HomeMy WebLinkAboutD_Cherie Lane Fee-In-Lieu Request_20210216_V1.pdf February 16, 2021 Edward Mecum, PE Encompass Engineering 165 NE Juniper Street, Suite 201 Issaquah, WA 98027 SUBJECT: REQUEST FOR FEE-IN-LIEU OF CONSTRUCTING FRONTAGE IMPROVEMENTS CHERIE LANE SHORT PLAT (LUA20-000251) Dear Mr. Mecum: The City of Renton has reviewed your request to pay a Fee-In-Lieu of constructing the required Talbot Road South half street improvements along the proposed project’s western property line (approximately 30-feet) while still proposing to provide the required right of way (ROW) dedication of 11.5-feet. BACKGROUND: Talbot Road South is classified as a Collector Arterial Road. Existing ROW width is approximately 60 feet. Frontage improvements are required by Renton Municipal Code (RMC) 4-6-060 for projects that exceed $150,000 valuation. To meet the City’s complete street standards for Collector Arterial streets, the minimum ROW is 83 feet. Dedication of 11.5-feet of ROW fronting the site will be required. Per City code 4-6-060, half street improvements shall include a pavement width of 46 feet (23 feet from centerline), a 0.5-foot curb, an 8-foot planting strip, an 8-foot sidewalk, street trees and storm drainage improvements. ANALYSIS: RMC 4-9-060.C.9(c) allows the Administrator to authorize the applicant to pay a fee-in-lieu of constructing street improvements for single family infill lots and short plats provided the request meets one of the identified circumstances in the section. Since the project frontage is only approximately 30 lineal feet along Talbot Road South, the required street improvements would result in an unusual circumstance where the improvements would consist of a driveway access only due to the short length of Talbot Road South and would not construct meaningful improvements anticipated by the code. Therefore, per circumstance RMC 4-9-060.C.9(c)(iv), “other unusual circumstances preclude the construction of the improvements as required”, City Staff recommends approval of the fee-in-lieu of street improvements. City Staff does recommend a condition of approval that ROW dedication be provided to not preclude the street improvements from being constructed in the future when more of the improvements can be constructed along the roadway corridor than what is required of the proposed project. Mr. Mecum Page 2 of 2 February 16, 2021 DECISION: The fee-in-lieu of street improvements along Talbot Road South as requested by the applicant is approved with a condition as the request meets one of the circumstances identified in RMC 4-9-060.C.9(c)(iv). Condition of Approval: Right-of-way dedication of 11.5-feet along the western project property line along Talbot Road South shall be required. A deed of dedication and Real Estate Excise Tax Affidavit (REETA) shall be submitted as part of the Final Short Plat Application and shall be recorded with King County Recorder’s Office along with the Final Short Plat. This decision to approve the fee-in-lieu request with a condition is subject to a fourteen (14) day appeal period from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed with the City Clerk, along with the required appeal fee, by 5:00 pm, March 2, 2021. Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. If the situation changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the appeal in person.
