved, City staff will approve the Lot Line Adjustment for recording. The second concern is regarding existing encroachments onto what will become Lot 3 from parcel 9133600045 (not included in this Lot Line Adjustment). These encroaching improvements were not mapped by the surveyor, but are shown on aerial photos and were referenced by the Appellant in the appeal process in front of the Hearing Examiner. After the Hearing Examiner’s City’s Request for Limited Reconsideration October 23, 2020 Page 2 decision issued, it came to City staff’s attention that the property owners for Lot 3, James and Lynette Lotterer, were not included in the correspondence for the Appeal request or Hearing Examiner decision due to an error with the parties of record list. The City’s concern is that the boundary dispute will be transferred to the new property owners without their full knowledge of the encroachments. Therefore, City staff requests that the parties of record be provided an opportunity to comment to prevent any miscommunication regarding the boundary disputes. City staff has copied Mr. and Mrs. Lotterer on this request for limited reconsideration.
