OTHER UTILITY PROVIDERS. THE OWNERS OF LOTS 1, 2, AND 3 ARE HEREBY RESPONSIBLE FOR THE
MAINTENANCE OF THEIR RESPECTIVE PRIVATE UTILITY FACILITIES AND SHALL SHARE EQUALLY IN THE
MAINTENANCE RESPONSIBILITIES OF THE PRIVATE FACILITIES USED IN COMMON. PARKING ON THE PAVING IN
THE ACCESS EASEMENT IS PROHIBITED, UNLESS PAVEMENT WIDTH IS GREATER THAN 20 FEET. THE
EASEMENT HEREIN SHALL RUN WITH THE LAND AND SHALL FOREVER BE BINDING UPON ALL PARTIES, THEIR
HEIRS, SUCCESSORS AND ASSIGNS.
EASEMENT PROVISIONS
1. THE 10—FOOT WIDE LANDSCAPE AND PRIVATE STORM DRAINAGE EASEMENT WITHIN LOT 1 IS FOR THE BENEFIT
OF LOTS 1, 2 AND 3. THE OWNERS OF SAID LOTS SHALL BE EQUALLY RESPONSIBLE FOR THE MAINTENANCE OF THE
LANDSCAPING AND STORM DRAINAGE FACILITIES WITHIN THIS EASEMENT.
2. THE PUBLIC WATER EASEMENT WITHIN LOTS 1, 2, 3 AND TRACT A IS GRANTED TO THE CITY OF RENTON TO
INSTALL, MAINTAIN, REPLACE, REPAIR AND OPERATE WATER SYSTEMS FOR THIS SUBDIVISION AND OTHER
PROPERTY, TOGETHER WITH THE RIGHT TO ENTER UPON SAID EASEMENTS AT ALL TIMES FOR THE PURPOSES
STATED. STRUCTURES SHALL NOT BE CONSTRUCTED UPON ANY AREA RESERVED FOR EASEMENTS.
3. THE 10—FOOT WIDE PRIVATE STORM DRAINAGE EASEMENT WITHIN LOT 3 IS FOR THE BENEFIT OF LOTS 1, 2 AND
3. THE OWNER OF LOT 3 SHALL BE RESPONSIBLE FOR THE MAINTENANCE OF THEIR RESPECTIVE PRIVATE
STORM DRAINAGE FACILITIES WITHIN SAID EASEMENT AND SHALL SHARE EQUALLY WITH THE OWNERS OF LOTS
1 AND 2 IN THE MAINTENANCE RESPONSIBILITIES OF THE PRIVATE FACILITIES USED IN COMMON WITHIN SAID

4. AN EASEMENT IS HEREBY RESERVED FOR AND CONVEYED TO PUGET SOUND ENERGY, INC., CENTURY LINK,
COMCAST CABLE SERVICES, THE CITY OF RENTON AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS UNDER
AND UPON THE PRIVATE STREET(S), IF ANY, AND THE EXTERIOR TEN (10) FEET OF ALL LOTS, TRACTS AND
SPACES WITHIN THE PLAT LYING PARALLEL WITH AND ADJOINING ALL STREET(S) IN WHICH TO CONSTRUCT,
OPERATE, MAINTAIN, REPAIR, REPLACE AND ENLARGE UNDERGROUND PIPES, CONDUITS, CABLES AND WIRES
WITH ALL NECESSARY OR CONVENIENT UNDERGROUND OR GROUND —MOUNTED APPURTENANCES THERETO FOR
THE PURPOSE OF SERVING THIS SUBDIVISION AND OTHER PROPERTY WITH ELECTRIC, GAS, TELEPHONE AND

