HomeMy WebLinkAboutCI-162 XI-162 Department of Community and Economic Development Planning Division ADMINISTRATIVE POLICY/CODE INTERPRETATION ADMINISTRATIVE POLICY/CODE INTERPRETATION #: CI-162 MUNICIPAL CODE SECTIONS: 4-2-110E REFERENCE: RMC 4-2-110A, 4-2-110E SUBJECT: Rear Yard Setback from Alley BACKGROUND: Currently, condition number 39 of RMC 4-2-110E, “Conditions Associated with Development Standards Table for Residential Zoning Designations,” applies to the rear yard setback for properties that abut an alley within the R-8, R-10, R-14, and RMF Zones. The purpose of the condition is to ensure that garages and carports that are accessed through alleys have adequate vehicular maneuvering area. The condition requires that garages and carports with nine-foot (9') garage doors be at least twenty six feet (26') from the back edge of the alley, and garages and carports with sixteen-foot (16') garage doors be at least twenty four feet (24') from the back edge of the alley. JUSTIFICATION: The code does not clarify that the condition number 39, as described above, does not serve to replace or circumvent the applicable rear yard setbacks that apply to the zones, but rather as an additional measure to ensure adequate vehicular maneuvering area for garages and carports that are accessed through the alleys, in addition to the applicable rear yard setback. DECISION: Amend RMC 4-2-115.E.39 to clarify that the setbacks that apply to garage doors from the back edge of an alley do not circumvent the applicable rear yard setback requirements of the zone. Project proposals must comply with both the applicable rear yard setback and the required garage door setback from the back edge of the alley. Your submittal should explain the basis for the appeal. Section 4-8-110 of the Renton Municipal Code provides further information on the appeal process. CODE AMENDMENTS NEEDED TO IMPLEMENT DETERMINATIONS: 4-2-110E CONDITIONS ASSOCIATED WITH DEVELOPMENT STANDARDS TABLE FOR RESIDENTIAL ZONING DESIGNATIONS: 39. In the R-8, R-10, R-14, and RMF zones: In addition to the applicable yard setback requirements of the zone and Tto ensure adequate vehicular maneuvering area, garages and carports that are accessed through alleys shall be set back as follows: a. Nine-foot (9') garage doors shall be at least twenty six feet (26') from the back edge of the alley; or b.
