Dear Nathan Janders,
This letter is in regard to building permit at 207 Garden Ave N, Parcel #7564600270.
Project Narrative:
Improvement Determination for 207 Garden Avenue North included a Modified Right of
Way per city code 4-6-060. The determination states: The City will support efforts to
retain the existing frontage along Garden Avenue North under the following conditions:
The curb, sidewalk, and driveway must meet ADA and City standards.
We are requesting to move the lot access point and maintain current city sidewalks and
planning strips to match current neighborhood standards as suggested by the city. The
current sidewalk has access on the south end of the property in the intersection. For
safety reasons, the 9’ lot access would be moved to the north end of the lot to Garden
Avenue.
Modification:
The request is inline with city design for safety and beautification. The current lot access
is at a street intersection which is dangerous for both pedestrians and motorists. Our
request would remove the traffic hazard.
Justification:
a)The modification substantially meets the policy directives and objectives of the
current City’s Comprehensive Plan. It is the minimum adjustment necessary to
meet projected future use requirements.
b)The request will meet safety, function, appearance, and maintainability
requirements intended in code 4-6-060.
c)The request will not be injurious to other property(ies) in the vicinity.
d)The request does conform to the intent and purpose of the code and will match
surrounding sidewalks.
e)The request meeting the code, adding safety for both pedestrians and motorists,
removing a traffic hazard, is a good reason for the request. The city supports
efforts for safety and beautification.
f)The modification will not harm or impact the surrounding properties in the vicinity
as it will match all other sidewalks and in good condition.