MAINTAINING UTILITIES AND UTILITY PIPELINES, INCLUDING, BUT NOT LIMITED TO, WATER, SANITARY SEWER,
AND STORM DRAINAGE, TOGETHER WITH THE RIGHT OF INGRESS AND EGRESS THERETO WITHOUT PRIOR
INSTITUTION OF ANY SUIT OR PROCEEDINGS OF LAW AND WITHOUT INCURRING ANY LEGAL OBLIGATION OR
LIABILITY THEREFOR. FOLLOWING THE INITIAL CONSTRUCTION OF ITS FACILITIES, THE CITY MAY FROM TIME TO
TIME CONSTRUCT SUCH ADDITIONAL FACILITIES AS IT MAY REQUIRE. THIS EASEMENT IS SUBJECT TO THE
FOLLOWING TERMS AND CONDITIONS:
A. THE CITY OF RENTON, UPON COMPLETION OF ANY WORK WITHIN THE PROPERTY COVERED BY THE
EASEMENT, SHALL RESTORE THE SURFACE OF THE EASEMENT, AND ANY PRIVATE IMPROVEMENTS
DISTURBED OR DESTROYED DURING EXECUTION OF THE WORK, AS NEARLY AS PRACTICABLE TO THE
CONDITION THEY WERE IN IMMEDIATELY BEFORE COMMENCEMENT OF THE WORK OR ENTRY BY THE
CITY.
B. THE PROPERTY OWNER(S) SHALL RETAIN THE RIGHT TO USE THE SURFACE OF THE EASEMENT AS
LONG AS SUCH USE DOES NOT INTERFERE WITH THE EASEMENT RIGHTS GRANTED TO THE CITY. THE
PROPERTY OWNER(S) SHALL NOT, HOWEVER, HAVE THE RIGHT TO:
I. ERECT OR MAINTAIN ANY BUILDINGS OR STRUCTURES WITHIN THE EASEMENT; OR
II. PLANT TREES, SHRUBS OR VEGETATION HAVING DEEP ROOT PATTERNS WHICH MAY CAUSE
DAMAGE TO OR INTERFERE WITH THE UTILITIES TO BE PLACED WITHIN THE EASEMENT BY THE
CITY; OR
III. DEVELOP, LANDSCAPE, OR BEAUTIFY THE EASEMENT AREA IN ANY WAY WHICH WOULD
UNREASONABLY INCREASE THE COSTS TO THE CITY OF RESTORING THE EASEMENT AREA AND
ANY PRIVATE IMPROVEMENTS THEREIN; OR
IV. DIG, TUNNEL OR PERFORM OTHER FORMS OF CONSTRUCTION ACTIVITIES ON THE PROPERTY
WHICH WOULD DISTURB THE COMPACTION OR UNEARTH CITY'S FACILITIES ON THE
RIGHT—OF—WAY, OR ENDANGER THE LATERAL SUPPORT FACILITIES; OR
V. BLAST WITHIN FIFTEEN (15) FEET OF THE EASEMENT; OR
VI. ERECT FENCES IN SUCH A WAY AS TO PREVENT ACCESS BY THE CITY'S VEHICLES TO THE
CITY'S FACILITIES. ANY FENCE CONSTRUCTION MUST PROVIDE FOR AN OPENING (GATED,
REMOVABLE SECTIONS, BARRIERS, ETC.) OF AT LEAST TEN (10) FEET IN WIDTH; OR
VII. ERECT ANY OBJECTS WITHIN FIFTEEN (15) ABOVE THE GROUND SURFACE WITHIN THE
EASEMENT.
C. GRADING AND/OR CONSTRUCTION WITHIN ANY PUBLIC EASEMENT SHALL NOT BE ALLOWED UNLESS
PRIOR REVIEWED AND APPROVED BY THE CITY OF RENTON.

AQUIFER PROTECTION NOTICE
THE LOTS CREATED HEREIN FALL WITHIN ZONE (1 OR 2) OF RENTON'S AQUIFER PROTECTION AREA AND ARE
SUBJECT TO THE REQUIREMENTS OF THE CITY OF RENTON ORDINANCE FF4367. THIS CITY'S SOLE SOURCE
OF DRINKING WATER IS SUPPLIED FROM A SHALLOW AQUIFER UNDER THE CITY SURFACE. THERE IS NO
NATURAL BARRIER BETWEEN THE WATER TABLE AND GROUND SURFACE. EXTREME CARE SHOULD BE

PATIOS AND DRIVEWAYS SHALL BE CONNECTED TO THE PERMANENT STORM DRAINAGE OUTLET AS SHOWN ON
THE APPROVED CONSTRUCTION DRAWINGS ON FILE WITH THE CITY OF RENTON (PLANS NO. R-4014) OR
ADDRESSED IN THE SINGLE FAMILY RESIDENTIAL BUILDING PERMIT REVIEW ON FILE WITH THE CITY OF
RENTON. ALL CONNECTIONS TO THE DOWNSTREAM DRAINAGE SYSTEM SHALL BE IN COMPLIANCE WITH THE
CITY OF RENTON STANDARDS. ALL CONNECTIONS OF THE DRAINS MUST BE CONSTRUCTED AND APPROVED
PRIOR TO FINAL BUILDING INSPECTION APPROVAL.
2. SINGLE FAMILY RESIDENCES AND OTHER IMPROVEMENTS CONSTRUCTED ON THE LOTS CREATED BY THIS
