APPLICANT/CONTACT: Suzanne Cameron / Around The Clock, Inc. / 716 West Meeker Street, Suite 101, Kent, WA 98032 PROJECT LOCATION: 264140TRCT (West of 10359 SE 187th PL) PROJECT DESCRIPTION: The applicant is requesting a Critical Areas Exemption to reduce one 19 inch (19”) caliper Red Alder within Fredericks Place Plat, Tract “D” (Attachment C), directly to the west of 10359 SE 187th PL (Parcel Identification Number 264140TRCT). The applicant provided an Arborist Report, prepared by Davey Resource Group, Inc (dated October 2020; Attachment A), with the project application, which was later reviewed by the City's Arborist, Ian Gray. The Arborist Report concludes that the tree is hazardous due to poor health, crown dieback, and a 20 degree lean towards the nearby home located at 10359 SE 187th PL (APN 2641400420). The applicant proposes to reduce the tree to a wildlife snag in order to mitigate any potential risk that the tree poses to the nearby home. City Arborist, Ian Gray, concurs with the Arborist Report’s assement, provided that the tree is reduced to a 20-foot wildlife snag (Attachment B). The Arborist Report does not identify the height of the proposed habitat snag; therefore, staff recommend as a condition of approval that the Red Alder tree be reduced to a habitat snag no less that 20 feet (20’) in height. In addition, the tree debris shall be retained within the critical area tract (Fredericks Place Tract “D”), where feasible. CRITICAL AREA: Panther Creek, Type Ns Stream EXEMPTION JUSTIFICATION: Renton Municipal Code, Section 4-3-050C.3.c.iii. Limited to cutting of dangerous trees; such hazardous trees shall be retained as large woody debris in critical areas and/or associated buffers, where feasible. FINDINGS: The proposed development is consistent with the following findings pursuant to RMC section 4-3-050.C.2.d: i. The activity is not prohibited by this or any other provision of the Renton Municipal Code or State or Federal law or regulation; ii. The activity will be conducted using best management practices as specified by industry standards or applicable Federal agencies or scientific principles; iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored; iv. Where water body or buffer disturbance has occurred in accordance with an exemption during construction or other activities, revegetation with native vegetation shall be required; v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or substantial potential to degrade groundwater quality, then the Administrator may require compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material, activity, and/or facility. Such determinations will be based upon site and/or chemical-specific data. DECISION: An exemption from the critical areas regulations is approved and is subject to the following condition: 1.The Red Alder tree shall be reduced to a habitat snag no less that 20 feet (20’) in height. In addition, the tree debris shall be retained within the critical area tract (Fredericks Place Tract “D”), where feasible. APPEALS: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on November 12, 2020. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11- 680). Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. If the situation changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the appeal in person. RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. EXPIRATION: Five (5) years from the date of decision (date signed). On the basis of the report I don’t feel a site visit is required and as the tree in in decline I have no objections to the proposed removal and leaving the trunk as a 20’ foot wildlife snag. The owner of lot 42, Laurie Mitchell, contacted him about a diseased tree leaning over their home in the native growth protection easement located next to their back fence. The owner mistakenly thought the tree was owned by the City of Renton and Ian pointed out to her that the tree is owned by her homeowners association. The owner then emailed me, the Association Manager, asking for the tree removal and I notified the Association’s Board of Directors. The Association has determined the leaning tree is diseased and a hazard to the safety of the homeowners based on the opinion of a neighbor’s arborist and the owner of a tree service. They have secured and approved a bid to reduce the tree to a 20 foot snag to avoid the tree falling on the home. Attached is a plat map highlighting the lot and location of the leaning tree, a copy of the email correspondence between Laurie Mitchell, lot owner and Ian Gray, City of Renton and the bid from Top Cut Tree Services, a licensed and bonded company. I will forward pictures the owner took separately. While the tree appears to be around 40 feet tall, it does not appear to be greater than 30 inches in diameter at chest height. Please advise us on whether a permit is required to alter the tree, and if it is needed, how we obtain a permit and the timeline? The contractor is available next Wednesday, October 21st to reduce the size of the hazardous tree. Otherwise, his schedule is several more weeks out. Given the change of weather and high winds we have been experiencing, we are concerned about the safety of the homeowners. Thank you for your assistance.
