The project site totals 1.73-acres (75,172 square feet) and is located within the Commercial Neighborhood (CN) zone and Urban Design District D. The existing development includes an 1,800-square-foot convenience store, a 2,000-square- foot fuel dispenser canopy, four (4) fuel dispensers, and three (3) 15,000-gallon gasoline Underground Storage Tanks (USTs). The project will include the removal of the three (3) USTs and installation of one (1) 20,000-gallon Regular Gasoline UST, one (1) 15,000-gallon Supreme Gasoline UST, and one (1) 12,000- gallon Diesel UST, along with four (4) new dispensers and associated product and vapor piping. The purpose of the project is to modernize the existing fuel system, including replacing USTs that are beyond their warranty period and to ensure the compliance with the latest environmental standards for retail gas stations. No changes in access to the project site are proposed. The project site is mapped with a Wellhead Protection Area, Zone 2. Exist. Bldg. Area SF: N/A Proposed New Bldg. A.Environmental Threshold Recommendation Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials: Issue a DNS-M with a 14-day appeal period B.Mitigation Measures 1.If any Native American grave(s) or archaeological/cultural resources (Indian artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the City of Renton planning department, concerned Tribes’ cultural committees, and the Washington State Department of 2. Archaeological and Historic Preservation C.Exhibits Exhibit 1:Environmental Review Committee (ERC) Report Exhibit 2:Conceptual Civil Plans Exhibit 3:Site Plan Exhibit 4:Technical Information Report (TIR), prepared by Barghausen Consulting Engineers, Inc., dated November 6, 2020 Exhibit 5: Advisory Notes Exhibit 6: Comment Email from Duwamish Tribe, dated 1/7 D.Environmental Impacts The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether the applicant has adequately identified and addressed environmental impacts anticipated to occur in conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1.Earth Impacts: The topography of the project site is flat. A geotechnical report was not required to be submitted with the land use application materials as there are no geologic hazards mapped on the project site requiring a geotechnical report and a geotechnical report was not required per the 2017 City of Renton Surface Water Design Manual. The proposed project would include the disturbance of approximately 2,300 square feet of impervious surface for the installation fuel tanks in place of older tanks and associated utilities. A preliminary analysis of cut/fill activity based on the Site Plan indicates the project would anticipate approximately 1,000 cubic yards of total earthwork. Most of the cut material would likely be hauled off site, but depending on existing soil conditions, the cut may be able to be re-compacted on site. The grading is proposed to match existing grading characteristics. Grading activity will utilize on-site material whenever possible, in an effort to minimize fill. All imported fill will be sourced from approved sites and documented accordingly. Excavations will occur to replace Underground Storage Tanks. It is anticipated that the City’s adopted Grading and Erosion Control regulations would mitigate any impacts that could result from the proposed tank removal; therefore, no further mitigation is recommended. Water a. Storm Water Impacts: The applicant submitted a Technical Information Report (TIR), prepared by Barghausen Consulting Engineers, Inc., dated November 6, 2020 (Exhibit 4). Based on the City’s flow control map, the site falls within the Peak Rate Flow Control Duration Standard area matching Existing Peak Conditions and is within the East Lake Washington drainage basin. The development is subject to Targeted Drainage Review Category 1 in accordance with the 2017 Renton Surface Water Design Manual (RSWDM). The total onsite disturbance anticipated for the underground storage tank replacement is 2,300 square feet. The proposed project is exempt from the requirement to provide flow control facilities as no new impervious surface is proposed. The proposed project would be subject to the requirements of the 2017 Renton Surface Water Design Manual, it is anticipated that any surface water impacts would be mitigated through the implementation of the adopted surface water requirements; therefore no further mitigation is recommended. Mitigation Measures: None recommended Nexus: N/A 3. Environmental Health Impacts: A Stormwater Pollution Prevention and Spill (SWPPS) Plan, dated November 6, 2020, prepared by Barghausen Consulting Engineers, Inc. (Exhibit 4) was submitted with the project application materials. It is anticipated that gasoline and diesel fuel will be stored onsite during construction. In the event of a spill, there will be an air horn onsite that will be used to assemble the crew to take care of the spill. The area around the spill will be secured and a waste removal contractor will be contacted (if necessary) to remove any hazardous waste that cannot be addressed by the contractor. Spill response materials will be located in the staging area shown on Temporary Erosion and Sediment Control Plan (Exhibit 2). Any disposal of any contaminated water or soil will be done in accordance with state and federal laws. Reports shall be completed and submitted to King County for any spills. If any fuel-impacted soils are encountered during the replacement of the underground storage tanks, clean-up would be required to comply with the Washington State Department of Ecology Standards; therefore, no further mitigation is recommended. Mitigation Measures: None recommended Nexus: N/A 4. Historic and Cultural Preservation Impacts: Staff received an email from the Duwamish Tribe on January 7, 2021, which stated that there may be archeological resources on the project site, due to the site’s proximity to May Creek and Lake Washington. Staff did not receive comments from the Washington State Department of Archeology and Historic Preservation (DAHP) or the Muckleshoot Tribe regarding mapped archeological deposits on the project site. Staff recommends that archaeological monitoring along the project corridor occur during construction to ensure appropriate treatment of intact significant artifacts or deposits, if any exist. Mitigation Measure: If significant artifacts are discovered during construction, any work shall stop until coordination with the DAHP and Native American tribes has occurred and the City has authorized work in that segment to resume. If any Native American grave(s) or archaeological/cultural resources (Indian artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the City of Renton planning department, concerned Tribes’ cultural committees, and the Washington State Department of Archeological and Historic Preservation. The Environmental Determination decision will become final if the decision is not appealed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Environmental Determination Appeal Process: Appeals of the environmental determination must be filed in writing on or before 5:00 p.m. on January 26, 2021. Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
