The proposed site (Exhibit 1) is vacant commercial land that is located in the Commercial Arterial (CA) Zone and Design District ‘D’. The 7,821 square foot site is owned by DSB Commercial Properties who are leasing this space to the applicant (Exhibit 2) as well as a Mobile Food Vendor who is located on the southern end of the parcel (Exhibit 3). There are no currently existing structures on the parcel, and the site has two-way vehicular access available off of S 4th Pl. Along with the proposed parking area, on the eastern edge of the site, the applicant notes that there are marked parking stalls on the neighboring parcel owned by DSB Commercial Properties at 4th Place Plaza (APN 9228900070) available for customers to utilize and walk up to the pop- up tent (Exhibit 3). The temporary pop-up tent lease allows business operation for four (4) days a week between the hours of ten o’clock (10:00) am to seven o’clock (7:00) pm for clothing retail sales; however, the applicant is pursuing an extension of the lease to operate seven (7) days a week during the same hours of operation. The applicant may update the days of operation by submitting a revised lease to the Current Planning Project Manager reflecting these changes prior to the date of expiration. The applicant is proposing to have one (1) sign onsite: a 3’ x 8’ banner reading “Kettle Kingdom” fixed to the western side of the tent facing Rainier Ave S. However, the proposed pop-up tent is not an outdoor extension of any the existing retail businesses at 4th Place Plaza. According to the zoning use table, retail sales are an allowed use in the CA zone and outdoor retail sales are limited to farmer’s markets, building, hardware and garden products, vending machines, and retail product lockers (RMC 4-2-080.A.15). Therefore, the proposed TUP shall only be valid for up to one (1) month while the applicant pursues relocation of the business to a storefront and no extension requests will be approved by the Administrator. The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions: *CONDITIONS OF APPROVAL: 1. A City of Renton Business license must be obtained prior to operation. 2. The applicant shall provide temporary ground level landscaping between the onsite decorative fence and the western face of the pop-up sales tent to improve and soften the appearance of the tent and outdoor retail space from Rainier Ave S. The final detailed landscape plan shall be reviewed and approved by the Current Planning Project Manager prior to building permit approval. 3. The applicant shall use high quality weather resistant materials for elements of this temporary use. Should the tent shelter become tattered or damaged prior to the expiration of this Temporary Use Permit, the structure shall be replaced. 4. The site occupied by the temporary use shall be left free of debris, litter, or other evidence of the temporary use upon completion of removal of the use, or when the operation of the use ceases to exist. 5. The site occupied by the temporary use shall be restored to the original condition when the use ceases to exist including restoration of site elements such as, but not limited to, landscaping vegetation and parking stall striping. 6. No extensions shall be granted for this Temporary Use Permit. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on November 23, 2020. Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. If the situation changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the appeal in person. EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless the Community & Economic Development Administrator or designee establishes a shorter time frame or an applicant can request that a permit be valid beyond the expiration date, for up to five years at the time of application or prior to permit expiration. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator. It will be just myself working and no additional employees. I will be throwing away garbage and recycling in the designated bins provided by the property. I am also able to use the bathroom at New Lookz salon or the Window Tinting business located on the property. Any signage we plan to use for the business will one 3’ x 8’ banner fixed to the tent with our business name. Our primary customers are considered to be walk-up ones but for the ones who are driving, there is parking on the other side of the lot with clear, marked parking spaces. There is also plenty of access on the side where the tent will be located to park and turn around or drive thru so they can get out from the other side of the property. There is plenty room for two way traffic but I primarily notice cars are parking on the other side of the building. The area will be safe for cars and pedestrians. There is enough room for everyone; otherwise, the property manager would not allow a lease there for vendors. The Clyde’s Southern Food BBQ truck located on the South end of the lot is the other vendor aside from me to be sharing that area of the parking lot. There is enough room for both of us to be there and will not hinder traffic or customer access in any way.
