An existing single-family residence is proposed for removal. The proposed lots would range in size from 5,000 square feet to 6,522 square feet. Access to the proposed lots would be provided via a shared driveway/alley off of NE 38th Street. Half street improvements, including paving, curb and gutter, landscaping with street trees, and sidewalk would be provided along the site's Lincoln Ave NE and NE 38th Street frontages. The site is mapped with erosion hazard areas, landslide hazard areas, sensitive slopes, and protected slopes. The applicant is proposing to retain 17 of the existing 102 significant trees located on the project site. A Modification to the City's adopted street standards has been requested for the portion of N 38th Street to the west of the proposed private access driveway. The applicant is requesting to waive the frontage improvements along the steep slopes and to limit the frontage improvements to a sidewalk, parking area, and landscaped courtyard over the proposed stormwater vault. Total Building Area GSF: N/A STAFF RECOMMENDATION: Staff Recommends that the Environmental Review Committee issue a Determination of Non-Significance- Mitigated (DNS-M). City of Renton Department of Community & Economic Development 38th Street Short Plat Staff Report to the Environmental Review Committee LUA18-000683, SHPL-A, ECF, MOD Report of June 17, 2019 Page 2 of 3 ERC_Report_38th Street Short Plat_FINAL ENVIRONMENTAL REVIEW In compliance with RCW 43.21C.240, the following environmental (SEPA) review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. A. Environmental Threshold Recommendation Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials: Issue a DNS-M with a 14-day Appeal Period. B. Mitigation Measures 1. Project construction shall comply with the recommendations outlined in the Geotechnical Engineering Report, prepared by ZipperGeo, dated October 12, 2018. 2. A 25-foot buffer and additional 15-foot building setback shall be required from the top edge of the protected slope area. C. Environmental Impacts The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether the applicant has adequately identified and addressed environmental impacts anticipated to occur in conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1. Earth Impacts: The project site is mapped with erosion hazard areas, landslide hazard areas, sensitive slopes, and protected slopes. The applicant submitted a Geotechnical Engineering Report (Exhibit 5), prepared by ZipperGeo, and dated October 12, 2018. According to the submitted report, the topography of the site slopes moderately down to the west to the top of a protected slope. The total vertical relief of the property occurs between the southeast and northwest property boundaries and is about 58 feet. Vegetation on the site generally consists of deciduous and coniferous trees and brush with areas of ornamental landscaping. Published maps indicate that the project site is underlain by Vashon Till, which is a non-sorted mixture of clay, silt, sand, pebbles, cobbles, and boulders in variable amounts. Subsurface conditions were evaluated through the completion of 2 test borings (B-1 and B-2) on the project site. Boring B-1 was conducted on the southeastern portion of the project site and boring B-2 was conducted on the southwestern portion of the project site. Both borings were advanced to a depth of about 41.5 feet below grade. Surficial soils conditions observed in the borings generally consisted of about 6 to 8 inches of forest duff and topsoil. Below the forest duff and topsoil, soil conditions observed in borings generally consisted of about 7 to 10 feet of loose to medium dense sand and silt. Below the loose to medium dense sand and silt, soil conditions observed in the borings generally consisted of medium dense to very dense sand and very stiff to hard silt to the completion depths of about 41.5 feet below existing site grade. Perched groundwater was encountered at a depth of about 15 feet in both borings. The submitted geotechnical report recommends a 25-foot buffer with an additional 15-foot building setback from the edge of the protected slope area. In addition, it is recommended that earthwork activities be conducted during the drier summer months (May 1-September 30). The report also includes recommendations for site preparation, structural fill materials and preparation, underground utilities, temporary and permanent slopes, residential building foundations, permanent foundation retaining walls, site retaining walls, rockeries, MSE and gravity block walls, stormwater infiltration feasibility, stormwater detention vault, on-grade concrete slabs, and permanent drainage. Staff recommends, as SEPA mitigation that the above mitigation recommended in the submitted Geotechnical Engineering Report (Exhibit 5) be required during project construction. The Environmental Determination decision will become final if the decision is not appealed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Environmental Determination Appeal Process: Appeals of the environmental determination must be filed in writing together with the required fee to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057, on or before 5:00 p.m. on July 5, 2019. RMC 4-8-110 governs appeals to the Hearing Examiner and additional information regarding the appeal process may be obtained from the City Clerk’s Office, Renton City Hall – 7th Floor, (425) 430-6510.
