The curved fence would sit on the curved eastern property line between the existing residence and Blaine Ave NE. The subject property is located within the R-8 zone and is developed with one (1) single family house. The applicant has proposed a six (6) foot tall fence for privacy and continuity with the existing fence on the property, rather than the maximum four-foot tall fence required by RMC4-4-040D.3.d. The proposed privacy fence would be constructed utilizing composite materials. The applicant has proposed a five (5)foot wide landscaping strip rather than the required eight (8) foot wide planting area to accommodate for the 10 feet of clearance required in the right of way next to the paved section of Blaine Ave NE. ANALYSIS: The applicant's justification for an increased height allowance is due to the subject property being a through lot and a six (6) foot tall fence would not detract from the aesthetics of the subject property or neighboring properties and provide privacy to their rear yard area. City staff agrees with the applicant's justification for the increased height and concurs that the proposed fence strikes an appropriate balance between preserving private space and protecting the safety and aesthetics of the neighborhood. Therefore, staff recommends approval of this Special Fence Permit request as submitted. DECISION: The Special Fence Permit is hereby Approved with Conditions* and subject to the following conditions: *CONDITIONS OF APPROVAL: 1.The applicant shall install a five (5) foot wide strip of continuous permanent landscaping as shown on the planting plan (Exhibit 3) with salal, kinnikinick, topsoil, mulch, and irrigation abutting the proposed fence and along the entire eastern property line without gaps unless the applicant receives approval or shows evidence of existing approval from the City for a driveway to Blaine Ave NE. There shall be no less than ten (10) feet of existing grass area abutting the paved section of Blaine Ave NE. 2.The applicant shall schedule a final inspection of the fence and landscaping with the Current Planning Project Manager no later than October 6, 2021. SIGNATURE & DATE OF DECISION: Vanessa Dolbee, Planning Director Date ADVISORY NOTE: The applicant should contact the Utility Notification Center, by dialing 800-424-5555, to determine the location of underground utilities (telephone, streetlights, cable, electric), which may be located behind the sidewalk. APPEAL: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on April 20, 2021. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov.. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. If the situation changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the appeal in person. RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame.
