CITYOFRENTON,WASHINGTONORDINANCENO.6003ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTION4-9-070.ROFTHERENTONMUNICIPALCODE,RELATINGTOTHESTATEENVIRONMENTALPOLICYACT(SEPA)APPEALSPROCESS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,thePlanningCommissionheldapublichearingonSeptember16,2020,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;andWHEREAS,pursuanttoRCW36.70A.106,onOctober6,2020,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-9-070.RoftheRentonMunicipalCodeisamendedasfollows:R.APPEALS:4--——ExceptforpermitsandvariancesissuedpursuanttoRMC4-3-090,ShorelineMasterProgramRegulations,whenanyproposaloractionisgranted,conditionedLordeniedonthebasisofSEPAsubstantiveauthoritybyanonelectedofficialotherthantheHearingExaminer,thedecisionshallbeappealabletotheHearingExaminerundertheprovisionsofRMC4-8-110,Appeals.Whensucha1 ORDINANCENO.6003proposaloractionisconditionedordeniedonthebasisofSEPAsubstantiveauthoritybyanelectedofficialorbytheHearingExaminer,thereshallbenoadministrativeappeal.2.ExceptforpermitsandvariancesissuedpursuanttoRMC43090,ShorelineMasterProgramRcgulations,whcnanyproposaloractionischallengedastoaSEPAproceduraldetermination,thereshallbcnoadministrativeappeal.SECTIONIll.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONIV.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis14thdayofDecember,2020.JasoA.Seth,ityClerkAPPROVEDBYTHEMAYORthis14thdayofDecember,2020.Pavone,Mayor2 ORDINANCENO.6003Approvedastoform:ShaneMoloney,CityAttorneyDateofPublication:12/17/2020(Summary)ORD:2126:10/5/20203
