HomeMy WebLinkAboutD_Roppe_Street_Modification_201103_V1DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT ADMINISTRATIVE STREET MODIFICATION APPROVAL DENIAL EVALUATION FORM & DECISION PROJECT NAME: Roppe SFR PROJECT NUMBER: LUA20-000260, C20003316 PROJECT MANAGER: Nathan Janders, Civil Engineer II APPLICANT: Vicki Cale ZONING CLASSIFICATION: Residential-4 du/ac (R-4) PROJECT LOCATION: 14005 160th Ave SE SUMMARY OF REQUEST: Pursuant to RMC 4-9-250D, the applicant is requesting an Administrative Modification from RMC 4-6-090 and RMC 4-6-060 to retain the existing overhead utility lines fronting the property along this portion of 160th Ave SE. BACKGROUND: The applicant is constructing a new home to replace the existing one that was lost to a fire in February of 2017. RMC 4-10-050 allows for legally established single family dwellings to be rebuilt to its same size, location and height if a building permit is applied for within one (1) year of the fire; the applicant made a complete building permit application in December of 2018. The applicant has endured personal legal difficulty and non-responsive contractors, both of which played a role in submission of the building permit application extending beyond 1 year from date of fire. In addition, the applicants insurance is not providing coverage for utility undergrounding other than the individual service to the home. The applicant is proposing to construct a new home that is similar in design, size and shape to the original home while also installing all other code required frontage improvements (curb, gutter, planting strip and sidewalk) along 160th Avenue SE. Substantially implements the policy direction of the policies and objectives of the Comprehensive Plan Land Use Element and the Community Design Element and the proposed modification is the minimum adjustment necessary to implement these policies and objectives; Staff Comment: The Comprehensive Plan Land Use Element has applicable policies listed under a separate section labeled Promoting a Safe, Healthy, and Attractive Community. The intent of the policies is to promote new development with walkable places that support grid and flexible grid street and pathway patterns, and are visually attractive, safe, and healthy environments. The proposed project will install a planting strip and sidewalk, which provides the benefit of a safe and walkable pathway. Although the street modification does not provide the aesthetic allure of removing existing overhead utilities, City Staff recognizes that the Applicant: • Would have been granted relief if a building permit application had been submit within 1 year of the fire, • Has shown to be making a reasonable effort to obtain the necessary permits, and • Will be installing curb, gutter, planting strip and sidewalk in accordance with complete streets standards. In addition, City Staff acknowledges that the modification provides the minimum adjustment necessary to implement the Comprehensive Plan Land Use Element. In order to facilitate undergrounding of this system in the future, Staff recommends as conditions of approval that (1) the new and existing services to the property are undergrounded, and (2) that the existing pole is located within the proposed planting strip, which may require the pole to be relocated. Compliant if condition of approval is met b. Will meet the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements, based upon sound engineering judgment; Staff Comment: City staff has reviewed 160th Avenue SE and the surrounding area. Retaining the existing overhead will provide the safety, function, environmental protection, and maintainability as intended by Code for pedestrian access. Appearance is generally met provided that the staff recommended conditions of approval noted in criterion ‘a’ are met.  c. Will not create substantial adverse impacts to other property(ies) in the vicinity; Staff Comment: There are no identified any substantial adverse impacts to other properties from the requested modification. See comments under criterion ‘b’.  d. DECISION The proposal satisfies 6 of the 6 criteria listed in RMC 4-9-250D.2 for the requested modification. Therefore, the street modifications for Roppe SFR located at 14005 160th Ave SE Project Number LUA20-000260, C20003316 is Approved with the following conditions. 1. The existing pole within the frontage improvements shall be located within the proposed planting strip which may require the existing pole to shifted based on the proposed improvements. 2. All existing and new electrical or communication facilities serving the property shall be installed underground pursuant to RMC 4-6-090. _______________ Brianne Bannwarth, Development Engineering Manager Date The decision to approve the modification will become final if not appealed in writing together with the required fee to the City Clerk’s Office on or before 5:00 pm, on November 30, 2020. Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
