PROJECT DESCRIPTION: The King County Drainage District No. 1 is requesting a Shoreline Exemption renewal for the maintenance of 11,197 lineal feet of shoreline along the Springbrook Creek from SW 43rd Street to SW 16th Street that will occur over a five-year period beginning August 22, 2021. The project involves the removal of overgrown vegetation including grass and brush along the banks of the creek to reduce blockage of the channel. Vegetation will be removed from the edge of Springbrook Creek within a 10-foot wide area from the edge of the waterway. Brush would be cut at a height no greater than 6-inches above the existing ground. A measuring device that is 10 feet in length will be used to verify adequate brush removal from within the clearing zone. Cut brush and grass from the site will be removed and disposed offsite. Garbage and debris within the channel will also be removed as authorized by the Drainage District. Vegetation removal will occur annually between September 15 and December 31. All cut vegetative debris will be promptly removed and no fallen trees in the channel will be removed without authorization. All work will be completed above the Ordinary High Water Mark with the exception of possible removal of trash/debris in the water. The Drainage District has provided a proposed enhancement plan that would be implemented in certain areas of corridor where work will be performed. Enhancement plantings consist of Big Leaf Maple, Paper Birch, Pacific Dogwood, Oregon Ash, Pacific Ninebark, Quaking Aspen, Douglas Fir, Western Red Cedar, and Western Hemlock. Previous Shoreline Exemption Permits dating back to 1997 have been issued (LUA97-142, LUA00 129, LUA05-070, LUA07-076, LUA11-087, and LUA16-000577) for this scope of work. The current permit expires on August 22, 2022. LEGAL DESCRIPTION: Not Applicable (multiple locations) SEC-TWN-R: S24-T23N-R4E, S25-T23N-R4E, and S 36-T23N-R4E WATER BODY: Springbrook Creek EXEMPTION JUSTIFICATION/DECISION: An exemption from a Shoreline Management Substantial Development Permit is hereby Approved on the proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and for the following reasons: WAC 173.27.040(2)(b) - Normal maintenance or repair of existing structures or developments, including damage by accident, fire or elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substant ial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or enviro nment. The proposed development is: Consistent with the policies of the Shoreline Management Act. Not Applicable to the guidelines of the Department of Ecology where no Master Program has been finally approved or adopted by the Department. Consistent with the City of Renton Shoreline Master Program. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: The administrative land use decision will become final if not appealed in writing to the Hearinge Examiner on or before 5:00 p.m. on April 13, 2021. An appeal of the decision(s) must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. If the situation changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the app eal in person.
