HomeMy WebLinkAboutORD 6011CITYOFRENTON,WASHINGTONORDINANCENO.6011ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,ANNEXINGCERTAINTERRITORYTOTHECITYOFRENTON(GRAVESANNEXATION;FILENO.A-19-OO1)ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,undertheprovisionsofRCW35A.14.120,asamended,awrittenannexationpetitionwaspresentedandfiledwiththeCityClerkonoraboutNovember19,2019;andWHEREAS,theareatobeannexed,knownastheGravesAnnexation,isapproximately21.5acresandislocatedattheeasternportionofCitylimits.ItisborderedbySE128thStreettothenorth,62dAvenueSEtotheeast,SE130thStreetandparcellinestothesouth,and;52thAvenueSEtothewest.TheboundarytothewestiscoterminouswithexistingCitylimits.TheareatobeannexedislegallydescribedanddepictedinExhibitA,attachedheretoandmadeaparthereofasiffullysetforth(theProperty”or“areatobeannexed”);andWHEREAS,priortothefilingandcirculationofthepetitionforannexationtotheCityofRenton,pursuanttoRCW35A.14.120,thepetitioningparties,comprisedofpropertyownersofnotlessthantenpercent(10%)invalue,accordingtotheassessedvaluationforgeneraltaxationoftheareatobeannexed,notifiedtheCityCounciloftheirintentiontocommencethedirectpetitionforannexationproceedings;andWHEREAS,afterapublichearing,itwasdeterminedthatthepetitioningownersagreedtoacceptthatportionoftheCity’sComprehensivePlanasitpertainstotheareatobeannexedincludingtheapplicablezoningregulationrelatingthereto;andWHEREAS,theKingCountyDepartmentofAssessmentsexaminedandverifiedthesignaturesonthepetitionforannexationonoraboutMay26,2020,anddeterminedthatthe1
ORDINANCENO.6011signaturesrepresentatleastsixtypercent(60%)oftheassessedvalue(excludingstreets)oftheareatobeannexed,asrequiredbyRCW35A.14.120;andWHEREAS,theDepartmentofCommunityandEconomicDevelopmentoftheCityofRentonconsideredandrecommendedthattheCityofRentonannextheProperty;andWHEREAS,consistentwithRCW35A.14.130,theCityCouncilsetJuly6,2020,intheCityCouncilChambers,CityHall,asthetimeandplaceforapublicheatingonthepetitionwithnoticeasrequiredbylaw;andWHEREAS,pursuanttonotice,thepublichearingwasheldatthetimeandplacespecified,andtheCityCouncilconsideredallmattersinconnectionwiththepetitionanddeterminedthatalllegalrequirementsandproceduresapplicabletotheRCW35A.14.120petitionmethodforannexationhavebeenmet;andWHEREAS,a“NoticeofIntention,”includingallrequiredinformationforreviewoftheannexation,wastransmittedtotheKingCountyBoundaryReviewBoardandapprovedasofDecember7,2020;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.Allrequirementsofthelawinregardtotheannexationbythedirectpetitionmethod,includingtheprovisionsofRCW35A.14.120,130,140,and150havebeenmet.ItisfurtherdeterminedthatthepetitionforannexationtotheCityofRentonofthePropertyisherebyapprovedandgranted;thePropertybeingcontiguoustothecitylimitsoftheCityofRentonisherebyannexedtotheCityofRenton,andsuchannexationtobeeffectiveonandaftertheapproval,passage,andthirty(30)daysafterpublicationofthisordinance;andonandafter2
